Drilling and Irrigation services drilled a well promised water with no sand. 4 months later and our water is still full of sand. We want a full refund
We hired Brad's Drilling and Irrigation Services, LLC in April and he promised to drill a well that supplied water with no sand. He billed us for a well that was over 120 feet deep. He then went to the health department and got a permit to drill 85 feet. In the beginning of May, he only drilled 85 feet and the water from the well was full of sand. He left without fixing the issue and kept saying that the sand was in the lines and it will clear up in a few days. A few days later, we called him and told him we still had sand. He asked to give it a few weeks and run the water at the pump to get all the sand out of the lines. We did as instructed and called him a few weeks later to tell him we still had sand. He then blamed us and said we were purging the well by letting out the water at the pump (those were his instructions to begin with).

The sand has messed up our appliances in the home and I had to personally install a sand filter and a sediment filter. We have to constantly change these filters and I have to flush out the sand filter almost every single day. Brad kept blaming us and finally sent an employee to check the well. He said that if the sand wasn't coming from the well he was going to charge us $75 for sending someone. Brad's employee used his own pump and said that the sand was coming straight from the well and it wasn't coming from our equipment or our water lines.

Even with the employee's acknowledgement, Brad kept diverting the blame and would not accept responsibility. He then said he would put a sock on it and if that doesn't clear up the water, he would give us a full refund. We agreed and Brad put a sock on the well. The sock did not stop the sand. I still have to flush the sand filter almost every single day and I have had to replace 2 sand filters and 4 sediment filters. The sand filters are supposed to be good for 6 months and the sediment filters are supposed to be good for 3 months but not with the lousy well that Brad drilled. When we told him that it hadn't improved, he kept blaming us and diverting blame. He then refused to give us a refund and said that he would just pull the pipes higher. We called several well drillers in Stuart and they all said the same thing, "You have to go to 115 feet or lower for sand free water. Going higher will not fix the problem."

So, we went to the health department and they said that if he pulls the pipes higher, the water is more susceptible to ground contamination. We relayed this message to Brad and he said that the only thing he was willing to do was go higher with the well and not deeper. We asked for our money back and he refused. We have gone 4 months with water full of sand and Brad refuses to fix the issue or give us a refund. He said there is a 5 year warranty on the well and he still won't fix the issue so his warranty isn't worth the paper it is printed on.

This left us no choice but to call and hire another well drilling company to drill our well which will be drilled tomorrow (September 27th). We left a negative reviews about Brad and his lousy work on *** as well as all the other review sites on September 19th and received a certified letter from Brad today (September 26th) asking to call and schedule to have a new well drilled. It has been over 4 MONTHS!! Over four months and $2,015.00 spent without clear water. On top of that we spent hundreds of dollars on sand/sediment filters and only when we made the issue public was he willing to address it. He never proposed to dig us a new well until September 26th and by that time we had already hired a new well company. Brad refused to give us a refund and his proposition to go higher would have left us with contaminated water. This is unacceptable and we want a full refund. We already put down a deposit with another well company 2 weeks ago because Brad refused to help us. Drilling and Irrigation Services, LLC are a bunch of liars, cheats and crooks and we demand a full refund.

Desired Outcome

We want a full refund of $2,015.00. Brad (Drilling and Irrigation Services, LLC) promised water without sand and gave us the run around for over 4 months. We will accept nothing less than a full refund. My wife is pregnant and having Brad bring the pipes higher (proposed by Brad) to give us water more susceptible to contamination is not an acceptable resolution.

I was notified by the customer *** on Thursday 06/29/17 by Text msg that he still had sand coming into the system. I immediately responded by phone and offered to pull the Well Screen out of the Well and put it into a different Producing Zone. The customer indicated that he wanted to be there for the Well warranty work and that he would find out which day the following week that he would be able to be home for the Warranty work. Then there was no contact from the customer to me for almost 3 months, then on Monday September 18th, 2017, I get a text message from ***, (by this time I had thought that the Sand had stopped after not hearing from them for close to 3 months). Mrs. started right out stating that she was not going to allow me to warranty the Well which has a 5 Year Written Warranty. I offered to come Warranty the Well 7 Times during the text conversation with Mrs.. At the end of our text conversation Mrs. asked me "which day I could come to re-drill the Well?", to which I responded "you can choose any day next week Tues.- Friday." After which I got "No Response". So I followed up with a Letter (attached)dated 09/21/17 by Certified (***) and Regular Mail stating that their Well was under Warranty and that they could choose any day that was convenient for them for me to come to Warranty the Well. To this day I have still received No Response from the ***'s. This is a first for me as I have Drilled over 11,000 Wells under my License, and have been Drilling for over 33 Years in Central Florida. This is the first Customer that has ever refused to let me Warranty a Well.

I would like to address a couple of claims that the Customer has brought forward.

1. that I agreed to Drill a 120' Well, when the fact is the contract signed by *** (attached) does not state any "agreed Well Depth" only that a 2" Private Well with (NO Guaranteed Depth). He also Signed a Permit Application (attached) for the New Well which clearly states that the New Well would be an "estimated" 85' deep.
The Well was ultimately Drilled to a Total Depth of 94' deep.

2. Mr. also claimed that I would give him his money back, however, we only offer a refund after we exhaust all options to us like Drilling into a different Producing Zones, or Changing Screens, Etc. I have a large overhead incurred in this Job, and am willing to Warranty this Well per the Contract signed by myself and the Customer.

Unfortunately, I have exhausted all options with the ***'s which has brought us to this point.

To anyone reading this, please think about this. If Brad was willing to drill a new well or go deeper with the current well, why would we spend another $2,000 to hire another well drilling company so that we could have clean water? Brad is a LIAR. We are a single income family and $2,000 is not a small amount of money for us. If Brad was willing to make this right, why would we go out and hire another well driller and pay them another $2,000? The answer is simple. Brad was not willing to do the right thing.

The only thing Brad was willing to do was pull the pipe up so that it was even less than 85 feet deep. That is what he means by a different Producing Zone. We told him that this was not a suitable option because of ground water contamination. Even the Health Department warned us that it was a very bad idea. Several other Well Drillers we called also said that it was a horrible idea for the area we live in. We told Brad that we lived next to two defunct gas stations as well as 1 working gas station. We also told him that a drainage ditch ran right along the property line and that the area we live in was very susceptible to ground water contamination. His response was, "I'm not willing to dig deeper because it will break the screen and at this point I would be losing money on the well." We told him we wanted a new well and we didn't want a shallow well and he refused every time.

My wife is pregnant, so why on Earth would we risk our health as well as our unborn child's health with contaminated water just to save Brad the Crook a few dollars?

The claims that Brad would like to address:

1. Brad said that he never said the well would be 120' deep. He said it several times and I should have thought to look for it in the contract. I didn't know he was a liar and a crook at that time so it never crossed my mind that he would be such a *** The new well we had drilled by Ray's Well Drilling charged us the same amount as Brad. They drilled 120' deep and we have clean and clear water. Why would they charge us the exact same amount since the charge is calculated by how far deep you must drill? They had no prior knowledge of how much Brad charged us.

2. Brad said he never offered to refund our money and that is not true. Before Brad installed the screen on the well, he said that he would give us our money back if the screen didn't work because it wasn't worth it for him to keep coming out to Stuart (he is based in Melbourne) and he would be losing money at that point. When the screen didn't work, we asked for our money back and he refused. He said he would come over and pull the pipes up so that it was even less than 85' deep and we refused because of the potential for ground water contamination. Brad said trying to go deeper would break the screen so no matter what, he would have to go shallower.

The bottom line is that Brad is a crook and he cheated us out of $2,000 and his Warranty isn't worth the paper it is printed on. He doesn't care about his customers or their health, because if he did, he would have dug us a deeper well after being informed of the dangers of a shallow well.

Mr., continues to claim that I was not willing to "do the right thing".

I came back 2 times to the job after Drilling the replacement Well and over and over I assured the customer by Phone, Text, Regular Mail and Certified Mail that the Well was under Warranty and that I was willing to Honor that Warranty.
I have attached a copy of the Certified Postal Warranty Letter that was delivered to the ***'s, they also received a copy of the same letter that was sent regular mail. (A copy of the Warrant Letter was included in my first response)

I remained a constant Professional and never avoided any communication with the ***'s even though they were very rude to me and called me a Crook, Liar, Cheat, and a ***, which is ludicrous behavior on their part while attempting to reach a resolution in this matter.

Mr. claims that I was warned about the dangers of a Shallow Well in his last sentence of his response. Warned by Who? This claim is completely made up and is yet another fabrication of the facts.

The fact is that any area that has contaminated ground Water in Florida is considered a "Delineated Area" as per Florida Dept. of Environmental Protection. The ***'s address IS NOT in a "Delineated Area", which means that there IS NO Minimum or Maximum depth requirement for any kind of Water Well at their Home.

I have attached a copy of the Statutes from the FDEP 62-524 that covers Delineated Areas and under 62-524.430 Maps Containing Delineated Areas sub-section 25, it shows the only Delineated Area in Martin County and it is in Indian Town, Okeechobee, which is some 20 miles away from the ***'s address.

The Gas Station hundreds of yard away from the ***'s is irrelevant. All gas stations have "Monitoring Wells" installed that are tested on a regular basis to ensure that there is no ongoing Contamination of the Ground Water Resources.

Mr. keeps insisting that I agreed to Drill a Well to 120' which is another Fabrication of the facts. Mr. signed 2 different documents that dispute this; 1. the Proposal/Contract (attached in first response), and the Water Well Permit Applications (which was also attached in my first response) which clearly identifies that the Well would be Drilled to an estimated Total Depth of 85' deep. (the Well was ultimately Drilled to 94'.

The bottom line is: despite every effort on my part to maintain a Professional relationship with the ***'s, and my continual assurance to them that their Well was under Warranty, and that I was willing at their convenience to Warranty the Well. THE***'S WOULD NOT ALLOW ME TO HONOR THE WELL WARRANTY.

Again, under my State Water Well Contractor's License, there has been over 11,000 Well Drilled.
This is the first customer that has ever refused to let me Warranty their Well.

My previous Business that was dissolved because of an 8 year long divorce, was called: DRILLING AND IRRIGATION SERVICES OF BREVARD INC., it was also a member of the Revdex.com with an A+ Rating. (Please look this up Ms.).

I have always done the right thing for my customer as the 33+ years in the Business clearly shows.

Stop exaggerating Brad! You are acting like you were so keen to help us with everything when you were not. After accusing us for the sand and blaming us for over a month and only after your own employee said it was your fault, then you decided to come and put a sock on it. Even then, you b(expletive language)d and moaned about how you are losing money on this well. When that didn't work, you went back to blaming and accusing us for the sand. You sent the letter offering to help once we posted a review on *** and said we already hired a new well guy. You did that to make it look as if you are actually a decent human being. You are definitely not that!
You didn't remain a constant professional like you said. You remain a lying ***. You lied about how deep you would dig the well and you lied about your 5 year warranty. We don't want a shallow well and we never did. I know that is not in the contract and like I said before, I should have paid more attention to it. I didn't know that you were a liar, crook and a cheat back when I signed the contract so I took your word for it. If you don't know how deep you have to go to get clear water in the cities where you are providing well drilling services (Stuart), then you shouldn't be digging wells in those cities. Stop scamming people.
We don't want contaminated water Brad! We didn't pay you $2,015 for a shallow well. Nobody charges $2,015 for a shallow well. Please call around and ask. Learn the water tables in Stuart and stop blaming your customers because you were too lazy to go 120' like you originally said. Had you done it right the first time around instead of cutting corners, then we wouldn't be having this problem.
