I wish to provide you with a current update on this complaint caseFirst, I must thank you and the associated staff for your excellent work towards negotiating a resolution towards a portion of the dispute: On 05/25/15, Mr*** dispatched a specialist on site, and completed work on the three ceiling openings, after almost a month shy of an entire year of not fulfilling the terms of the contract work
I emailed Mr*** on 05/27/15, in the acknowledgment of the above mentioned work finally completed, and that the remainder of the dispute involves a refund request for specific project work never initiated
As of this writing, there has been no contact by Mr*** in regards to the resolution of this remaining portion of the complaint
If you would please recall the case notes, there are two parts to the dispute - this is the second issue in regards to contract work that was proposed, but never initiatedWe were billed for labor/parts, and paid for the specific project in full with the reasonable expectation the work was to be completed
The itemized cost of this particular job was never specified on the invoice, as Mr*** consulted from a company project cost list prior to amending the unknown cost to the invoice totalI also believe this to complicate matters, for it would hinge on Mr*** to report the correct financial worth of the work to be refunded
I questioned the viability and restriction of the proposed area for the project (a special ceiling panel to gain future access to piping repairs), and Mr*** later agreed that it was not workableI wondered why Mr*** did not make such an evaluation earlier in his preliminary scan of all building areas, which would've avoided implementing an extra cost for a project that was not sustainable
In this light, I do not believe it fair or ethical to charge and retain monies for work that was never done, and request a full refund for the uninitiated project (access panel)
The previous email response from the Revdex.com did suggest a middle ground offer with which to work with - to possibly further the final resolution to this caseAlthough I believe a full refund to be the proper resolution to this ongoing matter, my family has reluctantly agreed to a refund of 50% of the TRUE project work value - but no less, as a gesture of flexibility and last resort
We are not happy with the near year-long delay and inconveniences caused by Mr***, whom seemed to rest in complacency after full payment was satisfied
Alas, my family is grateful to the Oakland chapter of the Revdex.com for its expertise and negotiating acumen, while working towards final resolution and closure in this matter
