A picture of the door on the vehicle it was being removed from was sent to the customer before it was sent out. At the time of being sent out the door was in good condition and was signed for to be in...

good condition at the desired delivery location [redacted] Austin Texas [redacted]. A few days after the door had been delivered received a phone call from [redacted]'s husband saying that the part had been damaged. The phone call was at night on my personal number around 8:00pm. told [redacted] I would look into the dispute and to please contact me during business hours at the office number not my personal cell phone number which had used to send [redacted] a picture of the door. The next day received several more phone calls on my personal number along with threats and inappropriate language. The last time heard from [redacted] was on the night of August 5th once again on my personal number at around 9:00 pm with more threatening text messages. At that time I told [redacted] he would have to go through his credit card company because I would no longer take his verbal abuse for something that was not my fault. The credit card company came up with the solution for them to return the part to me and for me to refund them once the part was returned. While do not think this is fair since the part was sent out and received in good condition a bound to their decision via my agreement with the credit card processing company. To summarize my response I feel a false complaint was filed after the part was delivered and damaged in the customer's possession of they are trying to send me back there original damaged door. I feel did everything I could to try and help the [redacted] family however the verbal abuse and now threats of lawsuits and other false accusations have gone to far. I have enclosed the paper work for the original sale along with a copy of the signed delivery slip stating the part was in good condition when received and a picture of the original part.Thank you Michael I

Review: I purchased a 2001-2006 CARAVAN TOWN AND COUNTRY VOYAGER 3.3 3.8 TRANSMISSION from [redacted] seller Drive Line Auto Parts the seller shipped a transmission from a sebring model vehicel instead of what I purchased. This item was shipped on a pallet by a semi type vehicle not standard shipping because the item is to large and 150 pounds.Although the seller acknowledges he sent a transmission from another model he refuses to make it right and exspects me to pay to ship it back or be stuck with the wrong one.I am a single mom without the means to return this item. My van continues to be stored at the shop. I can not move it without the transmission so it continues to cost me money. I have to pay others to get me to work or even to the store to buy food for my children. I can not get the baby to her physical therapy in [redacted] closed the case in my favor as well yet because the item is over 70 pounds they say I still have to pay to return the item before the can issue my refund.This is unjust this seller pulled a bait and switch - he sold me one item then shipped another. He has no remorse he has been extermly rude to me and my mechanic and believes somehow I should have to keep this item even though the VIN# proves it is not a model listed in the auction I purchased.Desired Settlement: I want a full refund and if the seller wants the item back he should pay to return it since it is not what I purchased from him.

In response to the letter I received from you yesterday I will fill you in on the situation. The customer ordered a 2001-2006 Dodge Caravan, Chrysler Town & Country and Plymouth Voyager transmission for their vehicle. That transmission is a 41TE unit which fits other vehicles in the Chrysler owned family. The auction clearly states that this is for a transmission that fits them vehicles and not from one particular vehicle or from one specific vehicle with a certain VIN. I assume the customer researched the transmission looking for a VIN to maybe get the mileage and found it is from a Chrysler Sebring which also carries the same transmission a 41TE and is actually a higher quality unit in regards to internal parts. I asked the customer to send me pictures of them side bV side and point out the difference which I never received because there is none and only assumptions that it is incorrect. We have been in the parts business for a very long time and all our techs are ASE certified and have vast knowledge of used parts and their interchange with other vehicles and this is in fact the correct transmission. I told the customer they can return it any time for any reason and I would not even charge the normal fifteen percent restocking when there is a return that is no fault of our own and they refused. [redacted]'s policy which is where the customer purchased it from is the customer is responsible for return shipping no matter what and even if the seller is at fault but if we were at fault we would surely pay to have this item returned. The customer already left numerous harassing and threatening messages which are well documented along with a negative feedback. I have also enclosed a copy of the original auction and a few other customers that purchased the same transmission with no problem and that is only a few I sold hundreds of these units. If you need anything further from me please feel free to contact us but we already welcomed a return to which we just got threatened with credit card fraud that is also documented we just are not willing to pay and lose money for this situation as it already cost us a hundred dollars plus to ship it there and if we did that for everyone that wants to save money and buy used parts but has no knowledge of used parts we would no longer be in business specially with large shipments like this. As one can see this auction implies that this transmission came from one of the listed vehicels in which case would go in mine without any changes to my van. The auction does not state anything about it coming from any of Chrysler's family of vehiceles nor does it state anything about a Sebring Model or the 41TE unit, which would require my vehicle to undergo several conversion to accept this 41TE Sebring transmission at a hefty cost to me. The shop doing the repairs on my van has been in business many years as well and has ASE Certified techs too.

[redacted] found in my favor because the seller did not list this transmission correctly. Which IN FACT MEANS THE SELLER WAS AT FAULT. [redacted] advised them that THE RIGHT thing to do was pay the return shipping. Although [redacted] policy states I am to pay return shipping, [redacted] will in fact pay to return item to them when the seller is blattenly misleading as this seller was. The problem here is they will pay shipping up to 70 lbs and this transmission in fact shipped at over 100Lbs and had to be shipped on a semi costing an additional $139.85 to return ship the item they sent that was not stated in the auction listing.

I have attached the onging case responses and the only threats I made are the ones I intend to follow through with such as this complaint and the other complaints I have filed and the stop pay I placed on the transaction through my card company which is totally legal and not fraud as the seller claims that is the protection offered to me by my card company to fight crooks like these. I am taking advantage of all possible avenues as to stop seller FRAUDs like these.

The fact is this seller is at fault and has call me shop and cussed them and been just as rude to me trying to justify his poor action and unproffessional business practices.
