 Complaint: [redacted]
I am rejecting this response because: Mr. Bloom is not telling the truth. This is simple. His company came on private property and put oil into my basement. He admitted it was the fault of his female employee who has cancer that wrote up the delivery slip wrong. As for no one entering my house, we I called 911 the operator said no one can enter the house until the fire department or police come. I'm sure there is a recording of this since I called 911.  I am a disabled veteran, I do not know how to lie. This military instilled integrity and honor. There is no honor in not telling the truth. We have Golden Retriever dogs and he nor his employees were never in any danger of being bit, until his overweight employee started kicking our dog. He was not witness to this because he was in the basement. No one called the newspaper another lie. I sent Mr. Bloom a letter with all my intentions. I told him if he didn't take care of the problem I would contact an attorney and [redacted] did their story. Myself and my wife are having health problems from this. A matter of fact my wife, [redacted] now has to have blood work and test done to see if liver damage is also happening to her. Freedom of speech is on my side. I will continue to post on my [redacted] page how awful  Bloom is.  My friends and family will also talk to everyone they know and let them know that Bloom makes mistakes constantly.I can prove that Bloom makes this problem quite often. They just happened to have another misdelivery of oil to my step-sister's house ([redacted]). This was a few weeks right after they misdeliveried to my house.I have signs on my gate that clearly state "Private Property". I have also been advised to sue the employee direct. I am still weighing if I'm going to do this or not. Also I have the Pennsylvania Constitution on my side also. It over rules code.. So I guess the next move will be to higher an attorney and take this to court. Mr. Bloom should also contact [redacted] and talk to the girl who wrote up the estimate and he will be told that no living thing can be in the house when they do their clean up. Again, I'm a disabled vet who doesn't lie.
Regards,
[redacted]

In response to the complaint issued by [redacted], our position is simply put, we have done more and offered to do more than we were required. Despite having been insulted, called fat and stupid, sworn at and almost being bitten by her dog five of my employees and myself spent a good portion...

of our afternoon cleaning the basement floor to the best of our abilities. [redacted] was told on that day to contact our office if the smell persists and that we would do our best to help. Instead she sent a letter stating she is seeking over $16,000 in damages, threatened us with legal action and called [redacted] Channel **'s "action **".As for how this incident occurred. [redacted]'s son came to our office and ordered a fuel delivery to his residence. We processed the order to her account, not her son's. It is unclear to me if the information was given to us incorrectly or if we simply pulled the wrong account and processed the delivery. It did not raise any flags to my staff being that we have several customers who use heating oil only as a supplemental heating source or use different companies at times and there forgo several years without a delivery. As per PA building code (see attached) it is the responsibility of the property owner to remove the fill and vent piping anytime a tank is removed. This is done simply to avoid unfortunate situations like this one. Errant deliveries do happen, for a variety of reasons. While these occurrences are rare on our behalf we do only employ human beings, whom by nature are subject to error. Despite being informed of this and having this actually happen to her, the pipes remain in place.I have [redacted]'s letter, a proposal from [redacted], a portion of the DEP report issued to her regarding the clean up, a letter of rejection from her insurance company, and a letter from our local police Chief. I have no receipts or evidence that any clean up was done by [redacted], or any record of a hotel stay, there is nothing in the [redacted] proposal that states no living thing can be in the house, and no indication from DEP (not the EPA they were not there) that nobody can occupy the home. The day of the incident she contact the fire department, the local police, and the local news paper. She lied to us telling us the police said everybody must leave the house and not start the clean up until they get there. Officer [redacted] informed me this was never stated by the police department. The fire department sent 3 trucks to the scene, and they left with out action being taken. The news reporter left also, with out interviewing anyone or taking photos. She also contacted DEP, who's report states "there was no sign of standing oil" and "no sign of soil contamination".As per the previously stated building code this incident is classified as negligence on be half on the property owner([redacted]). I was not compensated for our lost product, our materials used for the clean up, or labor costs of the clean up. I don't expect to be. I also do not expect to to be on TV for this anymore, to be trashed in social media, sworn at or threatened. We owned up to possibly being responsible for delivering to the wrong home. We cleaned it up, we didn't need to but we did it. I will offer no other compensation of any kind for what is simply not completely this companies fault, and may not have been at all.Sincerely,Brett B.
