Review: When we were purchasing the vehicle seller ([redacted]) told us that there is no check engine light issue. He told us that vehicle is in perfect condition. He made us to believe him with false advertisement. We trusted his honesty and purchased the car. the next day in the morning check engine light turned on then we visited him and asked the solution. He said probably it is nothing, then he checked the problem with his tool. He said probably gas tank cap, then turned off the light after pushing the erase button on the control tool without fixing anything. Then we got his word then got the cap from [redacted], then transferred the title on my name. He told us that if the light is on again he will show the car to his mechanic to repair it. After the light on again we visited him, but he run away. We visited him again next morning then he lock the door then hided somewhere in his shop. I visited his office again but this time there was a lady who was very rude, and she started to yell at me. I told her I am a professor at [redacted], and trying to solve this problem peacefully. But she continued to be rude then she told me I am on my own. She told me my husband call their shop but he never did. She told us that all sales are final, but they did not deliver the product they promised. They made us stressed, and I started to cry after I came home. Because I did not deserve this behaviors and vehicle with check engine light is on. I request repairing the broken parts that is causing this malfunction in the car. We asked [redacted] they sair EGR valve and eleectric wiring should be replaced. Thank you very much for all your help.Desired Settlement: Repairing the malfunction that is causing check engine light. We asked [redacted] they sair EGR valve and electric wiring should be replaced which are not under their 3 months warranty. Thank you very much for all your help.

Response:

Hi my name is [redacted] the reason for my letter is I am responding to

[redacted]. We did sell them a 2005 Chrysler Pacifica August 27th 2014

they came in and purchase the vehicle from us they ask me was there any

issues with the vehicle or check engine light on I said no vehicle just

went to virginia state inspection and there's no lights or check engine

lights on I never told them that it was in perfect conditions I told them

that the vehicle had no lights on it it ran great they knew when they

bought the vehicle it had over 100,000 miles we were asking 5695 for the

Pacifica they came to me and told me all they had was 4650 I told them that

I would sell them them the vehicle at 4650 and put a 3 month power train

only warranty on the vehicle and I told them the powertrain only covers the

motor in the transmission in the drivetrain internal lubricated parts only

.....no check engine lights and as far as hiding from the customer they

brought the vehicle back to me I turn the light off and told them that it

could be as simple as a gas cap we have been in business 22 years and we

have always been respectful to all of our customers they came in our

dealership demanding that we fix this issue we explained to them that we

drop the price over a thousand and there was no room for us to fix anything

that wasn't under the warranty I'm sorry the check engine light came on but

we are a small business and we lost over a thousand on that sale therefore

that leaves us no room to be generous and fix something that's not under

warranty enclosed in a fax he is a copy of the Virginia state inspection a

copy of the warranty power train only

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[ I am sorry I am responding late but I was busy with school and my own 3 boys. Seller said it is in a good condition without any issues including check engine light. My husband asked about it several times. It became on while I was taking my kids to their school, next day. When we visited him he said probably it is nothing, and recommended us to change the gas tank cap. We purchased new one and then changed it. He erased all errors in the system and turned off the check engine light without fixing anything, actually 2 times. He told us that he would fix it if we revisit him if it happens again. After check engine light became on we visited him but he run away. He did not confront with us. When we visited him again he again locked the door and disappeared, and the next time his mother was there and she behaved very rude. She screamed and started to threaten me. I scared and could not sleep several days. He says he is in this business in 22 years, but also trusted that, but he did not keep his promise/ He says they sold the car cheap but not true. Good condistioned same car has the value 3,765 if it is in good condition. A car with check engine light is on does not deserve that classification at all. Anyway we paid almost 1,000 more than the average fair price. It is even cheaper at private party around 2,700. I attached the kbb report fro your reference. He needs to fix this car, and pay us some money to fix it. I thhink we deserve that treatment. If anything happens to me and and my family while I am driving this car, then they are responsible. We are looking forward to get your help to resolve this issue with the car dealer. We can return the car if necessary, and of course we will ask for price we paid plus tax and registration money we paid for too. Owner said his name is [redacted] it means [redacted] in German, and he needs to what his names asking him to do.

Thank you very much for your help in advance

Best wishes

Response:

To who this may concern responding to the customers message we sold them the vehicle and I told them that the

vehicle pass Virglnia state inspection and as far as I knew the vehicle was a good reliable vehicle they didn't drive the

vehicle before they purchased it I asked them before they purchased the vehicle would they like to drive it there was no

issues with the vehicle when it left my lot no check engine lights no nothing the next day they came by about the check

engine light being on come on he next day I told them I would scan it and turn the light off I scanned it and the code

came up for the gas cap lib they went down to [redacted] and got a gas cap lid I told them but I need it to get a factory

gas cap lid from Chrysler I told them that they had a warranty on the vehicle that they could contact the warranty

company but the warranty was a powertrain warranty only and he did not cover check engine lights unless it was an

internal problem with the engine I never made any promises that wasn't keep and this far is my mother being rude she

is the owner of the business she owns several businesses and she is always courteous kind and polite to everyone she

told the customers that the check engine light was not under warranty at the customer's basically threatened us my

mother asked her to leave we are not going to fix the check engine light we are not giving the customer a refund all

sales are final..,. and as far as her pricing analogy I have been a licensed dealer for 22 year and we do not go by Kelley

Blue Book the auction houses and all the lending institutions banks go by nada and nada clean retail is 5575.00 and

enclosed in my letter is a copy of this I am very sorry that they had such issues with a check engine light the vehicle ¡s

running and driving fine and when you buy a used car that is 9 years old and has over 120,000 miles on it you're not

buying a new vehicle and you will have maintenance and expenses with a vehicle such as that I'm very sorry that they

had issues I felt confident in the vehicle that's why we put a warranty on the vehicle but that problem is not covered

under the warranty I'm very sorry about that but making threats an untrue statement about driven motors and myself

and my mother ls it is not warranted myself and driven motors have followed the Virginia dmv laws and we have spoke

to the dealer board about this issue

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Revdex.com, thank you very much for the opportunity of representing

us here. Seller, Mr. [redacted] is lying and cheating because we test drove the car

and liked it at that time. We asked him at least 5 times for the check engine

light and he told us no and no many times. Engine light went on next morning

when I were picking my kids from the school. I am professor at [redacted], and we

teach our students to be ethical. I did not threaten his mother at all. I told

her that I will talk with Revdex.com and she told me that I can do whatever I want to

do, and they will not cooperate. She actually threatened me by calling police

officer if I do not leave. She told me that my husband called her office, but

this never happened. I thing they are confusing us with somebody else. Mr. [redacted]

also told us that he is in the business for last 22 years therefore we got his

word. He was really approachable at the beginning, but he changed very much

after we told him check engine light is on. I think he knew the problem

otherwise he would not run away from us when we visit him again. He just drew

away from parking lot after he saw us (me, my husband and our 3 little boys).

He had his boy once therefore we thought he would sympathize with us and would

not do anything to hurt us. When we purchased the SUV we just moved from

Boston, and new to the area. We thought he would want to help us because he is

local here. We were kind of his guests, we also told him that. I do not know

how he survives in dealership business with this type of behaviors towards his

customers, especially his mother. We did not meet with her while we were

purchasing. Our purchase agreement was with him, not his mother. He and his

mother should be stop, because they are running their business responsively and

properly. Their shop is already closed; I do not know where they are located

now. I need to protect my students at [redacted], therefore I will use this case as an

example of bad business. He is not getting responsibility, instead hiding

behind his mother. He should keep his word, either refund our money back or fix

the car. NADA pricing is for clean car, but obviously this is not a clean car.

It was honest bargaining the retail price, if he was not making money he would

not sell at all. [redacted], just fulfill the requ[redacted]ents of your business properly,

and earn your money for your family right. If you are seriously sorry, make

this deal right, and treat your guests as you should have behaved. I think it

also good idea to report this dealer association here in [redacted]. We

really purchased the car to keep it, not to run into abrupt issue like this and

wasting our time. This is the country that protects customers rights 100%...We

are looking forward to hearing from you about your cooperation. Revdex.com, please help us and let us know what else can we do, because this is not going anywhere since the Driven Motor is not cooperating. I do want them to get away with this misconduct and misinformation.

Regards,

Review: On February 2, 2014. I purchased a vehicle from Gary Tolliver at Driven Motors of Harrisonburg, Va 22801. Just a week later, my oil pressure dropped and I put it in the shop, only to find out, the motor is completely blown in it. The 4 wheel drive doesn't work either. I bought this used and signed an "as is" paper and have contacted a lawyer just to check if there's anything I can do about it. On Friday February 21, 2014, I went to the business and told Mr. Tolliver of my issue and he didn't care what problems I had. I believe Mr. Tolliver knew exactly of the problems this vehicle had before he sold it to me, I believe he rigged it enough to get it off the lot and to get it sold. In the mean time, I have found out, he was once in business under a different name and had lots of issues with other customers being unsatisfied. And now is in business under a different name. he doesn't care to even offer me any kind of help to fix the issue or anything. Poor customer service upon his part. He got the vehicle off the lot when he sold it to me and left me not only 4500. dollars in the hole for the vehicle, but I must buy a new motor and have it put in. So I am lookn at another 4000.oo dollars or more before I can even drive the vehicle. I want TO REPORT THIS ISSUE IN HOPES THAT MAYBE ANOTHER CUSTOMER MAY BE SAVED FROM BUYING JUNK FROM THIS BUSINESS. RUNNING A BUSINESS LIKE HE DOES MUST MAKE HIM A LOT OF MONEY, HE KNOWS EXACTLY WHAT HE IS DOING TO GUNK UP THESE BAD MOTORS ENOUGH TO GET THEM OFF THE LOT AND HIS "AS IS" NO WARRANTY SAVES HIS [redacted] FROM BEING PERSUED BY THE LAW. I believe his practices of running a business need to be checked out and others be warned of what he does. I am sure he will do this to another customer, but hopefully he can be stopped of taking money from hard working individuals like me. Thank you, [redacted].Desired Settlement: I would like to see this business be responsible in helping me at least partially paying for a new motor. It's the least a good business man would do. He sold me junk, sold my vehicle I traded into him for this vehicle and made 2000.00 dollars off of it. Left me with nothing. A good business man would have offered some sort of help. I've known of business men that find mechanics and help to solve issues with used vehicles being sold. This man offered me nothing but, Sorry about your luck!!

Response:

My name is Gary E Toliver of Driven Motors in Harrisonburg Virginia. I am sending this letter in regards to the ID # [redacted] concerning Mr [redacted]'s complaint.

On Feb. 1, 2014 I sold a 2001 Jeep Grand Cherokee Vin number [redacted]. to Mr. [redacted]. Mr. [redacted] drove the vehicle and looked over the vehicle and decided to purchase it. Mr. [redacted] was told he was purchasing the vehicle As/Is with no Warranty. Mr. [redacted] signed the Buyers Guide clearly stating the vehicle was As/Is No Warranty. Mr Siver also signed the Buyers order as the Bill of Sale. Mr. [redacted] also signed a disclamer that was drawn up for us by an attorney detailing what As/Is No Warranty means. Enclosed is all four of these documents.

Mr. [redacted] stated that I knew there was an issue with this vehicle. To my knowledge I saw no issues with this vehicle. I drove it back from Roanoke Virginia 110 miles away and then I drove it 2 days before I put it on my lot. The vehicle was gone over and state inspected by a certified mechanic who found no issues. I also ran a car fax on the vehicled to make sure it had no issues before putting it on my lot. The reason the vehicle was sold As/Is No Warranty is because on the age 13 years and also the mileage 145000 miles. The vehicle also had an altered suspinsion it had been lifted and had bigger tires put on it.

Mr. [redacted] state I was shut down for unsatisfied customers this is totally false. I have been in business for twenty two years, nine of those years in the used car business. I have never been sited by the Dealer Board for any fraudulent acts. I have no criminal record. I shut my businesses down due to the economy.

Mr. [redacted] traded a 1994 Toyota 4 Runner in which he told me had no issues which I took "As/Is" He also told me the four wheel drive worked in his vehicle. Believing the man at his word I showed him $2500.00 on his 4 Runner. Mr. [redacted] never told me that the four wheel drive did not work or that in 10/1/2012 the 4 Runner had been totaled I ended up fixing that and a wheel bearing on his vehicle before I could put it on my lot. The repair reciepts and the car fax for his vehicle is also enclosed.

I regret he is having problems with his vehicle. There is no way I can predict what will happen to a used car I also can't tell if it was taken off road and abused after it was sold. I did everything in my power to make sure it was a good vehicle I drove it for 3 days had it state inspected by a certified machanic and I ran a car fax on it to make sure it had no issues. And I told him it was being sold "As/Is" No Warranty.

Sincerely,

Gary Toliver
