We received your letter today regarding case # [redacted] I've attached to this letter copies of the original complaint email that Ms [redacted] sent to us, as well as the response we sent to herhave also attached a copy of the original test confirmation email sent to Ms [redacted] the day she made the test appointment, as well as the attachments that we include with every test Confirmation email.You are asking us to acknowledge the customer's concernsMs [redacted] paid $for the convenient service of a third party PennDOT certified driving examAs previously stated, the Current test scheduling system often has appointments for months from the request date(If you were to call today, you may not get a test date until January)She called on July 13th, and was able to get an appointment on July Her son failed the driving test, as do about 50% of the population on their first tryThe fee is for pass/fail, and as stated in the test confirmation attachment; it's non-refundable.You asked us to state the factsMr [redacted] did not pass his testHe was observed to be going well over the mile per hour speed limit on the course three timesThe test was administered by a State Certified Examiner (who also happens to be a retired Philadelphia Police Officer)He has no personal interest in passing or failing anyone for this exam.You finally asked for us to explain the actions we can/cannot takeWe cannot change the results of the test that he took [redacted] was notable to pass the exam because he could not follow the rules of the road during the courseIt was his first attempt at taking the test, and he does have a total of three attempts before he needs to reapply for his permitWe can administer another test for him; Driver Training ServicesTo Whom it May Concern:Driver Training Services is a driving school, operating since As of June 1* of this year, we were certified by PennDOT to administer the Class C Driver's Exam as part of a state-wide pilot programPennDOT started this program to ease the burden
of scheduling the testIf you were to contact PennDOT today to schedule a test, the next available test date, on average, would be in three monthsWe are one of driving schools across the state to be eligible to be certifiedAll members of our staff, have been trained by PennDOT officials in Harrisburg to administer the Class C Driver's ExamBecause we area third party administering the test, we are allowed by the state to charge a fee for the exam.On July 27th, *** *** was scheduled to take his test*** was not one of our behind the wheel students, but was referred to us due to the backlog in test dates at PennDOTIt should be noted that *** has only had his permit at this point in time for months, and scheduled his test date for the date of eligibility on his permitOur exam includes parallel parking, several traffic changes, and several speed changesWe have three routes to use for the test; all approved, in person, by PennDOT officialsOn the particular route used for this test, there are speed limit signs along the routeThe examiner assigned to administer the test to *** that date, observed during the course of the route that *** went at least miles over the speed limit three times during the Course*** was observed to be traveling 7-miles over the posted speed limit on two points on the route, and miles over the posted speed limit at one point on the route: which was easily observed by the digital speedometer in the vehicle used for the testThe examiner states that he had a clear view of the controls of the vehicle, as is required as a State ExaminerAt this point, the examiner ended the exam and had *** return to our offices.The Pennsylvania Class C Non-Commercial Driver's Exam is a driver's skills examAs per the PennDOT DL-402NCD (Non-Commercial Driver's Examination Report), the driver candidate is allowed so many points until the test is considered a failurepoints is the maximum one could score on the exam and still passSpeeding is considered going at least miles over the speed limitSpeeding is considered a Serious Traffic OffenseA Serious Traffic Offense is pointsFor each speeding infraction, he was assessed points; to a total of points, which is afailure*** did not meet the requirements to pass the State of Pennsylvania's Class C Non-Commercial Driver's Exam.At the end of the exam, the examiner brought *** inside to our office to discuss the results of the examHe reviewed with Ms*** the test, and explained that he was observed speeding during the course of the exam three times which resulted in the failureThe office staff did ask if they wanted to schedule another exam, as there are appointments available after the PennDOT mandated waiting period, which they declined and leftWe received an email from Ms*** a few hours later telling us that she was going to file a complaintThe owner of the company, Robert G***, made two attempts to contact Ms*** to explain the results of the exam, and she did not respond to either phone callWe also spoke with two officials in PennDOT, and reviewed what had occurred during the exam; both said that *** would have failed given the number of faults.Driver Training Services is a member of the National Safety Council, is a AAA Approved Driving School, and is a member of the Pennsylvania Association of Professional Driving SchoolsAs a driving school, we are committed to teaching each student how to be a safe, defensive driver for the rest of his/her lifeAs PennDOT examiners, we are especially aware of the skills that are necessary in order to pass the examMs*** paid $for the Convenience of having her son take the test at an earlier date and not have to wait for several months for an appointment at a Bureau of Driver Licensing CenterUnfortunately for her son, he failed the exam, as he did not have the skills to successfully complete the State Mandated requirements.Please feel free to contact our offices at any time, should you have any additional questions.Thank You,Robert KG***Owner, Driver Training Services
