Review: June 14, 2013 we purchased from Timesquare Furniture and Mattress (Ds discount furniture)a table and chair set that was sold as high quality. On July 2 a set of 2 captains chairs that have screws coming through the seats . Metal brackets under arms that have nails and nail heads everywhere that are dangerous. the surface of the tabletop has split, plastic putty used to repair. July 17, contacted the business to pick up the set and refund the payment. They refused. July 18, contacted [redacted], we filled out a complaint form. [redacted] said Timesquare has 45 days to respond. As of Sept.4, [redacted] has not received a response.Desired Settlement: We want Timesquare Furniture and Mattress to come to our house and pick up the furniture and credit our credit card,[redacted], with the purchase price of $1,299.00.

This is in response to the letter that I received about the complaint. The credit card company came out with their decision on 9/9/13 that upheld the charge and sided with our company in this dispute, instead of writing out the entire situation again, I will forward all of the documents that I sent to merchant services,

I will summarize the situation as this, the customer purchased a floor model set for less that half price, It was clearly marked "floor model". The then had complaints about the product and wanted to return it, which is outside our company policy for a discounted floor model item.

Response to Chargeback on transaction on 6/14/2013 Reference number [redacted] in the amount of 1299. The claims being made are not true. I will address all issues and give an account of what happened.

On 6-14-2013 [redacted] and his wife purchased a "Floor Model" table and 6 chairs from our business. I am the salesman that sold it to him. It was made perfectly clear that this item was a floor model and is a clearance item. It is a solid wood piece being sold at a discount. As is noted on the sales order all clearance items are sold as is and are not eligible for exchanges or refunds. The tag on the table set has a giant Clearance tag on it and is reduced in price by 50%. We purchased 10 sets of these and have being selling each one off of the floor.

[redacted] and his wife came in on 7/17/2013 with complaint about the furniture. I told them they purchased a clearance floor model item that has no warranty or exchange possibilities. He was very upset and claimed he was never told that. That is just not true, I personally told him, it was marked on the tag, and it is on his sales order. Even if it was not a clearance item, he was outside the 10 day exchange period for the furniture.

Their request to return the furniture is outside our business policy and we do not warranty clearance items as they are sold at a 50% discount.

All of the issues they are complaining about on the furniture were there when they purchase the set.

While I understand they do not want the furniture any more, I simply cannot return or exchange clearance priced furniture.

They also made claims that the furniture was not cherry wood; it is cherry wood as described in the manufactures sales guide. They were also upset about the screws in the chairs and I told them that they were like that on the floor, and it was part of the reason it was on clearance. They purchased solid cherry wood set that normally retails for well over $3000 for $1299. Their concern that they did not get quality furniture is not true. It is quality furniture, and they were sold the floor model set at a discount.

At no point was the customer told that this was an American made product.

They make a claim that they were not given the floor model because theirs was dusty. Their set was dusty because it was moved to our warehouse for three weeks before the delivery date. I told them they would get the one on the floor that they were looking at, and to look it over.

See the attached Sales invoice and receipt showing the store policy. The store policy is also printed in large print on the sales counter right at the point of purchase.

This is a case of the buyer wanting full service and warranty, on a clearance and floor model piece at a clearance price. If there is any questions please give me a call 406-245-6334

We contacted [redacted] Credit Card Company on 9-15-13. They told us D‘s Discount Furniture had not responded to their letter of 8-5-13 but that they have 45 days to respond. The party we talked to could find no evidence that [redacted] had made a decision on 9-9-13 to side with their company in our dispute They will inform us of a decision when the 45 days has elapsed.

Our position in this matter is covered by the documents we submitted to [redacted] on 8-5-13. “Copies Attached”

In response to D’s Furniture letter’s we offer the following as our reply to the comments in Brian’s letter.

We did not get the “floor model" we looked at "Clearance, NO RETURNS” was not posted.

We were told that the quality furniture was being sold at 50% discount because they had purchased 5 or 6 sets (not 10 sets) at such a good price they were passing the savings on to us, the customer.

We never saw their manufactures sales guide.We ourselves looked up cherrywood on the computer and we told them it was not one of the 4 kinds of cherrywood but a Chinese cherrywood. Very misleading on their part.

As for the screws In the chairs and the metal brackets, we feel no one should have to turn It over checking to see if it has those things on quality furniture. A reputable business will disclose that to a customer. Also the nails on the chair in the picture were not on any of the chairs on the so called floor model.

We feel this has been a scam on two elderly people. But we are two elderly people who are capable and will persevere with this matter.

We are rejecting Time Square's and D's Furniture response to our complaint we have with their defective merchandise. We stand by our claim that at the time of purchase we were assured we were buying QUALITY FURNITURE. We did not receive QUALITY FURNITURE! It was not sold as "floor model". Further more, as stated in our correspondence we received defective merchandise and a legitimate dealer will acknowledge it and refund the purchase.

We will recommend to the people we know to never purchase from D's furniture, which we did not do, and for them to say we did, that in it self is a deceptive business practice. Nor will we ever recommend Time Square.
