Hello ***,
This is a respond to the case ID ***
"">*** *** purchased a *** *** from us on Saturday 11/08/2014, she test drove the vehicle and she liked it, she even comment that the vehicle drives very nice, the vehicle passed VA inspection and there were no issues with itBefore the sale, *** *** mention that she was going to take the vehicle to her mechanic and if something was wrong, we had to take care of it, we told her that it does not work like that, she was more than welcome to bring her mechanic to check the vehicle before the sale, because she is buying AS IS, and she decided to proceed with the purchase and she signed all the paperwork of buying AS ISNow she is complaining and she put a stop on a check of $that was part of the payment for the vehicleWe were very clear with *** ***Thanks,

Complaint: ***
I am rejecting this response because:
D and S Imports is selling vehicles under pretenseI purchased my *** with an 'as is' warranty but also VA inspectedThis vechicle FAILED VA inspection business days after purchaseThe issues with this vechicle are SAFETY RELATEDGas tank leak, tie rod, brakes & rotors and exhaust (although vechicle has more issues, those listed are only what failed the state inspection)
days after purchase an investigation by the VA state police deemed the vechicle unsafe for the road and my new vechicle is now under investigation and not in my possessionHow is this right? Selling a car like this unethical and fraudulentD and S should be ashamed of their selling practices of unsafe vechicles and are not state inspected required the state of VirginiaMy vechicle is a death trap for both myself and other drivers.
I am requesting payment for all mechanical issues that FAILED VA inspectionI am entitled to these funds because D and S sold the vechicle with VA inspection (which is fraudulent)PS upon another response from D and S: I AM FULL AWARE 'as is', THIS IS NOT THE ISSUETHE ISSUE IS FAILED STATE INSPECTION MECHANICAL ISSUES THAT ARE MAJOR SAFETY ISSUES.
Regards,

In response to the untrue accusation against D&S Imports, LLC, once again the buyer purchased the vehicle after she did a test drive and liked the vehicle, she was offered the option to bring her mechanic BEFORE the purchase but she wanted to proceed with the sale anyways and after signing all the AS IS clauses and paperwork she proceeds to make these claims. We didn't do anything fraudulent as she is stating because the vehicle was inspected in a VERY well known franchised location with VERY GOOD reputation and we have proof of it. Aside of this she paid us part of the amount of the sale with a check in which she did a stop payment and we were unable to process it, we are now in doubt if maybe she is doing all this because she didn't have the funds available.Every case have 2 side of the story. D&S Imports, LLC  is a reputable dealership, with high standards of integrity, and will be glade to forward supporting documents to all the facts stated above, and on another note the buyer is an adult over the age of 21 who signed the clauses and understood the terms and conditions of the purchase.
Thank you.

Review: A vehicle was purchased. We were told we needed to deliver a check for over 300.00 for taxes tags etc..after reviewing the sales contract it was financed in with the loan. I contacted the business who claimed it was an error. No check was delivered. 42.50 was financed for tags which were to be delivered to my home. The last day of temporary tags we had to drive to the business to pick up the tags. They business had registered the vehicle in the wrong county and we were told we had to have an emissions inspection. The tags provided were valid for one month. The business owes us 40.00 for the remainder of the tags which we had to pay out of pocket after clearing up being registered in the wrong county. The business also advertised a price online for the vehicle to be 4995.00. We were told that was the cash price. There is no disclaimers online. The price we were charged was 6995.00. The company was contacted 3 times regarding the 40.00 refund. Each time I was told it would be mailed. I have not receivedDesired Settlement: I want the 40.00 which is rightfully owed for the tags. I also want 50.00 for travel picking up the one month tags and travel to the DMV to correct the county. I want a review of this companies advertising practices as I believe they are misleading and illegal

Response:

Review: Purchase vehicle 03 [redacted] on Saturday 11/08/2014, as is warranty. The following business day had my mechanic look at this vehicle. Was immediately told to stop driving due to gas leak, front left axel broke and front brakes. Gas leak and axel being very crutial safety issues for myself and other drivers.

I made dealer aware via phone and email and was told "as is warranty." No consideration for safety issue. Dealer not will to pay for these issues or have their mechanic fix.

Prior to purchasing, I emailed this dealer and was told 'no mechanical issues'. This is a false statement.

Therefore, I have 2 complaints:

Making a sale under false pretenses

Failure to correct safety issues which could harm to self or othersDesired Settlement: replace gas tank, front left axel and front brakes to meet manufacturing safety specs as per state requirements.

Response:

Hello [redacted],

Review: Look to purchase used pick-up it did not have current state inspection. I was unable to take a test drive but the truck had to go into the shop for many repairs. He had promised to be ready at a certain date but the dealer did not deliver on time. He made plenty of empty promises and claimed that he was trustworthy but found he was not at all. All the cars he had on the lot did not have any current inspections on them and they all were offered for sale.Desired Settlement: He would have to have all the vehicles with current state inspections so they could be test driven when customer comes on the lot.

We would like to inform you that we have some vehicles that whithout buyer's guide or state inspection are not currently for sale and we have display signs stating so, in the event that a customer wants to test drive a vehicle that is not for sale we can't let them take the vehicles out of the lot, this customer didn't take this in the best way possible and decided to file a complaint, we have contacted the customer to find out if there was another reason why she filed a complaint but she informed us that it was because the vehicle was not ready for sale and unfortunately she wanted to test drive that particular vehicle. Legally we are fallowing the rules to have the displays when vehicles are not for sale.
