I hired DS60 to redo my shingles on my roof and was quoted $6056.80. I fully paid off the quote/final bill on 29 July 2019. On 29 August 2019, I was handed an additional bill of $1502.90 for two extra layers of shingles they discovered while doing my roof. No adjustments to the quote were made during the work for these extra layers and I have already paid the final bill. After contacting legal help and telling the company I would not be paying the extra charge due to the breach of the Canadian Consumer Protection policy, they told me they will submit the bill to collections or take me to small claims court.

Desired Outcome

Dismiss the extra bill in accordance with the Canadian Consumer Protection legislation

Thank you for bringing this concern to our attention.

This matter has been turned over to our attorney for collection. For the record, *** signed a contract with our firm and was aware of the extra charge and verbally acknowledged it. He asked for payment options (which we gave) and he was grateful as this was a little unexpected.

We deal with nearly 1000 clients per year and try very hard to meet their needs. We pride ourselves in doing a good job at this as servicing nearly 1000 clients annually in our sector has its challenges.

Dear ***

The contract I signed with DS60 was signed on July 4th with their residential estimator. We signed a contract for $6056.80 and provided a 10% deposit of $600. The fine-print of this contract states, "Any alteration or deviation from above specifications involving extra costs will be executed only upon written orders and will become an extra charge over and above the estimate." No written order was ever presented to myself, nor were any payment options discussed until they presented me with an additional $1502.90 bill.
The only verbal agreement came from an option of shingles or siding being added to my dormer. I agreed to their $200 offer to add shingles to my dormer, but later verbally removed the order as I wished to complete the dormer myself. The price adjuster then asked if I was aware of additional layers on my roof, to which I did not know until that moment. The price adjuster then informed me that the roof will take a few days longer to do but did not inform me that there would be additional charges.
A few weeks after the roof work was completed, the residential estimator delivered by hand my bill of $5465.30, which I payed in full on the 29th of July 2019.
A month later and no further contact with DS60 or the residential estimator, on Thursday the 29th of August 2019, the residential estimator hand delivered a bill for $1502.90 and was dated 31st of July 2019, explaining that the company was trying to charge me for the extra layers of shingles that were on the roof. He explained to me that he was trying to negotiate with his boss to expunge the charges or reduce them. He also asked that if he was unable to get the bill dropped if I was able to pay the bill anyways by means of $200 a month. I explained that I would not be able to afford it as I had not budgeted an extra $1500 bill a full month after paying the final bill.
The residential estimator then contacted me multiple times a week after the Labour Day Weekend, explaining that DS60 did not want to drop the bill or reduce it. He explained that they now wanted $250 a month but he would try again to get rid of or reduce the bill.
After this interaction, I contacted the Ontario Consumer Protection Act representatives, who then placed me in contact with a legal representative who explained to me that this additional charge was in violation of the CCPA and that I should contact the company and inform them.
The final time the residential estimator called me, 12 September 2019, he repeated the same information as before but now the monthly repayment that DS60 wanted was $300. I informed the residential estimator that this extra bill was in violation with the Canadian Consumer Protection Act, explaining that no written changes were made to the contract and that the final bill should have reflected the legal additional amount. I also asked to bring this violation up to his bosses and asked for their information as my complaint was with the offices and not the individual.
On 19 September 2019, I contacted DS60 and explained that the extra charge of $1502.90 was in violation of the CCPA and that I would not be paying the amount. I was then told that the extra bill would be sent to collections and that I would be seeing them in small claims court.
