This lady [redacted] took me to court and it was dismissed for 200$. She still put it on my credit history.I have proof it was dismissed.Desired SettlementWould appreciate if it was removed off my credit history.it is preventing me from further rental history.Business Response October 21, 2014Revdex.com Complaint Case#:[redacted]Consumer: [redacted]Thank you for allowing us to respond to this compliant filed by Ms. [redacted] a prior resident at [redacted]. Ms. [redacted] had court papers filed on her August 22, 2013 for failure to pay August rent of $406.00 plus $3.00 balance from July, late fees of $27.00 and damages of $15.00 for a set of blinds replaced in June. The manager posted several notices on her door concerning the past due rent but Ms. [redacted] did not pay the August rent as required by her lease. The manager filed court paper on August 22, 2013. The Community Apartment Manager marked the wrong line under section 3 of the Complaint in Summary Ejectment. She marked the defendant breached the condition of the lease described below for which re-entry is specified. The correct line should have been the defendant failed to pay the rent due on the above date and the plaintiff made demand for the rent and waited the 10 day grace period before filing the compliant. Due to the wrong line being marked the judge did dismissed the case. Ms. [redacted] paid August rent and continued to pay rent and up till November. In December the property did not receive any rent as you can see in the ledge attached to this letter. Ms. [redacted] resided in the apartment until around the middle of December. Ms. [redacted] never notifed us of her moving out of her apartment. The manager realized that Ms. [redacted] had moved out without giving notice. We moved her out on December 17, 2013 as a skip. Ms. [redacted] failed to give a notice to termination of Lease. Under Section Twelve: At the close of the current lease period and for good cause, either party may terminate this lease prior to expiration by giving the other written notice at least 30 days prior to move-out or date of termination. The tenant is responsible to abide by all the terms of the lease and attachments during that 30-day period and any additional days that may occupy said unit. This includes the payment of rent and any additional charges that may occur. I have enclosed a [redacted] showing how her security deposit was used;Ms. [redacted] was in the unit 17 days in December $222.70 plus $15.00 damages for blinds replaced in June. $3.00 balance for July rent that resident never paid. $27.00 late fee. Rounded total $268.00Due to Ms. [redacted] skipping out the apartment keys were not turned into the office. A charge of $125.00 for changes the units locks. Due to the condition of the unit a cleaning charge of $100.00Cleaning of carpet $90.00Replaced safety bar that was damaged on patio door $25.00Removal of stickers from ceiling $50.00Replace broken Towel bar $25.00Total Charges $290.00$483.00 -$268.00-$125.00-$290.00 equals a balance of $200.00 owed to the property. The charges on her credit have nothing to do with the court case in August. The charges are from her move out and how she left the unit with damages and owing rent. Due to Ms. [redacted] not giving proper notice as her lease requires we were unable to schedule a walk-through with her to discuss the damages. Also we were unable to provide the documents of the move out paperwork due to no forwarding address left by Ms. [redacted]. I would like to provided all the back-up documents to show that Ms. [redacted] owes the $200.00 that is on her credit and is only using the Revdex.com to keep from having to pay the money owed to [redacted]. Again I would like to say thank you for allowing us the opportunity to respond to Ms. [redacted]'s claim. I do not see a way of downloading additional documents.
