Mr*** has claimed in his complaint that they paid DTR $6,500.00, which is totally inaccurateThe only funds we ever received from his company was the $3,retainer we required along with the signed agreement before the bulk of the work was to beginHis Son *** *** who was running the
project at the time signed an agreement and provide the retainer checkAt the time DTR was commissioned for waterproofing engineering, the construction project was at a stand-still, cause by an inability to waterproof the east wall due to poor planning/coordination of the design teamDTR’s professional fee was $6800, in addition to $for each site visits, plus reimbursable expensesThere has been no amendment as claimed to the signed agreement*** *** initial each page of the agreement and signed/dated the agreementIt was not until this week that we have received any notification from Mr***, that he was unhappy with any of the professional services providedIn fact the last correspondence we have from him is to the contrary, with Mr*** stating it was wonderful working with usDTR’s Design/Engineering services offered multiple viable solutionsThese solutions were discussed on site with *** and their Architect and Structural EngineerThis final solution could have been much cheaper had the proper consultants been part of the design phase, prior to constructionThe lack of coordination and foresight on waterproofing your project, prior to the actual construction caused the problems which stopped the constructionDTR was not in any way part of this failed process (which happened long before we were hired)We were asked to come in and provide solutions based on where the construction was at that timeI personally took time out of my family vacation to drive to your site twice because it was extremely urgent I meet with you and your design team at once, for which my family was not happy aboutWe had several manufactures meet out on site and meet with the projects waterproofing installerBoth individuals told me your subcontractor was not qualified to install either of the suggested solutions and they (as the manufactures) would not be able to provide a warranty for any such installationsThese are national manufactures field techs that confirmed your waterproofing subcontractor hired lied on multiple occasions on site about his experience and was not certified by *** *** or the any of the other waterproofing manufactures to install these materialsI recommended Mr*** look for another installer, or accept a no warranty conditionHe asked for names of other installers and we requested the local (well respected) local distributors provide you with a list of local qualified installersThe design changes that were necessary were unilaterally agreed to by the project *** * *** *** (Consultants of Mr***)Based on their suggestion we drafted a more refined solution to use a “Blind Side Waterproofing” solution with is extremely common against below grade shoringThis solution should have been part of the original project design! There was no product that could have been installed under the site conditions when the construction was stalledI have well photographed the site conditions clearly illustrating that a contractor could not have waterproofed the originally designed masonry wallsAny insinuation of kick-backs is both foolish and totally without merit… DTR for years has been and is a totally independent consultant and has impeccable Client referencesWe never recommended any contractors, only obtained a list of qualified installers from local manufacturer distributors for your useWe did inform you that your subcontractor was not qualified as noted by multiple manufacturesOur interest was that you had a quality installation with no leaks, backed up by a national manufacturer or Year WarrantyOur only fees come 100% from Clients who pay their bills… Mr*** has been provided with another simple spreadsheet showing our hourly billings for the waterproofing re-design work (Professional Services-$6,800), in addition to site trip charges (trips-$2,850) and expenses ($1,608.42) all in accordance with the signed agreementIn addition, late charges ($1,527.65) continue to accrue on the outstanding balance until this amount is paid in fullThe total amount due minus the initial retainerDTR is currently still owed $9,and will legally pursue all options available to us, until we are paid in full
