I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.How can you sit here and tell me that I was responsible for 100$ deductible when my attorney and the class action lawsuit attorneys say you are full of it!! Why would you not take any calls from my layer Mr Guess? Why did your service department use curse words to my year old grandmother when she picked up the car and nicely told him that we had spoke to Mr P*** about not paying it and he in fact waived the fee?? Maybe your dealership should communicate? All you can say is it passed a point inspection? WHO CARES the fact is it had recalls and still does and you refuse to take responsibility!! Apparently that's just the guess way! Rip people off!!

In response to the complaint of ID *** Mr, *** did purchase a used Certified Ford Focus in April of 2016, at that time there where no issues or open recallsI have attached a copy of the Carfax to show there were no open recallsOn August 31, Mr*** did bring the
Focus in with 53,miles and a complaint of a transmission shutter while drivingThere were no open recalls but ford had a TSB to reprogram the transmission control module and replace the clutch and slave cylinderA loaner car was provided and all repairs were fixedThis was all covered under the manufactures p***train warranty because the car had less than 60,milesIn December of the car was brought in for a front tire shake and something banging against the vehicle while drivingWe verified the concern and found internal damage to the steering gear assembly. These repairs were covered under the extended service contract with a $deductable and a loaner car was provided. On May 4th the Focus was brought in again for jerking when shifting with 72,miles on the carAgain there was a TSB to replace the clutch and reprogram the transmission control module but the only open recall was 16sto replace all side door latches. All parts were ordered and scheduled to come in. On July 7, the Focus was brought in to fix the shutter and replace all side door latchesThe customer dropped the car off and a loaner car was again provided. The shutter was fixed under the TSB which is not a recall and falls under the manufactures warrantyWith the car now having over 60,miles on it the manufactures warranty has expiredHowever, this was a Certified car and is covered under the Certified warranty program with a $deductableMr*** would not pay the $deductible but Guess Motors agreed to pay it for him Guess Motors did not knowingly sell Mr*** a faulty car and we have been complying with Ford procedures for all repairsWe even provided a free loaner car when neededI’m not sure how Mr*** wants us to pay $when he has only had to pay a $deductable? I would first like to say I’m sorry to hear about the health of *** *** He has been a loyal customer of ours and we wish him the best. In April, *** *** contacted us about trying to get financed on a low payment carHe stated that he did not have the best credit and his
income was low, so he did not have a big down payment. At that time we were able to get *** *** approved but did not have a car that fit his budget In May, *** *** agreed to buy a Chevrolet HHR LT with 157,miles for $3,977. We had one bank that approved him for financingThe terms of the loan including, interest rate, down payment, and loan term were based off of his past credit history, income, and credit scoreThose terms were set by the bank not usWe do not have the book value from MayHowever, as of today the NADA Retail value for a HHR LT with 157,is valued at $4,So in May the book value would have been higher. The financing company will not finance a vehicle over book value. When *** *** came in to sign papers he did bring somebody else with himThey were in the finance office with *** *** at the time of deliveryLooking at the true facts of the situation we are not able to offer a refund as requ

His response is not acceptable to me im sorry but no matter what he believes I am owed some compensation here!! Ford admitted these vehicles are defective and have extended the warranty on themDocumentation providedHe can say he opted to pay it but he didn't pay 100$ for anything! I paid 12k for this vehicle that is now worth less than because of recalls and defects how is it fair that the dealer KNOWINGLY sold itThis problem was told to me during my first service appointment and they stated that they had been aware of these issuesThen why was it sold??? Seriously he needs to get on and just own up to the dealerships mistake!!

The final transmission repair did have a $deductible that was supposed to be paid by Mr ***We paid the $deductible charge for him? We did not knowingly sell him a vehicle with issues? At the time of the sale we ran a Car Fax and an OASIS check with FordThe car also went through a point inspection and was Certified by FordFord will not certify a vehicle with open recalls.? We have done everything that Ford has recommended us to do.? ?
