Overview = Duarte Nursery failed to sell us economically viable UCB-Pistachio rootstock as we contracted and they advertised repeatedly they soldOnce they promised on the phone through their representative to compensate us; however, our repeated demand letters have gone unanswered
Details = We contracted with Duarte Trees and Vines for UCB-Pistachio rootstock to start our family farm(Contract #*** signed by *** Duarte on 4/14/2012) We paid them $35,for 4,trees & tree protectors
They delayed our delivery monthsThen, delivered in OctWhen the trees came out of dormancy, we had lost treesDuarte replaced them without questionGood we thought
In the spring, we realized that something was wrongWhen we suspected that there was something wrong with our trees, Duarte's rep Steve Scheuber came &recommended that we use the services of their preferred tree tending group, *** *** ***They would help us to sort out the bad trees

Review: I purchased 1200 pistachio UCB-1 rootstock from Duarte Nursery which I later found to be contaminated with a plant-pathogenic bacteria, Rhodococcus fasciens. This bacteria causes the disease of leafy gall in many plants. The presence of Rhodococcus fasciens was confirmed by a plant pathologist at New Mexico State University. I have sent Duarte two letters informing them of the contaminated trees with the test results asking them for assistance and a refund yet I have never received any reply. The plant pathologist also informed me that she had also collected plants directly from Duarte Nursery and detected this bacteria on the plants before they shipped the trees to me. Many pistachio growers in CA and AZ have had to remove thousands of acres of pistachios due to contamination from this bacteria.Desired Settlement: I would like to be refunded $8,400 which is the price I paid for the trees.
