Thanks for the feedback if your intentions were to help my business succeed I was thinking when I took $off your final bill it would satisfy the work that you were not happy with In addition, I paid $to get you a step because you requested it but was never included in the total
charged, and the topsoil and replanting grass that was done in the backyard was not charged back to you, only $to cover the topsoil I have paid an additional $total for extra costs involved and on top of that discounted your price by $in hopes that we could reach an agreement and move on You told me you were satisfied and paid in full and I believed that to be the end of our working relationship You can imagine my surprise when weeks later you were posting negative feedback about me and telling me that you will take it down if I give you additional money, which you are now requesting again I apologize if you are not happy with the work but I urge you to move on from this uneasy situationThis project has been completed 100% to the specifics of our agreementI have not breached contract in any way

Here is original contract showing the terms and conditions of the agreement. There had been changes to the scope of work and pricing after this agreement and during the duration of project. I will send over a copy of the final invoice as well. I will not be refunding any additional monies to the customer as he has paid in full and we have completed all of the work outlined in the agreement. There was in fact, no breach of contract on our behalf.

The job was paid in full, correct. We did have a meeting at the tail end of the job where [redacted] was paid in full. BUT, there are incompleted items that we did discuss, but we did not discuss the flooding areas as I did not know about those at the time as we did not have rain on the patio to see that there was a problem: - There is flooding that exists each time it rains in two areas of our patio. This was caused from the new extension of our patio due to incorrect grading. There was no way of me knowing about this when the job was nearl completion. It never rained at that point for me to notice. I noticed it the first time as I was power-washing my patio to seal it. All the water dissipated as it was drying except the two areas that I am looking for him to repair. [redacted] knows of these areas as I have called and spoken with him on this. I have sent him emails, and text messages with photos and videos. His only ONE response was he was not sure what he could do about this and he  will look into it. This is unacceptable. And, I never heard back. - Paint on the final post next to our patio door needs to be completed. So, not a finished job. - Our latch on our gate of the portion of the gate they had to remove each day does not latch. It latched prior to the job. All of this needs to be addressed. Yes, the job looks beautiful. I never denied that. BUT, the job is not fully completed, and the flooding is something I would have never known about until there was actually water on the patio for me to see. How come he never got back to me on this, or the gate, or the unfinished painting? That is what I am very concerned about. When we get into the winter season, there will be ice rinks on my patio. Bottom line, there is a problem that exists and he needs to address and fix. How come these were not addressed from [redacted] on my initial complaint as these are my main complaints.Thank you very much.

In my June 8 letter, the remedy was two-fold. To fix what could be
fixed and a financial credit for couldn't be fixed. He gave me a small credit
but was not interested in fixing his work. I had already asked him several
times. He was desperate to meet payroll and I honored my commitment. The proper procedure for poor performance is to pay the contract
in full and request damages/reimbursements. He seems to think that just because
I met my obligations that he is relieved of his. How could I know at the time
how much it was going to cost to fix the yard and sprinklers? My eight page
letter (below) was explicitly clear that I was not accepting of any area of his
performance. I could have guessed at an amount and short-paid him, but he would have sued me and we would be in the same spot. Either he is willing to accept responsibility for his work or not. 
 
The breach of contract and the poor performance are both
objectively certain. Below are the areas where he indisputably breached the
contract and the attached photos prove poor performance. To continue to say
that he didn't breach the contract is just plain dishonest. I have asked
several landscapers to review his performance and they were frankly appalled at the
quality of work.
 
Contract states "rock face along outside edges" of the
concrete. 
There is no rock face or any other design on the outside of the
concrete despite promising options when he couldn't get a rock face in a timely
manner. His photo objectively proves this.
 
Contract states that any subcontractor used will be identified and
includes a 15% charge.
He never identified the contractor he used on the concrete, yet
blamed them for the delays. He had no control of subcontractors (of their
schedule, for example) and are not on his payroll. [redacted] clearly defines these as
subcontractors. 
 
Contract states that new plant materials will be placed in the flower
beds.
No new plant material was added. The old weed-infested plant
material was re-used and the weeds quickly returned. They were not killed or
prevented with [redacted] as promised. 
 
Contract states that changes to the contract for additional
services require a quote and signature. 
Landscape pavers were installed in the back without a quote or
approval of price. Last thing he told me was that it would be a wash since we
no longer wanted the tree in the front to be removed. To make things work, I
included this in the new contract because they did the work and I am a fair
person. The price is more than I wanted to pay, but I just wanted to get the
work done.  He is responsible for these breaches and the poor performance.
