Thank you for providing us an opportunity to respond to this customer's complaint. The customer states he purchased a *** *** from us on 9/18/2015, that we had advertised the vehicle to be in "perfect mechanical" condition, and that "by the time the car got home multiple issues were found
Took it to a local dealership for diagnoses and a long list accumulating to over $was given back." The customer requests that we either pay to fix the car or take the vehicle back and refund his money. Our dealership is located in Winchester, VirginiaThe customer lives in Irwin, Pennsylvania, and had driven a significant distance to our lot after seeing our Washington DC area *** ad on the internet (attached)Please note the ad does not claim the vehicle is in "perfect mechanical" conditionWe did state in the ad that it was a one owner vehicle, showing no accidents and service records on the (***) vehicle history report, all of which is trueThe customer wrongly accuses us of falsely advertising the vehicle was in "perfect mechanical" condition. The customer actually purchased this vehicle on 9/19/On September 21, 2015, he contacted us to complain of some oil drips on his driveway attributable to the vehicle he just purchasedAbout a week later, he told us he had taken the car to an *** dealer, who told him that various seals in the engine were seeping oilHe later sent us an estimate from the dealer that involved removing the engine, disassembling it, and replacing all of the various seals that were seeping oil.I responded by telling the customer that seeping oil seals are with used cars and that it is not economically feasible to fully correct such problems in a used vehicle by disassembling and replacing all seeping sealsIn most cases leaking engine seals can be controlled by oil additives, which expand the seals and lessen the seepage. At the time of sale the customer signed a non-cancellable Buyers Order with specific conditions of saleParagraph of the conditions states, "Any motor vehicle sold to Buyer by Seller under this Order is sold WITHOUT WARRANTY.,,as to its condition or the condition of any part thereof except as may be specifically provided in a separate writing furnished to Buyer by Seller." In addition, we provided him a copy of the Buyers Guide, which states that the vehicle is sold "As Is - No Warranty", Furthermore the customer signed the back of the Guide, acknowledging its receiptThis document specifically points out many defects that may occur in used motor vehicles, including engine oil leakage/seepage and transmission fluid leakage/seepage.Please note this customer purchased an extended warranty that covers many repairs on the engine and transmission: however, this extended warranty does not cover the replacement of seeping engine or transmission seals. We sold this car to the customer for $4,500, which is 46% below its NADA book value of $8,375, Despite getting a great price on the vehicle, the customer has threatened to file a complaint with the BBS and to trash our name on the internet unless we pay him $5,to replace the seeping seals, or take the vehicle back.Given the circumstances of this "as is" sale, we believe the customer's demands are unrealistic and completely without meritFor the above reasons we have declined to pay the customer any money or take back the vehicle.Regards,*** ***Dealer Principal

Thank you for providing us an opportunity to respond to this customer's complaint.
margin-bottom: 5pt;">The customer states he purchased a 2004 [redacted] from us on 9/18/2015, that we had advertised the vehicle to be in "perfect mechanical" condition, and that "by the time the car got home multiple issues were found. Took it to a local dealership for diagnoses and a long list accumulating to over $5000 was given back." The customer requests that we either pay to fix the car or take the vehicle back and refund his money.
Our dealership is located in Winchester, Virginia. The customer lives in Irwin, Pennsylvania, and had driven a significant distance to our lot after seeing our Washington DC area [redacted] ad on the internet (attached). Please note the ad does not claim the vehicle is in "perfect mechanical" condition. We did state in the ad that it was a one owner vehicle, showing no accidents and 21 service records on the ([redacted]) vehicle history report, all of which is true. The customer wrongly accuses us of falsely advertising the vehicle was in "perfect mechanical" condition.
The customer actually purchased this vehicle on 9/19/2015. On September 21, 2015, he contacted us to complain of some oil drips on his driveway attributable to the vehicle he just purchased. About a week later, he told us he had taken the car to an [redacted] dealer, who told him that various seals in the engine were seeping oil. He later sent us an estimate from the dealer that involved removing the engine, disassembling it, and replacing all of the various seals that were seeping oil.
I responded by telling the customer that seeping oil seals are normal with used cars and that it is not economically feasible to fully correct such problems in a used vehicle by disassembling and replacing all seeping seals. In most cases leaking engine seals can be controlled by oil additives, which expand the seals and lessen the seepage.
At the time of sale the customer signed a non-cancellable Buyers Order with specific conditions of sale. Paragraph 6 of the conditions states, "Any motor vehicle sold to Buyer by Seller under this Order is sold WITHOUT WARRANTY.,,as to its condition or the condition of any part thereof except as may be specifically provided in a separate writing furnished to Buyer by Seller." In addition, we provided him a copy of the Buyers Guide, which states that the vehicle is sold "As Is - No Warranty", Furthermore the customer signed the back of the Guide, acknowledging its receipt. This document specifically points out many defects that may occur in used motor vehicles, including engine oil leakage/seepage and transmission fluid leakage/seepage.
Please note this customer purchased an extended warranty that covers many repairs on the engine and transmission: however, this extended warranty does not cover the replacement of seeping engine or transmission seals.
We sold this car to the customer for $4,500, which is 46% below its NADA book value of $8,375, Despite getting a great price on the vehicle, the customer has threatened to file a complaint with the BBS and to trash our name on the internet unless we pay him $5,000 to replace the seeping seals, or take the vehicle back.
Given the circumstances of this "as is" sale, we believe the customer's demands are unrealistic and completely without merit. For the above reasons we have declined to pay the customer any money or take back the vehicle.
Regards,
