Thank you for the opportunity to respond to this claim.I have documentation showing an effort on my companies part to work out an equitable solution with the client and can provide it upon request.? I also have a substantial group of change orders that will reflect that the price of the project is far greater than $100,and that there is still a substantial balance owed on the project.? We have completed most of the change orders and have worked with the client to get it to a point where they feel comfortable to take it over.? I have tried to work with their structural engineer on several items that were needed as a result of the changes they asked to have initiated as well.In regards to time-lines.? The initial changes to design prior to permit approval resulted in delays that were not in our control and I personally spent many trips to the engineers office and the building department trying to resolve the issues and eventually got the permit.? The change orders that added additional time to the project and the pursuit of the permit that was delayed due to the changes prior to approval added a great deal of time to the time-line that is not reflected in this clients post and are very misleading.The amounts of money described in the post are also very? misleading.? There are at least, just over $27,in change orders that would raise the project price to $127,+/- and a combined total of $90,+/- has been paid (I still need to verify the exact amount that has been paid to this point).? This means that a balance still exists of $37,+/- and we have completed large portions of the project to date.The structural engineer refuses to work with me on any updates due his strained relationship with the clients and my HVAC sub-contractor has also left the project due to issues that have arisen with the client.? There is unfortunately a track-record here and I am hopeful that we can work out a resolution.? We are also dealing with the city of Bellevue as result of some work the homeowner did and ECA on their property that have yet to my knowledge deal with, which puts not only my company, but their neighbors and their own home at risk.? I am hopeful that those issues are also handled soon with the weather coming in for the fall and winter

Complaint: ***I am rejecting this response because: the statements made by Duet is inaccurate. He is not working or attempting to work with us in good faith and that is why this will be ligitated.The work was divided into three sections: Fixed cost was structural work that Duet own the cost for $42K, allowances for non-stuctural work for $57K, and change orders for $22K. We directly paid him $80K thus far and received only an $25K of work with much of the work being defective. For example, the contract specifically states the the subfloor should be plywood and he installed cheap OSB which is not even leveled. In addition, he cut our floor joists in several places without our approval and cannot figure out how to get it supported again. In one email, he said he talked to an engineer and have a solution, then said in a later email stated that the engineer would not work with him. The structural work that he is solely responsible for and has full control over was worth $42K according to the contract. When we asked other contractors into give us a bid to finish his structural work, it was an additional $44K. His estimate of drywall in the contract was $4.3K vs a competitor bid of $7K. His bid for subfloor and tile installation was $8.8K when the bid for tile installation alone was $8K. He habitually low ball the bid and threw in lots for freebies that will never be honored to get us to sign the contract. He stopped working because the cost to complete is much larger than what he estimated. We tried to help out by offering to install the windows for him for free to reduce his labor cost. Sadly, we declined because he stole our money and don't want to buy the window.On the change orders, he forced us to do a change order for a panel upgrade for $shortly after work started because he underestimated the electrical. We had to pay an additional $in plumbing change order, and an additional $3K in HVAC overage because he underestimated the work. He fraudulently told us that the engineer required us to add support in the attic and forced us to pay $1100 for additional support. He proceeded to screw some boards into the attic joist thinking that the two screws would could carry the weight from the roof and add meanigful support to the house. In some places, no screws were even added. When confronted about this, he said in an email that the attic support was not actually needed from engineering and engineering did it for free. If engineering did the work for free, there is no way engineering said recomment that the weight of the roof be carried by two screws. We did willingly requested a change orders for a french door; however, we have cancel that and all open change orders months ago, yet he has refused to give us back our money from that.He fradualently invoices us for doors and windows to be ordered. No doors or windows were ever ordered. He gave us an order invoices from another client as proof that it was ordered. This is clearly fradualent. He has a pattern of lying. When pressed on why the subcontractors cannot finish up plumbing and electrical, he gave a lot of excuses. When I tracked down the subcontractors and called them for the truth, they said they were not getting paid. On the time line, we paid $20K in Oct for him to start work. He did not do any work until Jan and was suppose to complete by the end of March at the latest per the contract (ie complete weeks after start of project). We suspended work around May due to the fact that he was not completing on time and kept billing us for more money. In good faith, we signed a new contract for him to complete the entire project by end of July with no new change orders. Stupidly, we gave hime more money but the result was the same. We set very simple milestone to complete work in two weeks increment. He could not even complete the simple tasks that he had chosen for himself in the alloted two weeks. Simple question for MrS*** is why hasn't he return the money for doors and windows that were never ordered, and return the money for all the cancelled change orders?
