After our discussion on the phone yesterday, things weighed on my mind with the statements made. I'm not going to argue further or try to take you to small claims to reclaim the money owed to us for the work performed. I want to address how...

this occurred and how we schedule service requests. I am an honest, reputable, and local contractor who stands behind my work and products. Our crews do around 30 drives per day, all in which the customers calls and we either verbally or email to schedule dates. We never just "stop in" or "swing by" to do the work though I know other companies may operate that way. As a rule, we do not, which is why I wanted to clarify the situation:
- 2004 we sealed your driveway
- 2008 we sealed your driveway again
- 2012 you called to request a bid. I came out to provide a free estimate and was honest with you by telling you to save your money and not seal it due to its condition. I passed along a name of a reputable contractor to consider to replace it.
- You replaced the drive
- 2015 you emailed me for a bid to seal the driveway because it was a couple years old now. No one was home at either house so I dropped off the free estimate at your door as well as an estimate at your neighbor's home (which shares a drive with you). You both called/emailed and scheduled a date to have the work performed by verbal conversation with my secretary. The day we were scheduled to do the work it was raining so the work could not be performed that day. We then call all of our customers to reschedule for that day. We will either speak with the contact or if there's a voicemail, we simply leave a standard message stating that we will not be able to make the appointment that day due to the weather and will give you another date (usually the next day) the crew will be there.
I was confused when you said "just because I called for a free bid doesn't mean I wanted you to do it" when you (and your neighbor) had already called to schedule(authorize) the work. But now you are saying that "you were out of town when we called to reschedule and you didn't confirm back that you wanted us to come back the next day" - this doesn't make sense that you would no longer want the service done. Your neighbor also gave us a five star review online and I have email conversations that I will forward on to you. I was also confused when you said, "I really didn't need it done but my neighbor did" when you and your neighbor already had it scheduled, you share a drive, the driveways are the exact same year/material, and you've always done it together. I have worked to reach a common ground with you and think it is fair to be paid for the service we provided. I will also forward you the conversation with the neighbor.

The email conversation that was forwarded to me is NOT for my property and I believe the business had me confused with the wrong house. I did NOT ever authorize this company to perform this work as I simply emailedthe company for a bid and it was left on my door. I did not sign, or verbally authorize this work to be done on my side of the property

I have tried to reach out to this customer and figure out a resolution on both ends but he is not replying back to me now. The scheduling for this work was done a long time ago... I believe it was initially scheduled but never confirmed back to reschedule (due to rain on the scheduled day). Honestly, we don't keep recorded phone records of all our conversations for scheduling. At this point it is all he said/she said...I don't believe my company would ever just go to a customer's house and do the work without some kind of scheduling communication. From his original email to the Revdex.com he stated that he was willing to pay 50% but I haven't seen or heard anything back on that. At this point, anything is better than nothing for payment I guess.
