We have received your letter regarding [redacted] complaint for the 2004 [redacted].Vin : [redacted]The client came on 11/01/14 to test drive the vehicle for 15 minutes, after liking the car they decided to go ahead and purchase...

it.The car was in great condition after passing Virginia inspection. The client stated that we would get her the emission done, however we have never promised this and we are not required to do it as a Virginia car dealer.we have never promised anything to the client as she signed the buyer guide which states that the vehicle is sold AS IS from our facility. However we provided her a third party warranty at her cost for 3 months including the powertrain. After 2 weeks the client called us telling us one of the tire blew up, the tires were in great condition and passed safety inspection. She started complaining about issues and she took it to her mechanic who provided her a list of repairs that needed to be done. The estimate the customer brought from her own mechanic was $3700 worth of repairs. As courtesy for our client satisfaction we told her would take the car to a third party mechanic who would be able to fix the issues at a dealer cost only. [redacted] agreed to take the car to our third party mechanic who was able to fix the vehicle for $1400.[redacted] agreed and decided to have some of the repairs done at her cost and would do the rest of the repairs later on.We helped her with the tire and paid from our own money. She paid $780 to the third party mechanic and agreed to contact us later on to have the rest of the repairs done.we as a used car dealer in Virginia and with a great reputation among our clients sell cars AS IS.The client signed the buyer Guide and we specifically told her the car is sold AS is NO warranty from our facility, and if she had any problem she would have to contact the third party warranty company.Attached documents :-copy of the buyer guide with the customer signature stating the vehicle is sold AS IS-invoice from the our third party mechanic who only charged her at our dealer cost

 Complaint: [redacted]
I am rejecting this response because: This response does not address my issues. First they say the car was in good working condition and then they say that their mechanic could fix it for $1,400. If it was in great working condition, there would be no need for $1,400 in repairs. I bought this car under the condition that it pass emissions. (See attachment). I did not, even after my mom paid nearly $800 to fix it. The only reason she paid that is because they threatened to keep the car and title unless she paid and she didn't want me to lose all of my money. If this business was operating in good faith, it would have made the repairs. She paid another $250 to fix the problem so that it would pass emissions. As soon as it passed, something else broke on the car. The fact of the matter is, they sold a 17-year-old an unsafe, $4,000 car that needs nearly $4,000 in repairs. Under Virginia law, a minor is not bound by any contract and has the right to void a contract even after reaching the age of majority. I'm voiding this contract. The only satisfactory conclusion to this is a complete refund.

Review: Purchased 2010 Honda Civic on 9/20/13. Car Dealer knowingly and purposely misrepresented that vehicle had never been in a bad accident and that air bags had not deployed. Dealer did not report major structural damage, a swayed and twisted frame and an inferior core support. Dealer used body filler and shims to temporarily repair major damage. Car was very dangerous to drive. Dealer did not report the repairs to Carfax. Dealer also provided an erroneous buyer's order/receipt which did not show what we paid for the car, and showed a trade-in rather than a cash sale with appropriate taxes paid.

Contacted Dealer. Response was that the purchase was "As is" and that we have no recourse. We have conferred with a lawyer who has informed us that CONCEALMENT of known major defects constitutes "MATERIAL MISREPRESENTATION." Therefore, the "As is" clause does not apply to this case.Desired Settlement: Dealer should reimburse us for structural repairs so that the car is safe to drive.

Review: About a month ago, I purchased a 2011 [redacted] from Dulles Auto Sales. The vehicle was listed for just under 17,000. It was agreed upon that I would pay the full 17,000 to the dealership and the registration, title, and taxes would be handled by the dealership, specifically a salesman named [redacted]. About two weeks after purchasing the vehicle, I called [redacted] to get an update on when to expect the registration, title, and tags in the mail. [redacted] told me that he had a problem at the Department of Motor Vehicles and that a signature needed to be placed on the paperwork in order for the Department of Motor Vehicles to accept the paperwork. [redacted] wanted me to come and sign the paperwork so that DMV will accept it, however, I live about 2.5 hours from Dulles Auto Sales and suggested that the full amount of money needed would be sent to me with all of the paperwork needed, plus additional money if requested due to underpayment. The amount of money agreed upon was $500, plus an additional $50 for the inconvenience of resolving the issue with the Department of Motor Vehicles.

When the personal check and paperwork arrived. The personal check was a total of $540. Although the check was $10 under the agreed upon $550, I proceeded with cashing the personal check and completed the transaction with the Department of Motor Vehicles. The totals from Virginia DMV are as follows: $530 for the title and taxes and $78 for a two year registration. I proceeded with calling Dulles Auto Sales about the underpayment, but there was no answer after several attempts.

Yesterday, 4/16/14, I received a letter from my bank, [redacted], about being charged $12 for depositing a “frozen/blocked” check, plus the $540 was taken out of my checking account. I called Dulles Auto Sales about the frozen check. After explaining to the salesman, [redacted], that the check was frozen/blocked and that I was being charged $540 plus a late fee, [redacted] proceeded to tell me that he knew that the check would bounce because “the account was closed”. Instead of trying to resolve the issue on the phone, he told me that he was going to call me tomorrow (4/17/14) about the issue. During my lunch break, I called [redacted] at the dealership to resolve the dispute. After explaining the situation, [redacted] quickly told me “I will send you $600 in the mail”. I continued to inform [redacted] that I have copies of the receipts from the Department of Motor Vehicles showing the costs of all transactions and the totals, but [redacted] insisted that he was only going to send me $600, then he said goodbye, and hung up the phone. Not only was [redacted] rude and demanded only $600 settlement, he did not clarify if the check would be a personal check, which is not trustworthy because of the prior bounced personal check, or a money order or certified check. The saleman hung up the phone after stating that he was sending a $600 check.

The salesman at Dulles Auto Sales was very unprofessional on the phone and refused to honor the agreements of the sale. The salesman, [redacted] did not contact me about the problems that were taking place with the Department of Motor Vehicles, which could have resulted in expired temporary tags on the vehicle. The salesman also deliberately did not inform me that the check that was sent would bounce from being frozen/blocked.

All receipts and copies can be provided by me upon requestDesired Settlement: I would like a fair and honest transaction. $530 for title and taxes, $78 for the registration, $12 for the bounced check, and the agreed upon $50 inconvenience charge. The total would be $670 in the form of money order or certified check. A warranty that was discussed amungst the the saleman and I, due to improper A/C functions and improper shifting of the transmission, is also a desired outcome.
