Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Like I originally stated, we have already spoke to [redacted] roofing and informed them of the incident [redacted] Roofing cannot believe at the carelessness the dumpster company showedNeedless to say, I will not play this back and forth gameMy paperwork does not show a signatureWhile there company has a signed formIf we signed it, why don't we have the signed copy? To me, the final weight of the dumpster and the weight document is irrelevantWhat matters is the fact that there was damage done to my driveway that could have been prevented on many different levelsNone of which is my faultI am innocentMe and my family did not cause this damage to my driveway Another issue we have, is the fact that this was a roofing job and the Dumpsters R Us company still only sent the smaller dumpsterClearly, the roofers had to use what they were provided with (the dumpster we recieved)Me and my family are not the roofing or dumpster professionalsThe only fault me and my family have is wanting a new roof and doing business with a company who we believed would do a good jobInstead, our driveway was ruined The whole point of this complaint is that regardless, of what dumpster was brought to my house initially and regardless, of who ordered it, the damage was caused by the Dumpsters R Us company failing to abide by good business practice and accept our request for a bigger truck - or realizing that this was a roofing job - that these "heavy shingles" needed a bigger dumpsterIf the Dumpster R Us company had the knowledge that 1.) shingles are heavy and require a bigger dumpster and 2.) The truck that was sent could not handle the heavy load, then Dumpster R Us had the responsibility to inform and make the best decision so as to not cause harmIn the end, harm was done Furthermore, if the Dumpster R Us company felt absolutely no responsibility, then why was an agent from Dumpsters R Us at my house on Tuesday, August 29th at 2:pm to inspect the damage? Why was it requested we send pictures to [redacted] from the day of the incident? Once again, the response to the Revdex.com, and thus me, and the actions done by this company do not make much sense Please find attached the pictures of the Damage taken the day of the incident Regards, [redacted]

I have again attached the signed contract that states a 15yd ton dumpster was ordered on August 14, Its unfortunate the customer filled the dumpster with almost twice the weight than they had requested (5.82tons)- again I have attached the weight slip of this dumpsterWe placed the dumpster where the customer wanted it as we do with all our customers and we picked it up when it was requestedThe customer should have requested a bigger dumpster which is what was needed and would have accommodated the weight the customer put in the dumpsterThis is something the customer should speak to the roofing company about especially if they were the ones who told the customer to get a 15yd ton dumpsterWhoever advised the customer to get a 15yd ton dumpster is who they should speak toRoofing shingles are extremely heavy and that is something the roofing company should have expressed to the customer (I am shocked they did not) and advised them to go with a bigger dumpster not a smaller one (they should know better)Again I am sorry they did not inform the customer that the weight was going to be more than the tons that was requestedThere is a formula all roofers know in order to calculate how heavy the material will be which is why they should have never told the customer to order a ton dumpster

Our reply was "thank you, if you can fix it, that would be great- definitely appreciated, can we have the number as well to follow up? The driver then went into his truck, called the office, came out with a number missing a digit and said "you know what the problem is- this truck can't handle this heavy of a load"It was then that we called [redacted] Roofing and let them know what happened and they were shockedThey asked for the phone number to the companyIt was then that we realized we had an incomplete numberLuckily, we had taken pictures of the side of the dumpster and gave him that numberThe project manager said he would call them and get back to us but never didBefore he got off the phone, he told us to call the dumpster company ourselvesWe followed the suggestion but what we got was blantant disrespectLike I said before, the first time we called, we were met with anger and a "didn't you read the contract"We got the only paper we had (the drop off receipt) and reviewed itThe second call from them was to tell us they had to speak to more peopleThe third time they called, my husband answered the phone, and all the guy kept saying, rather rudely, is "look at and read the contract- we are not responsible"This is all the guy said over and overThen this dumpster r us worker tried to say "it's your fault for denying a bigger truck"My husband replied bull and read the man the back of the dumpster receiptStating "they are responsible to fix damage when it is gross negligence by them or their employees"He denied this and said "we are not responsible periodSince the conversation was going no where, my husband got off he phone with the manWe were forced to take further action and reported them to the Revdex.com since they were not willing to negotiate, own their mistake, or work with usThe definition of negligence is " failure to take proper care in doing something." The driver finished lifting the dumpster and on his way out said "it will be a bad day for me"- clearly showing guiltLastly, It is considered negligence because: 1.) the driver knew that the truck was not capable of lifting the load and attempted it anyway2.) the driver said he forewarned the company that the trucks couldn't handle the roofing loads and the company itself took no action to rectify the situation3.) we did request a bigger truck and the driver stop what he was doing but that request was denied4.) the driver showed guilt which means he knew he was in the wrongRegards, [redacted]

On August 14, 2017 one of our drivers delivered a 15yd dumpster with a 3 ton limit to [redacted] at [redacted] 01854. [redacted] waste called us on August 13, 2017 and asked if we could help them out with a few jobs because they were overbooked. This was one of the jobs....

When the driver showed up at the location and spoke to [redacted] about placement, she told him she wanted him to back it in as close to the house in the area the roofers were going to be working. She wanted it to be convenient for the roofers so they could throw the shingles right into the dumpster from the roof. My driver advised [redacted] that he didn’t think putting it that close was the best idea. [redacted] continued to say it was an old driveway and they were going to be redoing it soon and she did not care about it and to place the dumpster where she asked. So, my driver being as helpful and courteous as he could placed the dumpster where the customer wanted. After the dumpster was placed exactly where [redacted] wanted, [redacted] signed the rental contract, was given a copy and the driver left. The receipt given to [redacted] had all the company’s information on it if she needed to call or email us. On August 23, 2017 a request for the pick up of this dumpster was made. My driver showed up there and hooked the dumpster onto the back of the truck and when he adjusted the hook to lift the dumpster he realized the dumpster was much heavier than 3 tons and said he could not pick it up and would send another truck because the dumpster was too heavy. [redacted] insisted he pick it up and not to send another truck because it would have been days before we could get another truck out there. She said she did not care about the driveway she was getting a new one. The driver continued to pick it up and the weight of the dumpster pushed on one of the wheels. There was a small crack about 1’ x 1’ from the wheel. She then asked my driver if he could patch that one area up and he told her to call the office. The office then explained our policy and explained to her we put the dumpster where she asked and told her the dumpster was heavier than normal when we went to pick it up and was told that the weight might scuff up the driveway but the driver was told to pick it up anyway. We did everything we could to make sure the customer was happy and we did everything they asked and made them well informed of what could happen. The rental contract was signed and “Dumpsters R Us is not responsible for damage caused by the container to concrete, asphalt or any other structure.”. Because the dumpster was filled with double the weight ordered, that caused the wheel to make a dent in the driveway. This was the customers negligence not the company’s. A 3 ton dumpster was ordered and 5.82 tons were put in. We have copies of the signed contract and a copy of the weight slip from the transfer station which are attached. We also have trackers on our truck that show the driver delivering the dumpster, picking up the dumpster and going straight to the transfer station with the dumpster. Unfortunately, [redacted] has a very old driveway that has many cracks and patched up areas and our negligence was not the cause of this small crack.

I have again attached the signed contract that states a 15yd 3 ton dumpster was ordered on August 14, 2017. Its unfortunate the customer filled the dumpster with almost twice the weight than they had requested (5.82tons)- again I have attached the weight slip of this dumpster. We placed the dumpster where the customer wanted it as we do with all our customers and we picked it up when it was requested. The customer should have requested a bigger dumpster which is what was needed and would have accommodated the weight the customer put in the dumpster. This is something the customer should speak to the roofing company about especially if they were the ones who told the customer to get a 15yd 3 ton dumpster. Whoever advised the customer to get a 15yd 3 ton dumpster is who they should speak to. Roofing shingles are extremely heavy and that is something the roofing company should have expressed to the customer (I am shocked they did not) and advised them to go with a bigger dumpster not a smaller one (they should know better). Again I am sorry they did not inform the customer that the weight was going to be more than the 3 tons that was requested. There is a formula all roofers know in order to calculate how heavy the material will be which is why they should have never told the customer to order a 3 ton dumpster.

Your accusations towards me and this family are a bold face Lie. I'm am appauld by the companies response and that they could stoop to such levels in a pathetic attempt to try and get out of their mistake. First of all, on August 14th, I never said that the driveway was old and we would be redoing it soon. Second, my request was to put the dumpster on the sand- in the yard- so that it would be close to the workers and make it easier to toss shingles during the roofing job. I wanted it this way beacause I care about my property - including my driveway. Furthermore, I told the driver I had children in the house and had to make it as safe for the children as possible. In the yard, on the side of the garage, was the best and safest option. Third, upon delivery we never received a contract. What we received was a drop off receipt to confirm we had actually gotten the dumpster. We never called [redacted] for this dumpster. We never ordered this dumpster. [redacted] Roofing handled all the business because it was all apart of our roofing agreement. Therefore, if [redacted] contracted this company for the job, either [redacted] or [redacted] Roofing would have their so called "contract". Fourth, we never signed anything. I will attached a copy of the drop off receipt to show we never signed for it. Fifth, on the back of the drop off receipt it states: "Dumpsters R Us is not responsible for damage 'except for gross negligence by Dumpsters R Us and its employees'". Sixth, Upon arrival of the dumpster, we were never told any information about the dumpster or its weight limit. All we were asked was "where do you want it?" Furthermore, we have a dog and the driver was so afraid of the dog that he couldn't do the job and leave our house fast enough. On August 24th, the dumpster driver came around noon. My husband, daughter, and myself were all outside watching the driver. My daughter had her phone for pictures. When the driver first arrived, we were asked to move our cars so he could do his job. We obliged. When the driver started to pick up the Dumpster it started to tilt so he asked what we had in the dumpster because it was awfully heavy.  Our response was "just the roofing supplies". The driver got out of the truck and said "They should have ordered  get a bigger dumpster. The dumpsters are too heavy for this truck. I have complained to the company several times without response from them". Our response was - "stop what you are doing, we should get a bigger truck". The drivers response to our request was ignored. He got back in his truck, put the dumpster half way down and tried to rebalance the truck. He thought if he could lift it just a few inches the dumpster would load. It was at this point where the dumpster started to wobble and I was afraid of losing my garage. I yelled to him. "Stop, stop, your going to ruin my garage". I was so afraid of losing my garage at this point, I didn't want him to continue. The driver then thought if he could just pull the dumpster a little bit foreword and clear the garage, he would be able to lift the dumpster. This is when the damage to my driveway occurred. The pictures I can send, clearly show the drag marks. The driver was able to lift the dumpster a bit but ended dropping it on the middle of the driveway creating a big hole. At this point my hands are on my head saying " omg! look at my driveway" The driver came out of the truck, with his foot started filling in the hole with the materials he dug up. Said he would take a picture and call his manager to see if they could fix it." Our reply was "thank you, if you can fix it, that would be great- definitely appreciated,  can we have the number as well to follow up? The driver then went into his truck, called the office, came out with a number missing a digit and said "you know what the problem is- this truck can't handle this heavy of a load". It was then that we called [redacted] Roofing and let them know what happened and they were shocked. They asked for the phone number to the company. It was then that we realized we had an incomplete number. Luckily, we had taken pictures of the side of the dumpster and gave him that number. The project manager said he would call them and get back to us but never did. Before he got off the phone, he told us to call the dumpster company ourselves. We followed the suggestion but what we got was blantant disrespect. Like I said before, the first time we called, we were met with anger and a "didn't you read the contract". We got the only paper we had (the drop off receipt) and reviewed it. The second call from them was to tell us they had to speak to more people. The third time they called, my husband answered the phone, and all the guy kept saying, rather rudely, is "look at and read the contract- we are not responsible". This is all the guy said over and over. Then this dumpster r us worker tried to say "it's your fault for denying a bigger truck". My husband replied bull and read the man the back of the dumpster receipt. Stating "they are responsible to fix damage when it is gross negligence by them or their employees". He denied this and said "we are not responsible period. Since the conversation was going no where, my husband got off he phone with the man. We were forced to take further action and reported them to the Revdex.com since they were not willing to negotiate, own their mistake, or work with us. The definition of negligence is " failure to take proper care in doing something." The driver finished lifting the dumpster and on his way out said "it will be a bad day for me"- clearly showing guilt. Lastly, It is considered negligence because: 1.) the driver knew that the truck was not capable of lifting the load and attempted it anyway. 2.) the driver said he forewarned the company that the trucks couldn't handle the roofing loads and the company itself took no action to rectify the situation. 3.) we did request a bigger truck and the driver stop what he was doing but that request was denied. 4.) the driver showed guilt which means he knew he was in the wrong. Regards,
