Review: The rooms are substandard and unsafe with glass shower doors that can fall down on you or your children trapping them in the shower. The bed is old with springs that hurt your back. They do not adjust the bill to reflect substandard conditions. The manager is ill equipped to effectively address consumer issues and resorts to insults and accusations to shirk off responsibilities to provide a safe environment for the guests. THis is inexcusible for a motel that wants to charge all inclusive "resort" fees. Additionally, there are no lifeguards on their private beach during the weekdays which is evidence of their criminal negligence.Desired Settlement: I would like my bill reduced to say the least by half of what I paid for a room "upgraded" that was worse than rooms that were cheaper in price.

This letter is in reference to a complaint made by [redacted]. On Sunday July **, 2013 [redacted] made a reservation in person at the front desk for a Deck Premium hotel room with 2 queen sized beds for 4 nights arriving on August **, 2013 and departing on August **, 2013.

It was explained to her that we would need a 50% deposit in order to make the reservation, and that the deposit would be non-refundable once taken since we have a 30 day cancellation policy. She agreed to these terms and allowed us to charge a deposit of 50% before tax to her credit card.

On Tuesday, July **, 2013, [redacted] contacted the front desk by phone and stated that she needed to cancel her reservation for August ** through August **. We explained to her that she would lose her deposit by doing so. She decided that she did not want to lose her deposit, so we offered to allow her to move the dates of her reservation to better accommodate her.

She told us she could only move her reservation to the weekend prior, so arriving on Friday August **, 2013 and departing on Monday August **, 2013. We explained to [redacted] that unfortunately we did not have any rooms with 2 queen beds still available for that weekend and she said that switching into a room with a single king sized bed would be fine. We also explained to her that the rate would be different for this room type due to the better view and that our rates are higher for weekend stays as opposed to midweek stays. [redacted] acknowledged these changes.

Upon arrival on Friday August **, 2013, [redacted] checked into her room with her 2 children (a son and a daughter). She had no complaints about the room until the following morning, stating that the bed was uncomfortable. The attendant working the front desk stated that unfortunately there were no other rooms to switch her into at the time due to the hotel being at maximum capacity, but a note would be made to contact her if anything became available.

On the evening of Saturday August **, 2013, [redacted] was found violently vomiting into a garbage pail on the hotel's deck area. She was discovered by the property manager of the hotel who asked a nearby friend of [redacted]'s ([redacted]) if she was alright. [redacted] replied that she would be fine and that [redacted] had just consumed too much alcohol over the course of the night. [redacted] was offered assistance back up to her room, but denied the help.

At check out on Monday August **, 2013, [redacted] refused to pay her remaining balance. She stated again that the bed was too uncomfortable for her and also that the shower door was broken. When we asked why it was not brought to our attention that the shower door was broken (we could have easily had maintenance go up and fix it), [redacted] did not have an explanation. It is ultimately our assumption that [redacted] probably broke the shower door herself in a drunken manner on the night of Saturday August **, and did not want to report it in fear of being charged for damages.

It is also our assumption that [redacted] found the bed uncomfortable due to having to share the bed with her 2 children. We would also like to point out that no complaints had been made about the mattress in that particular room prior to [redacted]'s stay and no complaints have been made since.

Finally, our lifeguarding staff opens the beach for public swimming based on the occupancy of the hotel. While lifeguards may not be on duty during the midweeks due to low demand, they are available to help with setting up beach chairs and umbrellas for our guests. Swimming is permitted, but is under a "Swim at your own risk" policy when lifeguards are off duty. This is in accordance with the Village of [redacted].

It is noted that a bar and grill is on site and if I was such a bad manner how would I have had the where with all to use a shower? I went directly to my room and to bed. For you to accuse a guest of something that was not directly witnessed by you or staff such as breaking the shower door is again an example of your lack of ability to accept responsibility for the poor conditions of the room. Your response overall is in poor taste and once again insulting to a guest. Also, I guess my children and I never slept in the same bed before, so your excuse for the box spring you call a mattress must be my fault as well. You were apprised of all the complaints and walked past me numerous times without acknowledging anything until I returned to you at the front desk. Again, indicating you had no intentions of doing anything, not a single thing about my complaints.

What transpired between the time you were discovered getting sick on the deck and the following morning will always ultimately be an assumption on our part. It would be an invasion of privacy for us to have any direct evidence of what went on in the room that night.
