To Whom This May Concern:I reached out to the East Liverpool, OH Dunham's Sport manager to investigate this matter and learned that the rack signage referenced in the Complaint was not only specific as to the product that was advertised for sale, but was also specifically facing the arm of the 4-way
that contained the correct sale product. The sale rack in question was not round, as described by Customer, but was actually a typical retail 4-way rack with arms going out in various directions. The sign was two sided, with the sale sign facing the arm with the sale product, with the back side displaying a Nike logo without sale language. The type of shirt that was on sale was specifically listed as the "Men's short sleeve Legend T". It did not indicate that all shirts on the rack were on sale, nor did it indicate and any basketball shirts were on sale. I have attached two photographs of the rack and sign in question. Dunham's certainly did not intend to cause any undue confusion and took sufficient steps to prevent it. Please let us know if further clarification is needed, or if it is necessary for Dunham's to take any additional steps to prevent confusion in the future
