Upon receiving this correspondence, I was completely confused and taken back by the comments madeAs you can see by the attached e-mail communication (Attachment & 2) along with documented phone calls on May 5th and 6th with Mr [redacted] , it was our understanding that he was satisfied with the plan to repair the narrow piece of land that separates his home and our property line (See picture A)For the record, the sprinkler system was originally located partially on our property but because it needed to be repaired anyway and we share the same irrigation contractor as their builder we did not make a big deal about it and the irrigation contractor was just going to make sure when fixing it that it did not cross over onto our propertyTheir irrigation company came out assessed the fix and is in the process of scheduling with the homeowner directlyThe irrigation company has not turned the system on for the season due to their scheduling and nothing to do with our companyThe cracked corner of the driveway was torn out, replaced and completed yesterday(See picture B) In reference to the damage on the side of the houseUpon further research and inspection we find this to be inaccurateMr [redacted] was out of town during this time and the individuals at his home made this claimUpon requesting pictures each of the dents, scrapes, etcpreviously referred to had already been painted over with white and not something that happened as they were grading the area on the day in questionIf our equipment had made those dents to the metal flashing you would see metal not paintI have attached the pictures (See pictures C,D,E) for your reference as well Mr [redacted] called and communicated these findings to Mr [redacted] who agreedAs far as the landscaping, as you can see by the attached correspondence, we were not made aware that Mr [redacted] preferred to use another landscaper of his choosing until May 6thWe immediately agreed to his request and only asked to see the bid prior to the work being done and we would reimburse them for the expenseWe have not yet received a copy of any bid from Mr [redacted] at this timePlease also be advised that we will be installing a construction fence within our property line to avoid any unintended contact with his propertyThis will take place once the irrigation is trenchedPlease let us know if you have any questions or need any additional informationThank you for your timeThank you, [redacted] M [redacted] D.B [redacted] Construction, LLC Glebe Street, Suite #200, Carmel, IN

I am writing in response to complaint ID # [redacted] Please be advised that we feel that the claim is unfoundedWe gathered all necessary permits per the City of Carmel and began to dig on our lot [redacted] in the [redacted] As you may be aware these homes along [redacted] Street are very close togetherAs a courtesy we attempted to contact Mr [redacted] the week prior to our digging and they were on not in townWe began to dig on Tues/Wed the following week and on Thursday we were hit with a large storm and their yard washed out into our holeThese homeowners contacted the police and building and code services (City of Carmel) over the weekend and subsequently these entities determined that there was no damage to their foundation and that some of the irrigation and landscaping was actually on our property to begin withMr [redacted] contacted our office over the weekend, and we returned his call on Sunday with several messages, but he didn't return our callOn Monday, we spoke to the homeowner as well as the other notified parties, and assured them that we would happily repair or replace any of the areas affected by this situationAfter our conversation on Monday with Mr [redacted] , we had a mutual agreement as to how this was going to be addressedHe was very pleasant to talk with, and was in agreement with the plan and very understanding of what happened and that it was out of our control We have been building homes for years, and have never had a Revdex.com complaintWe have also built over homes in this area, and have had similar situations due to the size of the lots, and in all of those cases we have addressed the concerns with the surrounding neighbors and have terrific relationships with themThe situation that arose from this, is not uncommon when building homes on these 40' lots, and our past reputation has proven that we take care of the surrounding homeowners in ALL of these situationsPlease let us know if you have any questions Thank you, [redacted]

Dear [redacted] was at the store on Sunday 04-20-to exchange golf bagI apologize for the message delay, fore I was off on 4-and 4-After receiving message on 4-23, I called [redacted] and explained to him the golf bag can be exchanged [redacted] said he would be at the store within a few days to exchange the product [redacted] exchanged the golf bag by weeks end.Don PStore Manageer

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that the response would not resolve my complaint For your reference, details of the offer I reviewed appear below Mr [redacted] emailed Friday, May 15th and "sounded" very upset, he seems to be going back on what was said previously about our A/C unit (something to the effect of "an inch or two is between us builders, don't worry about it") and is now asking that the unit and concrete pad be moved off of his property Our builder will be contacted concerning this issue as it would be his responsibility to relocate the unit and pad There is an issue already with the pad where it is because as Mr***'s crew built up the clay/dirt/rocks, the area was made uneven and would cause drainage issues around the A/C unit Water pools in front of it where as before it was draining away, and according to several landscape technicians and the A/C company, this could potentially cause issues with the air conditioner should water continue to pool in that area.The front irrigation has been fixed and we are waiting on two estimates from our landscaper in order to begin repairing the yard Drainage issues are going to have to be addressed because again, the way Mr***'s crew loaded clay/dirt/rocks onto our property has caused it to be uneven We cannot mulch or sod until we receive these estimates and decide how to move forward Mr [redacted] said he had a survey of the properties done; however, the survey has not been shared with us Since this concerns our property, and especially the A/C unit now in question, we feel an independent survey should have been done We have no idea who/what company completed the survey, nor have we seen the survey We feel there is an area of trim that was damaged by Mr***'s crew, the area is located around the guttering they first damaged when digging next to our property We feel the trim piece was dented when the guttering was re-attached It is inconsistent with the rest of the trim around the house The gashes and dents in the siding we feel are also Mr***'s responsibility He at first said he was going to fix it; however, in this Revdex.com response, [redacted] seems to be saying they are now not responsible ?? We suppose they feel as if we cannot prove his crew did it; however, Mr [redacted] cannot prove that his crew didn't do it In fact, Drew with the foundation crew was out inspecting the damage on the evening of May 6th and admitted his crew did it and apologized to Stacy's mother, who was home at the time discussing what happened Drew also apologized for the muddy hand prints and dirt in all of the cracks along the bottom of the trim We would like these issues fixed, as well as the siding and windows along the southside of the house to be professionally cleaned...when a crew was out shooting sand into our damaged yard area, sand was sprayed into our windows and window sills, into crevices of the trim, onto the siding, and into our A/C unit.Regards, [redacted]

For your reference, details of the offer I reviewed appear below.We did not receive the initial response to our complaint, but were able to view it just now and what Mr*** wrote was absurdOur sprinkler system is not on his property nor was this ever discussedHe told us that it would be repaired and it has yet to be repaired. Actually nothing has been repaired...our driveway is cracked, our yard is still messed up, and our irrigation system is non-functionalAfter inspecting the southside of our house, ***'s workers have also done MORE damageWe have pictures as evidence...dents in our siding, dents in our trim, dirt everywhere, a huge gash, paint scrapes, muddy handprints, you name itTo note, NO ONE contacted us regarding digging near our property until the damage they did was already doneTo say that the dirt fell into their hole is a joke...when we got home, there was no dirt "washed" into the hole, it was GONE because they had MOVED it*** and or his foreman even admitted "you got me there". We want to hire our own landscaping company and be reimbursed our expensesMr***'s workers have no idea what they are doing and did more damage to our house trying to "fix" the issues yesterday, including hitting our house several times with their equipmentThere are gashes in our siding and paint missing, dirt everywhere (in cracks of house, windows and window sills), and trim work dentedWe also want the damage to our house repaired, preferably by our own builder and to have him reimbursedThis is ridiculousWe also do not want any of ***'s employees on our land again, any work that needs to be done needs to be completed from THEIR side only

After our conversation on Monday with Mr. [redacted], we had a mutual agreement as to how this was going to be addressed. He was very pleasant to talk with, and was in agreement with the plan and very understanding of what happened and that it was out of our control.
We have been building homes for 22 years, and have never had a Revdex.com complaint. We have also built over 50 homes in this area, and have had similar situations due to the size of the lots, and in all of those cases we have addressed the concerns with the surrounding neighbors and have terrific relationships with them. The situation that arose from this, is not uncommon when building homes on these 40' lots, and our past reputation has proven that we take care of the surrounding homeowners in ALL of these situations.
