Following is our response to complaint below: Myers Concrete disagrees with the information in the complaint filed by [redacted] Myers Concrete also disagrees with allegations regarding customers courses of business including this complaint filed with inaccurate and misleading information Unfortunately we have had to hire counsel in order to try to complete the work contracted for by and between the parties At this time it is not in the best interest of either party to get into details of this project through this forum except to say that Mr [redacted] ’s compliant includes invoking basically a revolving door of opinions that he keeps seeking to justify his actions After Mr [redacted] was contacted by our lawyer that he needed to abide by the contract he then filed this compliant which we believe is merely to continue bullying our company to meet one new claim after another [redacted] Myers Concrete Construction, LP [redacted] Wimberley, TX 78676- [redacted] Fax www.myersconcrete.com

Complaint: [redacted] I am rejecting this response because: The General Contractor....Myers Concrete Construction, LP, of Wimberley-Texas, still has not agreed to Return-to-Work on my Commercial Driveway Entry Project, and First Remove the incorrectly installed Box Culvert Sections,? and then Re-Install the Box Culvert Sections with the TX-DOT required Trench Bedding Material, and in the TX-DOT required Sequence, by Re-Installing the Box Culvert Sections starting from the Outlet End, back Up the Trench Grade to the Inlet End, as identified by TX-DOT in that agency's letter, dated 11-November-2015.The 11-November-2015, letter from TX-DOT, is attached here for the public to see.Myers Concrete Construction, LP, signed a contract with me on 15-May-2015, and agreed to "meet TX-DOT requirements" for this driveway entry construction project.My contract with Myers Concrete Construction, LP, is attached here, again for the public to see.Myers Concrete Construction, LP, of Wimberley-Texas, did send a crew to the project site, and this crew carried-off 3-bags of Personal Trash, that had been left at the project site by a previous Myers Concrete Construction, LP, work crew.I appreciated that, and I thanked the Myers Concrete Construction, LP, workers for their help removing the trash.The Actual Text from the TX-DOT San Anotnio Headquarters' 11-November-letter is as follows:Texas Department of TransportationNW LOOP 4IOSAN ANTONIOTEXAS 782291(210) 615-I I IO ? ? ? ? ? ? ? ? ? ? ? ? ? ?
