Our notes on this loan indicate a ten (10) day demand letter was sent to the borrower at? the address listed on your complaintThat letter was sent on September 241h with a demand? date of October 4th On October 6th a phone call was made to the borrower, however, his? voice mailbox was full and we were unable to leave a messageOn October 7th a second? phone call was attempted and again we were unable to leave a messageThe repossession order? was not sent out until October 14th after these attempts were madeWhile the retail? agreement states that we do not have to contact the borrower before repossession, we at? Generations Bank attempt to make the best effort to afford our customers every opportunity to? make the loan current and avoid repossession.Our policy after repossession is that the customer must bring the loan completely current? to include all payments, late fees and repossession fees due at the time of recoveryIn this case? we allowed the borrower to recover his vehicle on October 23'd without making the? October 16th payment, that was due and the late feesThis was our attempt to help the? customer keep his vehicleAs for the repossession fee of $350.00, that is the fee the tow truckcompany charges for the repossession and it is not a fee the bank keepsIt is payment for? services and per the retail agreement, the responsibility of the borrower.Sincerely,Charles M [redacted] AVP· Loss Mitigation
