The complainant did sign a contract on 7/8/the contract is attached to this email? The membership is month to month and clearly states on the membership agreement "authorized signer agrees to give minimum of days written notice of cancellation by the 25th day of each month to make cancellation effective and to stop electronic funds transfer of owed fees for the next month." ? This written notice was not received until the month of November via email? The contract was promptly cancelled and billing ceased? The complainant requested a refund from the time the business changed ownership on 8/01/claiming he did not sign a new contract? A new contract is not required under state, federal or any other statute the contracts were purchased in a legal sale of the business on 8/01/? The complainant was on a month to month contract that he could cancel at anytime with written notice and chose to not cancel for billing cycles? Per terms of the contract we asked the complainant to provide written documentation of the cancellation prior to the date he was requesting the refund? The complainant never provided this evidence and simply stated he did not sign a contact with new ownership which is not a valid reason for termination of the contract? This is the exact reason written notice is required for cancellation so there may be a clear record of what transpired so in the case of an error the situation may be rectified? I also think it is worth noting that the complaint did not answer the questions "did you sign a contract" when delivering this complaint because he most certainly did and he was provided a copy of the agreement in the days preceding the complaint filling? Our business held up every bit of the contract the complainant signed? We are not responsible for any wrong doing or collecting any funds we were not entitled to under contract?
