Initial Business Response /* (1000, 9, 2015/06/05) */
Hello,
You never registered the domain name through DynadotYou registered your domain name through ***, as I am sure your credit card statement can confirmYou also confirmed both of these facts with our agents when you spoke to
them on the phone
Further, we do not have any $sales for .COM domainsOur last sale for .COM domains was in March of this yearIt was for $.COM domainsPrior to that, we had an $sale in December Neither of these sales included free privacy
All of these facts can be confirmed on our Facebook account, where all of our sales/coupons are announced
http://www.facebook.com/***
There is no record of you in our system until April at 1:03AM PT when you created an account with usThis includes a check of your IP address, various email addresses, name, or credit card
Our customer purchased the domain on April Two days before you created an account with us and days before we had any conversations with you
For whatever reason, your registration with *** did not proceed and was canceledIt is within the right of any Registrar to cancel a registrationIf that happens, you no longer have any rights to the domain name and the domain is immediately released back to the public
That procedure is described here:
http://en.wikipedia.org/wiki/Domain_tasting
When we spoke to you on May 1, the agent told you that if we had done that, we would have told youWe've done it before and will do it again in the future and it isn't really a secret, as you can see here (and various other places on our forums)
https://www.***.com/community/forums/f0-customer-feedback/2-days-phone-verificat... /> However, you never registered this domain name through usYou mentioned that your email address with *** was not accurate, which is one of the reasons why a domain name can and should be canceled, as shown on ICANN's website:
https://www.icann.org/resources/pages/approved-with-specs-XXXX-XX-
"A Registered Name Holder's willful provision of inaccurate or unreliable information, its willful failure to update information provided to Registrar within seven (7) days of any change, or its failure to respond for over fifteen (15) days to inquiries by Registrar concerning the accuracy of contact details associated with the Registered Name Holder's registration shall constitute a material breach of the Registered Name Holder-registrar contract and be a basis for suspension and/or cancellation of the Registered Name registration."
When the domain was available, our customer registered itAgain, a domain that is on the open market is available for anyone to register
Our customer bought itYou have no rights to the domain name
We started deactivating your accounts on May 8, for various reasonsIncluding you attempting to use a "backdoor" to try to buy the domain and wasting our agents timeUltimately, we aren't interested in doing any business with you
You have no evidence that you registered the domain with us on April because no such evidence exists
Our customer contacted us regarding the emails you sent to him, and it seems he is not interested in selling the domain
Regards,
Dynadot
Initial Consumer Rebuttal /* (3000, 11, 2015/06/08) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Hello,
This is my response to Dynadot's first response to my complaint with the Revdex.com
Dynadot is clearly trying to confuse the matter by involving ***Dynadot L.L.Cknows full well that they are the original and only registrar that ever existed pertaining to my creation of my domain name
Just to gather more evidence, today, I contacted *** again, and they stated that there has never been an attempt to purchase the domain name in question through their companyThey stated that if there was, a record would have been generated reflecting that attempt, regardless of whether or not the domain name purchase went through or notThey also emailed me verification that the domain name never even entered into their systemIn this email *** states this fact, that the only registration that was ever created in relation to my domain name was through Dynadot L.L.Cno attempt nor a record of registration through *** ever existed
Again, *** is not involved in this matter anymore because Dynadot L.L.Chas been the only registrar ever involved since I conceived the Domain name in questionThey are attempting to exploit my laps in which registrar I initiated the purchase
I registered it through Dynadot L.L.Con April 28thI did discover an online sale for .com's through Dynadot, whether the link was valid with the sale price of $or a fishing expedition in an attempt to lure people to their website, well it workedIt may have been an expired link that I came across, which may have contributed to the hold up of processing my order and lead to the hold of not being able to receive an email confirmationBelow is the email I received from *** relating to my phone inquiry:
Dear Customer,
Thank you for contacting us
Please be informed that we tried to check here our system if the domain name smoothiefy.com is connected with us, we don't have any connection on this domain , our tools here does have any logs on the domain name, so the domain was not registered here on the first place
If you wish to speak to a representative about your concern, please reply to this email and indicate the phone number, the time and date you would prefer for us to contact you, and the name of the person we need to look for if you would prefer to have us speak to one of your representatives insteadYou can also give us a call anytime at XXXX XXX XXXX

During the time of my registration all of my contact information that I provided was and still is accurateThe only problem I thought I had was in receiving my emails, but the email address was and is correct, and any problem I thought I had resolved itselfOnce I realized that there was a problem with not being able to receive my conformation email from Dynadot L.L.C., I immediately contacted Dynadot on April 30th, two days after I registered my domain nameThere has never been a "willful failure" to "update information provided to Registrar" "within seven (7) days of any change", "nor" a "failure to respond for over fifteen (15) days to inquiries by Registrar concerning the accuracy of contact details associated with the Registered Name Holder's registration", especially considering I contacted Dynadot on the 30th, immediately after realizing what had happened and well within any day or day time frameAlso, the customer that you are referring to that "bought it", is me
This is another attempt by Dynadot L.L.Cto cloud the truth is to imply that I offered to purchase my domain name backI never offered to purchase a domain name that I ownI was told by an employee of Dynadot L.L.C., that I should send an email to ***@***.com and offer to buy itBut instead I sent emails explicitly explaining that I am the original owner, that I don't know how you were able to obtain my domain name, and if we could negotiate an arrangement to have my domain name returned to meI also requested a responseIt is ridiculous to suggest that I would solicit to purchase my own domain name that I just created and that I am the rightful owner ofI have the emails that I sent as evidence
During my many correspondences with Dynadot L.L.C., they have been illusive with providing names or even signing their name to email correspondences, even after I specifically requested it through phone conversations and by emailMy guess is to avoid or minimize personal liability considering the employees are working for a limited liability companyThis is why it is difficult to provide actual employee names
As far as Dynadot's accusation that I attempted to use a "backdoor" to try to buy my domain name, this is ridiculousI purchased the domain name and I have a credit card charge to prove itAlthough, they claim it was a glitch in their systemThey know full well that I am the owner of my domain name that I created on the 28th of April, no one else but meIt is my domain name and Dynadot is blatantly attempting to cause confusionThis is an illegal misappropriation of my property
I have discovered that I am not the first person to be victimized by Dynadot L.L.Cunder similar circumstances regarding domain name misappropriation, but with the Revdex.com's help maybe I can be the lastWe can achieve this by keeping accurate publicized records of past and ongoing complaints especially those related to potential criminal activity that may be inflicted on consumers like myself
To Dynadot representatives and owner *** ***, for the second time and now on public record, I respectfully demand that you return what is rightfully mine, my business domain name that I conceived with my own creative imaginationThis domain name does not belong to you or to anyone else you may have sold it to after mePlease do the ethical and moral thing by allowing me access to my propertyAs you stated in your most recent response, "we aren't interested in doing any business with you", well the feeling is mutual and I have no problem transferring my domain name to a different registrar
Sincerely,
*** ***

Final Business Response /* (4000, 35, 2015/07/06) */
He doesn't have any proof about charges on 4/because no such evidence existsThe first charge was over a week later, when he tried to do the "backdoor orders" we mentioned in our original responseA charge we then refunded
He was never a customer on 4/28, we have never had any sales for $and he doesn't have screenshots for that either(*** does things like that, we don't)The only reason he came to us is because our customer bought the domain on the open marketThe customer does not want to sell the domain, so there is no middle ground to meet at
If it was just a matter of a $domain name that he claims we stole, we'd just give him the domain so he could move on with his life and us with oursBut we cannot give him what doesn't belong to us
Regards,
Dynadot
Additional email
email
He attempted to buy the domain times through the "backdoor" method I mentioned in the first email
The dates were 5/(we refunded on the same date)
5/again, he was never charged because we blocked his credit card 5/7, he was never charged
Nothing in April from him
Final Consumer Response /* (4200, 38, 2015/07/07) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Hello,
First off, Dynadot L.L.Cstill has not addressed their original claim that I purchased my domain name through ***Dynadot representative, can you please prove that I originally purchased the domain name through "***" like you so adamantly claimed
Secondly, what backdoor method are you "Dynadot L.L.C." referring to? Please explain that "in detail"Because that in itself is simply ridiculous and an extremely damaging accusation
I do have proof that you charged my card, I already supplied that proof to you, this proves that I purchased my domain name through Dynadot L.L.CIt is up to Dynadot when to submit the charge, so the date does not have to fall on the same day of the 28th of April
I am not the only former customer that has experienced this type of domain name intellectual property theft by Dynadot L.L.CI created a website called DynadoNt.com / ***.com, listing over or more similar incidences by other consumers that have had their domain names misappropriated/STOLEN by Dynadot L.L.C., and as the days and weeks go by I am discovering more and more victims, spreading the word by bringing attention to this type of corruption/crime
Finally, the reason I mentioned the $sale price was to explain how I discovered your site to begin withI never said that I purchased the domain name at that priceI explained this to you before and once again I ask that you stop trying to confuse the issue with the pricing, but you keep bring it up in an attempt to do just that, cause confusionWell it's not going to workAnd once again you state and I quote "we have never had any sales for $and he doesn't have screenshots for that either." Well that's just not true, because I do have a screen shot that the sale existed, which was the catalyst that enticed and drove me to discover your websiteLike I mentioned before that this is form of "bait and switch" conducted by Dynadot L.L.C., luring unsuspecting prospective customers to their site and record their domain name searchesIf prospective customers ended up not being satisfied with the higher price, you have already obtained their business domain name for unscrupulous/misappropriation purposes, for the registrar's profitThere is a term that relates to this type of corrupt action in this domain name industry, it's called (DNFR) Domain Name *** and or (DNIPT) Domain Name Intellectual Property Theft
When a registrar registers a domain name that you have searched on and believes you are interested in, you are no longer able to purchase the desired domain name for, say, $Instead you either must spend whatever price the registrar sets, which likely ranges from $to $500, or go back to the drawing board to find a new domain name for your business
Further, Domain Name *** (DNFR) drives individuals to register domain names as soon as they first query their availability, before a final name decision has been made, just to allow them to maintain the option of using those namesAs a result, an individual can end up registering extra names and spending more money than they should have to
Possible motives for Domain Name *** (DNFR) speak to the unscrupulous nature of the practiceExcerpted from Nominet's position paper "Domain Name ***: Nominet Experience," possible motives include:
To extort money from the person who originally intended to register the name by making them pay to get it
To steal the business idea of the person who originally intended to register the name
To block or disrupt the business or project of the person who originally intended to register the name
To utilize the traffic that the name generates
How Domain Name *** ***Some domain name registrars try to secretly maintain their own portfolio of domain names that they monetize with websites, parking or resaleRegistrars owning domain name portfolios puts registrars in a conflict of interest with their customers who want to potentially purchase the same domain namesAnd it's this practice that can lead to (DNFR) then when registrars are looking for desirable names to add to their portfolios, (they have)the "domain name query data" (your domain name searches) at their disposal
This is a serious problem in this industry, and Dynadot is simply trying to dismiss these known facts, by stating
"If it was just a matter of a $domain name that he claims we stole, we'd just give him the domain so he could move on with his life and us with ours."
There have been many studies on the practice of (DNFR) Domain Name ***/Domain Name intellectual property theft, and the overall "Domain Registration Abuses"There have been several papers written about this form of corruption, and this is exactly what is going on
So once again, Dynadot L.L.C.'s attempts to distort the truth are as clear as day
So I ask you again Dynadot L.L.C"*** ***", please provide me with proof that I originally purchased my domain name from "***", as you and your staff was so persistent in your efforts to convince me and the Revdex.com of this, in order to cause confusion
Also, please explain the backdoor method that you have accused me of using to purchase my domain nameThat is a ridiculous accusationPlease acknowledge the well-known fact that credit card charges do not always reflect on the day of purchase, as it was originally explained to me by your representatives and my credit card companyAlso due to another fact that your business "Dynadot L.L.C." has full control of when to submit the charge, and even after that the charge can take over a week to reflect on a credit card statement
Sincerely,
*** ***
P.SAlong with answering the posed questions that I asked, I also "demand" that you return my domain name immediately and stop with these time consuming and damaging antics

To the Revdex.com:
The above person is not a Dynadot customer
Hello,
As you have not stated which domain names you are referencing, it is not possible for me to investigate your claim
As it is, we do not sell contact
information
We do not tolerate spam originating from our servers, but again, as it is unclear what domain names you are referring to, I cannot investigate further
We do not control email lists of domain names registered with us

Initial Consumer Rebuttal /* (3000, 7, 2015/01/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I have contacted Dynadot and both forwarded the fishing email as well as by listing the domain names on their web-based complaint formI am able to trace the source of the emails to Dynadot using ICANN WHOIS listing
Although I have deleted the majority of the emails since I now forward them to the FBI and FCC abuse report addressesRecent domains include spurcent.net, furthebe.net, imettved.net, and eyrayers.netI have checked to see if all of these are from DynadotBut the first one is
I received an email from Dynadot today regarding another domain that I incorrectly attributed to them, jcpenneyem.com This is an interesting case since some Whois searches did show Dynadot as the domain registerBut this is no longer the caseI apologize for any problems this may have caused Dynadot and I have been forwarding these emails to FBI and FCC reporting addresses nd I hope this issue is resolved
Final Business Response /* (4000, 9, 2015/02/06) */
Hello,
Thanks for the informationI have found the complaintsThe domains were suspended
Regards,
Dynadot
Final Consumer Response /* (4200, 11, 2015/02/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Dynadot has contacted me by email about thisI believe that they are working on the problemI am still receiving the fraud emails but the frequency has been reducedI received two or three this weekendI have been forwarding the bogus emails to help Dynadot address the problemI do not want to cause Dynadot problemsBut allowing fraud emails that could result in personal damage is criminal and Dynadot allows thisTo be clear, I do not believe Dynadot is directly responsible for sending the bogus emailsBut their service set up allows thisThe emails often come from domains registered the same day that the emails are sentThey often list "Super Privacy Service c/o Dynadot" as the domain administratorThus Dynadot is responsibleI do not remember received a bogus email twice from the same domainSuspending domains after the emails are sent does not solve the problem

I DO NOT recommend Dynadot L.L.Cat allIn my opinion and from my personal experience, they seem to be practicing Domain Name Front Running, also misappropriation of domain namesSimply put, and in my opinion, they STOLE my domain name and now I am faced with having to take them to court to prove this
So, my advice when registering your domain name is to make sure to do your research before conducting business with any company, especially Dynadot L.L.C
Also, because this happened to me, if felt compelled to create a website gathering other consumer complaints that indicate the same unethical practice of domain theft, which includes domain name front runningPlease visit:
***
to view all the other consumer horror stories when dealing with dynadotI hope all consumers will check with the Revdex.com prior to conducting business with any company out thereConduct your own independent research so you DON'T end up going through what I am going though

Hello,
We have not refused to assist you. You are trying to unlock the domain and have failed 2 of our 3 methods to verify account holders.
The first is the birthday you set when you create the account. You were unable to...

remember which birthday you entered.
The second method is the secret question/answer combination that you set up when you create your account. You also were unable to remember the answer to your question.
When a customer is not able to correctly answer either of those questions, an ID is required, to make sure that you are the true account holder and not a hacker trying to steal domains from our system. You are unwilling to send in a copy of your ID.
https://www.dynadot.com/community/help/question/account-verification
As soon as you send in a copy of you Photo ID, we will be able to verify your identity so you can manage your domain.
