Dear Revdex.com,

Dynegy has completed its investigation into Case ID: XXXXXXXX and has documented its findings and actions taken with respect to this complaint. Dynegy appreciates you bringing this to our attention.

The Whitewater Township has an opt-out electric municipal aggregation program and selected Dynegy as the electric supplier for the period through November 2022. The Whitewater Township provided the customer's account number to Dynegy as an eligible resident to be included in the Whitewater Township opt-out electric municipal aggregation program in 2019. Ohio law allows municipal aggregation, and the customer can learn more about it at https://www.puco.ohio.gov/be-informed/consumer-topics/governmental-energy-aggregation-local-community-buying-power/.

On 9/27/2019, Ms. was mailed the attached opt out letter making her aware of the selection of Dynegy, the price of electricity, and other informational material. She was made aware that the opt-out must be received by Dynegy no later than October 18, 2019 and provided with the notice to mail back and a telephone number to call. Additionally, a copy of the terms of service agreement was mailed with the opt-out letter.

Ms. did not notify Dynegy prior to October 18, 2019 that she wanted to opt-out which appropriately prompted an enrollment order to be submitted to her Utility, Duke Energy, on 10/18/2019 with an effective date of 11/5/2019.

Ms. was billed appropriately as she did not opt out of the aggregation program and therefore no adjustments or refunds are warranted on this account. However, her utility, Duke Energy, has processed a drop from Dynegy's supply which was effective on 4/6/2020.

Please let us know if you have any additional questions.

I have been billed by Dynegy for services I never agreed to. I would like proof that I requested these services. 400.00 is the minimum amount.
I have been charged by Dynegy for services I did not request nor did I approve. This has caused my Duke Energy bill to double. I tried to resolve this issue but I was told that I didn't opt out. Opt out of what? I never received anything from this company and they can't provide proof that they sent anything to me. I want my money back for all of the payments made to this bogus company. These people are scamming people with that whole you did't opt out nonsense. This is ridiculous.

Desired Outcome

I would like to get all of my money back that I have paid to Dynegy.

FRAUD AND SNEAKY COMPANY
I never signed up for this company to take over my gas supply. I have been calling for the past hour I gets put on hold and then the phone hangs up. These people attached their self to my Duke Energy bill, without my consent. I called them in December to have them removed theirselves from my bill. That did not happen and they are on my bill again. Now no one wants to answer the phone and I keep getting hung up on.

Desired Outcome

Remove themselves from my bill and waive their fees.

On 11/18/19, *** contacted Dynegy and requested to drop her account from Dynegy's supply and return to Duke Energy. The drop transaction was submitted on 11/18/19 with a change effective date of 12/9/19. During this period, Ms. has been billed correctly for supply charges per the municipal aggregation agreement with the City of Cincinnati and no adjustments are warranted.

A soliciting electric company took our electric bill account number to add their services to without our permission for 20 months.
A door to door soliciting electric company enrolled us in their program without our permission. I have tried to cancel our enrollment but they continue to charge us each month. When I call to discuss the issue of our cancellation, they state that it will take an additional 1 - 2 months. I also registered our house and names on the No Soliciting list for Ohio. So we never should have been an option to be enrolled with their services. These charges are substantial and they continue to charge. We need reimbursed for the past charges since we never approved or authorized the enrollment as well as the charges that continue to be on our bill AFTER we canceled.

Desired Outcome

I have added the accrued charges starting in March 2018 through the current date, October 25, 2019. These monthly charges total $935.64 which is the amount we would like reimbursed for. In the least, we need reimbursed from the time we initially canceled this service (that we never approved of enrollment). Those charges equal $63.32 and currently climbing.

Dear Revdex.com,
Dynegy has reviewed complaint number XXXXXXXX from Ms. ***. Following are our findings:

*** is a resident of the City of Cincinnati at the address of 5312 Ravenna Street in Cincinnati. The City of Cincinnati has an opt-out electric municipal aggregation program which started in 2011. They selected Dynegy in 2017 as the electric supplier starting the initial enrollment with the May 2017 meter reading date for the period of 05/01/2017 to 05/31/20. The City of Cincinnati provided the customer account number to Dynegy as an eligible resident to be included in the City of Cincinnati's opt-out electric municipal aggregation program in 2017. Ohio law allows municipal aggregation, and the customer can learn more about it at https://www.puco.ohio.gov/be-informed/consumer-topics/governmental-energy-aggregation-local-community-buying-power/.

On 11/27/17, Ms. was mailed an opt out letter making her aware of the selection of Dynegy, the price of electricity, and other informational material. She was made aware that the opt-out must be received no later than 12/19/17 and provided with the notice to mail back and a telephone number to call. Additionally, a copy of the terms of service agreement was mailed with the opt-out letter.

Ms. did not contact Dynegy to opt out of the municipal aggregation program prior to the opt out date. An enrollment was issued on 12/20/17 and Ms. service started with Dynegy on 01/19/18.

Ms. first contacted Dynegy on 10/14/19 regarding her account and inquired how she came to be enrolled with Dynegy. The municipal aggregation program was explained to her and, at her request, a drop order was submitted to send her back to her utility company, Duke Energy. She was made aware that Duke Energy would provide the date the drop would take place and it could be 1-2 billing cycles before it was complete. The drop was issued on 10/14/19 and Duke Energy has reported the drop will take place on the next meter reading date, 11/17/19.

Regarding Ms. statement that a door to door soliciting company enrolled her services, this is not a factual statement. Dynegy does not offer door to door sales in the state of Ohio.

As Dynegy has honored Ms. request to close her Dynegy account effective on the first available date, no changes to her billing will be made.

Customer Response • Oct 31, 2019

(The consumer indicated he/she DID NOT accept the response from the business.)
How were we automatically enrolled into Dynegy? I understand the opt out letter. But I do not understand how we came enrolled in the first place.

Dynegy Energy Services Response • Nov 06, 2019

The city of Cincinnati currently has a municipal aggregation program and it's current contract is with Dynegy Energy. If a customer does not opt out of the aggregation program, they are enrolled with the company the city has a contract with.

Thank you,
Dynegy Energy

I opt out of services for this company and they appeared and charged me on my bill.
In April 2018 I was sent a letter from Dynegy Inc to opt out of services and I returned this to them. I have spoken with them several times also have spoken with Union Township and Duke energy. The finger keeps getting point as the next company. My account number is XXXX-XXXX-XX-X

Desired Outcome

I want my account to be credit for the charges.

Dynegy Energy Services Response • Aug 30, 2018

Dear Revdex.com Staff,

Dynegy Energy Services (DES) has reviewed complaint case number XXXXXXXX from Mr. ***. Following are our findings:

DES records reveal that Mr. was a participant in the Union Township opt-out electric municipal aggregation program. Union Township selected DES as the electric supplier beginning June 2018. Union Township provided the customer's account number to Dynegy as an eligible resident to be included in the Union Township opt-out electric municipal aggregation program.

On April 9, 2018, the customer was sent an opt-out packet explaining the municipal aggregation program, terms and conditions, an opt out card, and other informational material. Mr. had until May 4, 2018 to opt-out or the account would be included in the electric municipal aggregation program that the Union Township agreed to. A customer can opt-out by returning the opt out card, calling our toll-free number or emailing us at the email address provided in the packet. Mr. asserts that he replied to the opt-out form; however, our records do not reflect receipt of an opt-out form. Consequently, DES submitted a request to have the account switched to our electricity supply effective June 2018 scheduled meter read date. Duke Energy Ohio sent the customer a letter confirming the account was switching to DES electricity supply effective 06/08/18.

DES records indicate Mr. contacted DES on 8/09/18 requesting to have his electric supply dropped to Duke Energy. DES processed a drop request for service address, 1105 B Shayler Rd Apt 3, Batavia, OH XXXXX that will be effective with the next available scheduled meter read date.

However, no adjustments are warranted. The charges are correct. DES is not doubting the Joneses assertion that they mailed the opt-out form in; however, it was not received and consequently the customer was placed on Dynegy electricity supply. The customer was not charged by both Duke and Dynegy for the supply of electric service. Both Union Township and Dynegy are certified by the Public Utilities Commission of Ohio to provide this service.

I've contact them twice and advise I don't want them to be by energy supplier - this is my com ed Account # XXXXXXXXXX.I never sign up for them to be my supplier. .

Desired Outcome

Other (requires explanation) I want confirmation that they are no longer my supplier

Dynegy Energy Services Response • Jun 29, 2018

Dear Revdex.com,

Dynegy Energy Services (DES) has reviewed complaint number XXXXXXXX from ***. Below is a summary of our findings.

Ms. is a resident of the Village of Hampshire, IL. The village of Hampshire has an opt-out electric municipal aggregation program which the village agreed to. The village agrees to the municipal aggregation plan, but residents can opt out if they choose.

On 07/14/17, an opt- out packet was mailed to Ms. explaining the municipal aggregation program, terms and conditions, an opt out card, and other informational material. Ms. had until 08/04/17 to opt out, otherwise the account would be included in the program. Customers can opt out by returning the postage paid post card, calling our toll-free number or emailing us at the email address provided in the packet. As Dynegy did not receive an opt out from Ms., DES submitted a request to ComEd to have the account switched to our supply effective with the September scheduled meter read date.

Per her request, Dynegy dropped Ms. as the supplier of her electricity effective 06/19/18. Her supply of electricity will then revert back to her utility, ComEd, if she does select another Competitive Retail Electric Supplier.

Thank you for bringing this matter to our attention.
