Initial Business Response /* (1000, 10, 2015/06/15) */
We are in the process of working with the client on this transaction on a good resolutionThere have been many outside factors with this transmission that were not anticipated for example: parts on national back order, inferior parts from
vendors, etc

In regards to an AX4N transmission for a Ford Freestar with vin number ***, Dynotec sold an AX4N transmission to Techneeck’s Auto on April 26, When Dynotec dropped off the transmission at Techneeck’s Auto we used our flushing machine to verify the radiator and cooler were in
proper working order at that timeOur technician discussed with Techneeck that the radiator needed to be replaced in order to validate warranty due to not having proper flow for the transmission. On 09/05/at 8:47am Dynotec received a call stating the transmission was not working properlyDynotec discussed with Techneek’s Auto and came to the conclusion that we needed to remove the transmission in order to see what the problem was with the transmission. On 09/19/Dynotec picked up the transmission from Techneek’s Auto and on 09/21/we disassembled the transmission and found that the transmission was contaminated with waterI have attached a couple pictures to show what that looks like.On 09/21/Dynotec discussed with Techneek’s Auto the findings of the contaminants, that we were denying warranty coverage, and shared different options, with a fee, to get the transmission repairedOn 09/29/Techneek’s Auto communicated that the customer was declining repairs Dynotec stands behind our product and follows our written warranty (attached)In this case, Dynotec denied warranty due to the water contaminantsThis is listed under section C, limitations, and sub-letters a (attached)

I am rejecting this response because: I don't feel that per hour is fairI never got a mile out of the transmission and it had to be pulledI am requesting the other $per hour for the hours agreed uponStill wondering who is paying for the second installation? As of the social mediaBusiness has a Facebook page you can leave a reviewI left star Nothing bad or degrading said Also would like to add now Tim the owner won't talk to anyoneAfter he made a deal with Tony and I then backed out of it after he thought the Revdex.com case was closed he has refused to talk to anyone Very unprofessional Please stand behind your product

To clarify what has transacted - We spoke with the owner (Tony) of the automotive shop (*** *** ***) several times (6) about the owners truck and covering the labor to remove and install
the transmission that was purchased through an automotive parts facility in there area and the owner of the shop agreed on a recorded conversation to accept the amount of $for his servicesThe check was sent to him on the 31st of January for the amount of $and our check number is If we can help in any other way please feel free to contact us but we feel the issue is closed except for his comments on FaceBook's social media

Mr. [redacted] purchased a transmission for his 1995 Ford Taurus SHO ON March 23, 2014. He took his car to have this installed at [redacted] in Mound as we only remanufacture transmissions in our facility, we do not do automotive repair.
In March...

of 2015, one year later, Mr. [redacted] felt the transmission shifts were too soft, so he took the vehicle to a repair facility of his choice, [redacted] in Spring Park, MN, to have this looked at. He did not take it back to [redacted] in Mound because he was not happy with their work. At that time Dynotec worked with [redacted] on the diagnosis and determined that we could adjust the transmission to shift more firm. Dynotec and [redacted] worked together with the diagnosis and reinstallation of the transmission. After reinstalling the transmission, [redacted] test drove the vehicle with no complaints, and upon delivery of Mr. [redacted]'s 1995 Taurus SHO, [redacted] had Mr. [redacted] drive as they rode along and he expressed no complaints.
Our next contact with Mr. [redacted] was in June 2015. He now stated that the transmission was shifting to hard so, Mr [redacted] brought his car to Dynotec and at that time we had our ASE Certified Master Technician go on a test drive with Mr. [redacted] to verify the complaint. On the road test the master technician determined that the transmission was functioning properly, but noted the 1995 Ford Taurus SHO had a check engine light present and the OBD (On Board Diagnostic) connector was not functioning. This transmission is controlled directly by the PCM (Power train Control Module) in regards to shift timing and transmission control pressures. With the OBD not functioning we were unable to access codes or data from the vehicle computer control systems to determine the causes of the check engine light and if damage to the transmission is being done due to the failure causing the check engine light to be on.
Mr. [redacted] is aware of these problems because he noted to the technician he had been trying to resolve emissions and engine performance issues and he also was unable to access codes and data thru the OBD connector.
In Lehman's terms; the transmission at that time of the road test was working properly. The check engine light being on tells us there are additional problems within the vehicle that can cause multiple types of failures other than transmission concerns. If the OBD is not repaired this could ultimately cause the transmission to fail in which case this could invalidate his warranty. It is Mr. [redacted]'s responsibility to correct the OBD connection before any additional diagnostics can be completed.
Dynotec has tested, driven, and diagnosed the transmission and has come to the conclusion that the transmission at the time of the road test was functioning properly. Dynotec does not have any evidence that the transmission is not working and does not believe this is a transmission related concern. Dynotec does not believe our transmission is responsible for his current vehicle problems or that a refund is warranted. Dynotec will continue to stand behind our written warranty.

On September 30, 2015, Mr. [redacted] called Dynotec and asked for Tim, the owner of Dynotec Industries, but he was out of town, so Ken [redacted] a Dynotec representative, talked to Mr. [redacted] about his 1995 Ford Taurus SHO.
Mr. [redacted] states that the transmission does not shift properly, but has not had this diagnosed at any professional repair facility. He is refusing to complete the OBD (On Board Diagnostics) connector repairs necessary for his issues to be properly diagnosed due to him not having the funds to complete this repair and in his words; he will not invest anymore money to resolve any of his vehicle issues. Mr. [redacted] is still using this car as his daily transportation, because this is his only means of transportation. Continuing to drive the car without doing the proper repairs could be damaging the transmission along with other components of the vehicle.
We did offer once the OBD connector is repaired to again road test the vehicle with a scan tool to help determine the cause of his concern, and to that he responded, "I will see you in court."

On October 1, 2015 Mr. [redacted] called Dynotec at 4:30 and asked for Tim, at that time Tim was on the phone. He then started, without introducing himself, verbally attacking Dave (Dynotec employee) with profanity and threats.
He said that Dave was lying about Tim being on the phone, that we are, "a bunch of mn dumb f$, we are f$ liars, we do not know how to f$ fix transmissions", and more. Then when Dave asked who he was talking to Mr. [redacted] proceeded to say, "don't play stupid with me you dumb f$", so Dave said calmly again, "at least tell me who this is so I can pass along the message", Mr. [redacted] told Dave who he was and then proceeded to say to him, "I will come down there right now and kick your [redacted] you mother f$, I will have your job and your company." Dave put him on hold, so that he could talk to Tim once he was available, and after two minutes picked up and told him that Tim was still on the phone, Mr. [redacted] once again started with his verbal assults and was placed on hold and he eventually hung up the phone. After this Mr. [redacted] proceeded to call back a couple of times, but Dave hung the phone up on him as Tim was still on the phone and he was continuing to act in the same manner with verbal threats and profanity.

Tim called back Mr. [redacted] on October 1, 2015, and tried to have a conversation with him. Tim explained once again that we would stand behind our written warranty in which Mr. [redacted] was provided and he told Tim he did not want us to touch his car and wanted his money back. He said that we do not know what we are doing, has hundreds of witnesses that the transmission does not work, but as far as we know he has not had it to a professional repair facility to be diagnosed.
Tim did tell Mr. [redacted] that if he continues to threaten the employees the authorities would be called, and his response was that he had already called the cops.
Mr. [redacted] asked Tim if he was going to make this easy or hard, and Tim responded with, "Dynotec will stand behind the transmission's warranty, but will not refund him the money for his transmission," and he responded, "you are an a$$hole and I will see you in court."

At this time Dynotec will continue to stand behind our warranty for the three years, 100,000 miles. Dynotec also feels that we have went above and beyond by offering that once he gets his OBD connection fixed, we would hook up the scan tool for no charge to get readings from it so he can learn what the car is commanding and if there are any additional concerns to address with the vehicle.

Dynotec feels that they have offered different types of resolutions, and Mr. [redacted] is reluctant to use any of those options. It appears to Dynotec, based on his conversations that the only solution to Mr. [redacted] is for him to get his money back, or go to court.

I left messages with the store owner and the vehicle owner waiting for call backs to get this resolved
