a while before we could get there. A few weeks went by and [redacted] called and asked for an additional estimate for an egress window to be added to his basement. We then revised the original estimate to include this additional work and gave him an estimate to encompass both projects.
We went ahead and completed both projects and all was fine. The plumber/hvac portion of the project had one small cap to order to place on the end of a boiler baseboard heater. The cap was approximately 3" x 5" and was purely cosmetic. The rest of the project was completed and the owners indicated to us that they were happy. The end cap was ordered and took much longer than expected to receive, but this entire time, the owners were using the bathroom and the city had passed the project for the final inspection.
The alleged problems with materials and workmanship did not arise until we sent out our final bill for the project. It was at this time that we were sent a list of items that [redacted] had issues with. He even sent us video of the drapes moving from the wind through what he says is our inferior window we installed.
We went over there that night to inspect the problems to find out that the drapes were moving because they were not latching the window properly. It is a normal operating double hung window that had been misused so often that the latch had deep groove marks in it. At this time, we felt it was easier and better for our business if we completed the list of items he had for us, including replacing the window that they ruined. After we completed the list to his specifications, the agreement was we would receive our final payment. When we left, after completing the list of concerns, [redacted] was not home. His wife said thank-you and looks good. After more time went by and we have still not received our final payment, we contacted them again. We brought up our agreement to take care of the issues he had and we would receive our money. [redacted] responded to that with a brand new list of items that need our attention. Now we are under the assumption that [redacted] does not have the agreed upon money and is not going to pay no matter what we do. He even confirms this in his desired resolution as he is looking to avoid payment, not fix the alleged problems.

I am rejecting this response because:This is my response. Yes Dysthe Construction was the third contractor called but they were the only one to get back to us with an estimate. It wasn't explained to us that he was too busy. Yes the bathroom was completed in a timely matter however the 3' by 5' baseboard end cap took 6+ months to get completed. We do understand that it may have been a cosmetic part however during that 6+ months there was never any contact made to us by Dysthe Construction to update us on what was going on or when the project would be finished. We then decided after waiting several months to contact Dysthe Construction via email as we had other concerns about the bathroom and about when the baseboard heater would be finished. Dysthe Construction contacted us back by stopping at our house that night and they came back and "fixed" what we wanted done. My wife was home when they came back to fix the bathroom and stated that "Camerin needed to look over the bathroom and if everything looked good we would mail them their last payment." However after looking over the bathroom I was unsatisfied. We called Dysthe Construction back and he again came back to the house in a timely manner and looked at what I wasn't pleased with. He stated he would need a few days. After that he didn't come back and fix anything nor have we heard from him since. Also he stated in his previous email that the city passed the project for final inspection that is inaccurate as the city was contacted by my wife on 4-4-16 and the final inspection was never completed. The city inspector came on 4-4-16 per the request of my wife and completed the final inspection. As far as the window goes the original window that was put in was broken. He sent a worker to come back and replace the top half neither my wife or myself were present during that process. Only replacing the broken top half and not replacing the bottom half caused the new top half to not latch properly causing grooves in the window. After replacing the top and bottom half there has been no issues. There was never a new list of items to be fixed. The list we gave Dysthe Construction was the original list that was not completed properly. There was never any contact to us by Dysthe Construction. We have the agreed upon money however we feel that between the unsatisfactory work performed by Dysthe Construction and the amount of time it took to finish the project that we no longer should have to pay them as in order to fix the bathroom correctly we will need to put forth more money either in materials or having someone else come in and fix the bathroom correctly. Examples such as the flooring, leveling off the vanity, fixing the woodwork and take the time to vacuum the insulation out of the ceiling and putting new insulation in. These are all items that were included in our estimate that were either unsatisfactory or not completed at all as well as other items. We also asked for an itemized statement and have yet to receive that statement. We need those items for tax purposes which we stated to Dysthe Construction. This has been our first major remodel and the first project that we have ever hired out and it makes you not want to hire out a project again. We have put thousands of dollars into this project for a unsatisfactory job.
