Initial Business Response / [redacted] (1000, 10, 2016/02/24) */ ***Document Attached [redacted] On or about 1/17/I did charge a car payment to [redacted] 's credit card for the past due amount of $as I do just about every month for her car payment, Please see attached payment history, [redacted] has an obligation to make a car payment every month in the amount of $but [redacted] has never paid her payment in full or on time, I have allowed her to make partial payments throughout her loan term because of her continued loss of jobs, I believe she has had four different jobs since the loan was made to [redacted] Because she is unable to hold down a job for whatever reason she is consistently late when making her car payment or she will only make a partial paymentHowever after multiple partial payments, I had left word with [redacted] to make her payments on time and in full [redacted] instructed me to use her credit card that she put on file with us to make all of her future car payments to insure her car does not get repossessed [redacted] 's car payment was more than days late and rather than repossess her car I figured I would run her card as instructed to get her account currentIf [redacted] would like to bring me cash in the amount of $I would I will gladly refund her credit card [redacted] has options here she can either make a cash payment in the amount that was past due, or I can refund the $and she can surrender the vehicle (voluntary repossession) for not performing to her obligation as the contract states [redacted] is simply upset because I am no longer allowing her to make partial payments and or late car payments, I have run out of patients with [redacted] , She has been put on notice that if she misses one more payment or if she is more than days late she will lose her car due to her failure to adhere to the terms and conditions of the signed and agreed upon loan contract As to address the interest [redacted] is being charged, at the time of the sale [redacted] had a +/- credit score and as any lending institution will tell you, The interest rate is based on the individuals credit, with higher risk loans there is a higher interest rate chargedI offer interest rates from 1.9% for impeccable credit to 28.9% for people who simply do not pay anyone [redacted] should count her blessings that someone was even willing to give her an auto loanShe is a very high risk borrower who is unable to hold any type of stable employmentAs you can see from her payment history I don't believe you will find one on time payment in the amount agreed upon I am waiting on my Jan Bank statement and if the charge of $has been reversed or removed from my account her vehicle will be repossessed for nonpayment and she will be sued for the balance

In response to the above referenced complaint I would like to shed some light on this situation. On 3/10/2017 Taylor Price Purchased a Jeep from us with a valid Mo safety Inspection which allows her to obtain temp tags. The Emissions inspection could not pass until a drive cycle was performed....

Since not all Counties in the State of Missouri require emissions inspection we do not complete emissions inspections, However we will guarantee the car to pass emissions or we will make the repairs for free to get the car to pass emissions. Vehicles perform up to 11 diagnostic checks of specific emission control components such as engine, transmission, fuel systems and other emissions controls. Each diagnostic check communicates with a monitor called a readiness monitor. These diagnostic checks are performed while the vehicle is driven. Certain driving conditions must be met to determine if all components are functioning within allowable standards. If all diagnostic checks have been performed, the computer reports systems as "ready." If diagnostic data has been erased during vehicle repairs or through battery disconnection the computer reports systems as "incomplete" or "not ready." Vehicles are rejected from testing when these diagnostic checks are not completed. This sophisticated system serves as an early indicator of exceeding the vehicle emissions standards, increasing air pollution emissions and of potential engine damage.  The OBD (On Board Diagnostic) system is more like a computer monitoring system. An OBD monitor is a computer test or series of computer tests used to determine if an emission control device or system is failing. The vehicle performs the self-diagnostic computer test when the vehicle is driven. This is commonly referred to as a "drive cycle."  This may need to be repeated 2 to 5 times depending on the make, model and age of the vehicle. Maybe [redacted] did not understand why it took her almost 30 days to get her light off but it finally went off after her drive cycles were completed and her emissions passed and she was allowed to get her license plates through the State of Missouri without penalty. To address her repair complaint this vehicle was driven for about 45 days and her daughter got the car too hot and caused all the problems, this is simply driver error and with her being only 18 yrs of age she probably did not know what warning signs to look for. When they brought the car in for the overheating issue we had determined that she had a blown head gasket. This is something that was caused by driving the car while hot and not shutting the car down to cool. We replaced the head gasket for Taylor at a very deep discounted price. Normal price to replace head gaskets on this vehicle would retail for $2,400.00 parts and labor. We only charged her for the parts and fluid of $700.00 which I may add she did not pay in full. The reason we had the car for 11 days is simple we had to order the part which took 6 days to come in and the weekend accounts for 2 days now we are up to 8 days and I am not sure if she knows the severity of this type of work but it is a 2 day job not to mention sending the heads off to have them checked for cracks. In short this is an upper motor rebuild which takes time. As far as the radiator we never installed one, the person who put the radiator in must have put a smaller one in, but not us. As far as the money [redacted] invested I have no control over her insurance premiums or State Taxes and licensing fees, She can take those fees up with her Insurance Agent and The state of Mo. if she feels she was over charged. [redacted] states that she does not want us to do any repairs on her car because she doesn't trust us but on June 3rd two days after her complaint to the Attorney General she brought the Jeep in for us to replace a spark plug for a rough idle, so for her not to trust us she seems to keep coming in for service. Her ex husband has a completely different tone,  so I am not sure what they are telling each other. All I can say is we did more than anyone else would do. None of these problems were a result of anything we did. They were simply driver error and it took almost 2 months for the problems to show up, that should say something. There was no problem after the day of purchase only after a period of driving the car hard for 2 months did issues pop up. I would also like to add that [redacted] is not my customer, Her daughter [redacted] is my customer.

[redacted]'s car payment was more than 30 days late and rather than repossess her car I figured I would run her card as instructed to get her account current. If [redacted] would like to bring me cash in the amount of $202.92 I would I will gladly refund her credit card.
[redacted] has 2 options here 1. she can either make a cash payment in the amount that was past due, or 2. I can refund the $202.92 and she can surrender the vehicle (voluntary repossession) for not performing to her obligation as the contract states.
[redacted] is simply upset because I am no longer allowing her to make partial payments and or late car payments, I have run out of patients with [redacted], She has been put on notice that if she misses one more payment or if she is more than 10 days late she will lose her car due to her failure to adhere to the terms and conditions of the signed and agreed upon loan contract.

I offer interest rates from 1.9% for impeccable credit to 28.9% for people who simply do not pay anyone. [redacted] should count her blessings that someone was even willing to give her an auto loan. She is a very high risk borrower who is unable to hold any type of stable employment. As you can see from her payment history I don't believe you will find one on time payment in the amount agreed upon.
I am waiting on my Jan 2016 Bank statement and if the charge of $202.92 has been reversed or removed from my account her vehicle will be repossessed for nonpayment and she will be sued for the balance.
