*** ***Case No *** $50,c/s $5,prem $state feePossof Drugs-Franklin County Common Pleas CourtAttachments:Bail Bond ApplicationIndemnitor/Guarantor ChecklistCredit Card Payment AgreementCopy of Power of AttorneyReceipt for $State Fee Paid to Franklin County C.P.Receipt for
$paid by *** *** for Balance Due PaymentMarch 2, *** ***, *** *** daughter, contacted my office to post bond for her mother (*** ***)Ms*** was the indemnitor for the bond on *** ***. Ms*** put $down and bi-weekly payments of $were to be paid until the 10% premium was metPlus the $state fee paid to the court.*** *** bond was posted on March 3, In the amount of $50,c/s.March 6, Ms*** *** comes into my office to sign bond paperShe also makes a $payment towards her balance due which then leaves her new balance $While signing her bond papers Ms*** informs me that she has a bond hearing scheduled for March 7, 2017. I told her that I was unaware of the hearing but to notify me immediately once the hearing was completed in case there were any changes to her bond.March 7, Ms*** called me after her bond hearing to inform me that her bond had been lowered to $15,I explained to her that I would need to obtain my original Power of Attorney back so I could just post the $15,and charge the premium of that bond instead of the $50,I asked Ms*** to have her attorney contact me to see if he would be able to speak with the judge about receiving the original backWhen Mr*** called me I explained to him that the judge would need to sign an entry stating that I could receive my original Power of Attorney back so I could post $15,and only charge the premium for that bond instead of the premium on the $50,000. Mr*** asked me what the entry needed to sayI explained to him that normally they would just write an entry stating that the bonding company will receive the original Power of Attorney back and then I would post the new bond of $15,and Ms*** would receive a refund back of $225. I told Mr*** that if I posted the $15,and did not obtain the original back I would have to charge Ms*** the premium on the $50,and the $15,would then be a bond rewrite. Mr*** stated that he would call me back. About minsMr*** called me back and said that he was being asked to do something that he was not being paid for. I did explain to him that if my attorney filed the motion the fee that he charges would come out of the difference Ms*** would be receiving back.He stated that he was not going to speak to the judge or file a motion on behalf of his client.I tried to contact the judges bailiff to see what could be done about receiving the original back and no one ever returned my call. Ms*** did come into my office we went into my conference room and tried to contact the judges bailiff. I spoke with the secretary and explained the situation she said that she would have the bailiff call me back. I told Ms*** that she was more than welcome to wait in the lobby in case she called back. I went back to my office and about an hour later I went back to the lobby areaMs*** was still there and I told her that no one had called me back yet. She called her attorney to explain to him what was going on I asked Ms*** if I could speak to Mr*** and he told her he did not want to speak to me and for her to not leave my office until I gave her the refund back. I told her I could not refund anything until I received my original POA back. After about minutes Ms*** left. To this day I have not received the original back.In regards to the complaint Mr*** filed:*** *** paid the initial down payment of $not Ms***.Bond refund would have been $not $Mr*** is leaving out the $state fee paid to the court. The goal was to obtain the original power of attorney back and just post the $15,bond. If I would do a rewrite then I would still have to charge Ms*** the premium on the original bond of $50,000. I do not charge for bond rewritesI was referring to the $my attorney charges to file a motion to try and obtain the original POA back.I did explain to Mr*** and Ms*** that I would need to get my original POA back before I could give any refund
