Review: This company has billed me for a product which I nor anyone else in the household has ordered. I have had a problem with this company in the past for the same thing. As a result of this my bank is now charging me $32 in overdraft fees.Desired Settlement: I would like the price of the product ($40.00) plus the overdraft fee ($32.00) reimbursed to my account.

Response:

On June 25th, 2012 Ms. [redacted] called our support hotline to request her

subscription be cancelled however our records indicate that our

customer service agent offered Ms. [redacted] a discount and persuaded her

to put the subscription on hold until December 28th, 2012 and continue

on from there. Today we've refunded Ms. [redacted] $40 for the order from

December 28th and sent her an RMA email with return instructions. We ask

that Ms. [redacted] return any unwanted products back to our warehouse in

good faith. The $40 refund although processed on our side may take from

between 5 to 10 days to register back and be visible in Ms. [redacted] accounts.

[A default letter is provided here which indicates your rejection of the business's offer.

I have reviewed the offer made by the business in reference to complaint ID 9355861, and have determined that this proposed action would not resolve my complaint. For your reference, details of why I am rejecting this offer appear below:

I did not call their customer support line in June of 2012, nor did I accept their discount. Why? Because I do not smoke, nor have I ever smoked. No one in my household smokes. So for that part of their resolve I highly disagree. They did refund my money of $40 and I sent back their packaging UNOPENED today (it just came in the mail Monday ( January 7, 2013). This is not the first time this company has billed and sent me product I did not order.

Thank you for your help in this matter and hopefully this company will get shut down ( I see there were numerous other complaints about this company). provide details of why you are not satisfied with this resolution.

Review: I ordered the free trial of e-cigs for my husband in late December 2012 and we received it in January 2013. When he got the trial package and tried the e-cigs, he immediately started having pain in his lungs. Within 24 hours he had bronchitis and subsequently it turned into walking pneumonia. We tried calling on January 11, 2013 to cancel the account, the company refused to do so.Instead we were told that we had to wait until April 26, 2013 and then we could call and cancel; we never got a satisfactory answer on why this was the case. When we called on 4/26, the company had already charged us $83.94 and sent out a new shipment. Then they told us that they would not give the full refund until we both refused the new shipment and send back the trial package, which was not told to us in January. Nor did they provide return postage so we have to pay that even though we paid the initial postage. Then, of course, the refund won't be processed for 7-10 business days.I feel their business practices are predatory and the fact that they refused to cancel the account when it was requested should not be allowed.Desired Settlement: I would like to see some sort of warning attached with their site or at least an affect on their Revdex.com rating. If companies can refuse to cancel accounts at the customer's request, then what options do we have as customers?

Review: I was online shopping before Christmas and an advertisement popped up on my screen. It had a few different deals on merchandise, including a great deal on an e-cigarette for 9.99. I clicked on the picture on the e-cig and proceeded to check out. I even opted to buy an additional charger for 9.99. Nowhere on that screen or any other screen did it mention any kind of subscription. I received the product and gave it away as a Christmas gift. A couple of weeks later my account was charged 99.99. A subscription fee I was told when I called Customer Service. [redacted] was rude and spoke to me like I was stupid. Apparently they sent me an e-mail after I made my purchase that explained that by purchasing the e-cig I would be enrolled in a subscription program. Again I reiterate, after I made the purchase. They refused to return my money. They then agreed that if I would return the merchandise they would refund the 99.99, part before and part after they received it. But would not return to money I paid for the merchandise, just the amount of the subscription.Desired Settlement: I would like to be refunded the full amount of the subscription that I did not agree to. Or, if I have to return the merchandise then I want full refund on it also.

Business

Response:

Customer has been refunded a total of $99.99 in two transactions- the first, a refund of $50 processed on January 2nd, 2013 and the second, a refund of $49.99 processed January 8th of the same year. While we have processed these refunds on our side, it may take from between 5 to 10 business days for the amounts to appear back reflected in the customer's bank records.

Regards,

Review: I'm using an electronic cigarette on trial. I called twice to cancel it. Nobody will give me the information that I need to cancel. I need the R.M.A number n they are suppose to Email me some shipping information. But they won't give none of it to me. Tired of arguing with them. I was polite n very professional with them. The last time I even asked to speak to the guys boss but he kept giving me the run around. I don't want the E-cigarette. They want me to cancel the day before my trial is over. But I want to cancel now. What can I do? The trial ends on the fifteenth of this month.Desired Settlement: I want to be able to send the product back with out any hesitation or having to go in circles with them. I don't need to have to wait till the fourteenth to make up my mind. I already have.

Response:

[redacted] called in to cancel the membership and all further charges and shipments of product on June 5th, 2013 and was sent a cancellation confirmation email and an RMA email containing return instructions. There is no need for [redacted] to return the starter kit. Located within the full terms and conditions of the starter kit trial offer is our refund policy: "I understand that if I am not fully satisfied with my products I may cancel my order at any time by calling customer service and returning any unused, unopened Product to our warehouse. All returns must be within 30 days of original purchase. Shipping and handling charges are non-refundable." The only $4.95 [redacted] was ever charged was for the shipping and handling of the starter kit.

Review: I initally requested a starter kit for ecigs online through QVC; I agreed to have $9.95 debited from my checkin account. However, I noticed 20 days later while checking my statement online, that $99.95 was debited from my account for an additional set of ecigs that I did not request nor authorize. I attempted to contact their customer service number listed on the paper. I was hung up on or the call never went through I kept getting the message that their customer service reps were assisting other customers. I spoke with a rep on 01/02/2013 who stated that they would refund 50% initially and the additional 50% once the items were returned per each customer has 15 days to respond if they did not want any additional items sent; I stated that nowhere on the packing slip nor on the website where I initially ordered from stated that information. I also stated that those were fraudulent charges per I did not order a second kit and that If I was refunded the entire $99.00 in full and not in 2 parts I would report them to the Revdex.com. There was still no resolution for the full balance I was given a RMA number to return the item and wait for my refund.Desired Settlement: I want the full balance of $99.95 and not a partial refund.

The customer was also emailed an Order Confirmation email on the original order date (November 23rd, 2012) which contained the following passage:

"If you made a trial starter kit purchase, you have been enrolled in our refill membership program. In 15 days, we'll send you 10 replacement filters and charge your MasterCard on file. When the customer called in on January 2nd, 2013 we issued a full refund of $99.99 and this should be visible in the customer's bank records within 5 to 10 business days. We also emailed an RMA code and return instructions on that day. We ask that the customer return the items in good faith. Thus far we haven't processed any returns from this customer although customer has been refunded already.

We ask that the customer return in good faith the starter kit.

Review: I signed up for an E-Cig starter kit after being sent a link from a friend. It advertised a free starter kit for $4.95 shipping and handling. I tried it out, but saw that 20 days later I had a charge of $116.93 from Optima Cigs.I called the customer service line and they informed me that what I had signed up for was a monthly membership that would charge me $79.99 a month to send me an additional 10 cartridges on a reoccurring basis. I let them know that there was nothing on the website mentioning anything along the lines of that. They said that it was on their Terms and Conditions, which is located at the bottom, essentially, hidden from view. The customer service rep, [redacted], let me know that I was billed for the $79.99 and the cost of the starter kit, which is $29.99. He offered a refund on the $79.99, but said he couldn't reimburse me for the $29.99, as I had used the trial product. What kind of TRIAL is this? It's not a trial unless I try it out and determine if I want to proceed with it or not. Had this information been more prominently placed on their website, instead of hidden in the bottom of the page with a link to another page, I would never have gotten involved with this business.Their advertising is misleading to consumers.Desired Settlement: I would like a full refund of $116.93. The $79.99 is supposedly going to be refunded upon them receiving the additional 10 cartridges that I return. However, I would like an additional refund of $36.94, as I was led to believe that this was a free trial. I am happy to return what's left of the trial package, as the word trial means I can try it out and return it if I don't like it. Also, on the Optima Cig website (www.optimacig.com), it clearly says along the top, "Money Back Guarantee."

Review: after ordering an initial kit to see if my husband would benefit by the ecigarettes, the company charged my debit card 99.99 without notifying me,causing a check to bounce. I paid for the initial 9.99 and 9.99 for starter kit but was not informed that I would get this charge (99.99)I asked them to discontinue any more orders and NOT debit my card again, however they are unwilling to do this until adter July 1st, my guess is so they can get more money. I am very upset and would like to report them.Desired Settlement: no more debiting of my bank account and close out all further anything from them.

Review: First of all, I placed a partial order through the internet and stopped when I read the fine print about being auto-billed in the future. I received a phone call that night from an employee of the company following up to complete the order. He explained that I can cancel and avoid the auto-billing and that he would email me how to do that. I continued with the order based on this. I never received any emails from E-Cig brand. I ended up receiving 2 of their starter kits. I called today to return one and cancel both accounts and was told that I couldn't cancel the one account that I wasn't returning. Their policy is within 15 days and I contacted them on day 15. I am supposed to have received numerous emails from them confirming everything we've talked about and I have not received one email from them. This is a SCAM!!!!!Desired Settlement: I just want this registered as a complaint about them and posted somewhere so that other people don't get sucked into this garbage the way I have.

Review: NOTE: This also concerns Sales, Marketing, Customer Service -- I ordered an e-Cig from this company. Based on their magazine advertisement, the device was a one-time $4.95 charge to my [redacted] After receiving the shipment, the paperwork informed me that there was a monthly charge (automatically shipped and billed - amount not discussed). I immediately (May 3rd, 2013), called to ensure that the account was closed and to state that I did not desire any additional products or support. On May 28th, my [redacted]was charged $99.99 for additional merchandise. I never authorized this charge (especially after cancellation had already been done). I contacted their customer service people and demanded an immediate refund which they said they would do as requested. Then they informed me that there would be an additional charge of $19.99 for the original shipment of the e-Cig. So, now (at least temporarily....I hope) I'm out $120 until the refund goes through the system. This company's lack of proper, legal advertising and their sales tactics are atrocious and should be reviewed by authorities immediately.Desired Settlement: I would like a TOTAL refund of ALL charges regarding this account. The $99.99 refund has already been agreed to by their company. However, the horrendous advertising and sales skills leave a lot to be desired. Based simply on the methods used, I would appreciate a TOTAL refund of all charges -- $99.99, $4.95, and $19.99. I will never, ever order anything from this organization or any other like it in the future.

[redacted] placed an order for the starter kit trial offer on April 27th, 2013 and was charged only $4.95 for the shipping and handling of 1x starter kit; on that day an order acknowledgement email was sent to [redacted] containing the following passage: "If you made a trial starter kit purchase, you have been enrolled in our refill membership program. In 15 days, we'll send you 10 replacement filters and charge your [redacted] on file. Each 30 days thereafter you will be billed and automatically sent 10 replacement filters (equivalent to 20 packs of traditional cigarettes). If you cancel your membership before the end of the 15-day trial period, you will be charged for the starter kit's full value." The full terms and conditions of the trial offer are posted online: "If I enroll in the refill Membership program I am agreeing to be charged $99.99 in 15 days for the kit I received plus a 10-cartridge refill pack, and 79.99 +S&H each 30 days thereafter for a new 10-cartridge refill pack. My credit card will be billed and my shipment will be sent automatically at those times. Refill shipments will continue until I call to cancel my Membership at 1-866-830-2464, open 24 hours a day, 7 days a week. I understand that my starter kit has a retail value of $99.99. If I cancel my membership but do not return the starter kit, I will be charged for its full value. By clicking to order I represent that I have read and agree to the Privacy Policy and full Terms and Conditions of this offer and I understand that I will be liable for payment of product that was shipped to me, and future shipments of product, if I fail to notify customer service to stop supplying the product to me. Refund Policy: I understand that if I am not fully satisfied with my products I may cancel my order at any time by calling customer service and returning any unused, unopened Product to our warehouse. All returns must be within 30 days of original purchase. Shipping and handling charges are non-refundable." We received a call from [redacted] on May 3rd and as requested, the trial was extended up to May 26th. However there must have been some misunderstanding between [redacted] and the customer service representative because when May 26th arrived and the $99.99 charge was applied for the 10 replacement filter, we received another call the very next day from [redacted] requesting immediate cancellation and a refund of the $99.99 charge. The refund was processed on that day: $99.99 refunded on May 27th ([redacted]) [redacted] agreed to be charged a further $19.95 in order to keep the trial starter kit (this amount was refunded today transaction ID [redacted]). Unfortunately we cannot refund the original $4.95 charge as [redacted] hasn't returned the trial starter kit as yet. We ask that [redacted] return the kit in good faith.

Review: My involvement ended with this company in July 2012. By phone I stopped all deliveries and contact with them. Today Dec. 10th I received an Email from this company stating they took $40.00 out of my bank account with no authorization from me. and that an order had been shipped. This is theft. They had No Right to go into an unauthorized account and steal money. The money was taken in July and AGAIN now on Dec 10th, 2012. So infact this company has taken money twice from my account with no authorization. After the money taken in July I called and told them Do Not Do This Again. Do Not send anything to me.Desired Settlement: I want this money returned to my account now. And any form of information to the account taken from them. What do I have to do to protect myself against this happening again.

Review: This company had a Money back guarantee on its product. It stated "If you are not fully satisfied, you may return any unused, unopened products to our warehouse for a refund. To return a product, you must first contact customer service and obtain an RMA 9return merchandise authorization)code. Refunds will not be processed with out an RMA code. All returns must be within 30 days of purchase and in re-saleable condition. Shipping and handling charges are non-refundable. Return shipping is the responsibility of the customer." I made the order on 6/1/2013. I called and talked to customer service about the hidden charges they had and requested a RMA code, the never gave me a RMA code and talked all around the request. So this is why I am contacting the Revdex.com.Desired Settlement: I would like to get a RMA code and be able to return the unopened package to them for a full refund of any charges except for the shipping and handling charges that I am responsible for , I understand that part.

Today we've sent [redacted] RMA email containing return instructions and a cancellation confirmation email which means that there will be no further charges applied to the credit card of [redacted] nor shipments of product unless otherwise directed by [redacted] We encourage [redacted] to keep the starter kit as [redacted] has only ever spent $4.95 with us- for a high-quality product- and our terms and conditions state clearly that shipping and handling fees are non-refundable, as pointed out by [redacted]

Review: I recently tried an offer from e-cigs, and electronic cigarette company. They called my house and offered a free 15 day trial. ( www.[redacted] They called 4/11/13. The package came 4/15/13. They stated the trial did not start until I received the package. They also said that as long as I canceled before the 15 day trial was up, my credit card would NOT be charged. I called on 4/22/13 to cancel. The person I spoke to was VERY belligerent and would NOT take no for an answer. He kept trying to offer me discounts and things no matter how much I said I want to cancel. Eventually, I said, "I know this call is recorded. I am telling you to cancel my account immediately. Any charges placed from you on my card from this date on are UNAUTHORIZED!" Then on 4/26/13 I noticed a charge of $83.96 on my debit card from them (which also put me in the hole). I called them immediately. At first, the person did the same thing.. Not taking no for an answer, offering other discounts, etc. I told them "This account was canceled on the 22nd." They said it had in fact NOT been canceled by the person I spoke to on the 22nd! After a very long frustrating conversation and being told they would refund only %50 of the charge. I said "No, this charge was NOT authorized. You need to refund %100." They finally said they would have me speak to a manager. After being on hold for over 20min, a lady answered the phone and said there were no managers available. She did the same "Oh we'll give you a discount" etc. After once again talking and explaining that I had canceled and did NOT authorize these transactions, she reluctantly gave me a "reference number" (I later learned that this was a bogus number she gave me just to shut me up). To make a very long story short, the charge is still on my account, and there is nothing e-cigs will do about it. Regardless of all this, they had charged my account BEFORE THE 15 DAY TRIAL WAS UP. It had not been 15 days since they called on the 11th. It has not been 15 days since I received this supposed "free trial" on the 15th.I feel e-cigs is scamming people into a "free trial" and then charging their cards before the 15 days is up so they can get money out of you. They will not cancel your account if you ask, and they obviously keep your credit card number on file after the account was supposedly "canceled" so they can keep charging it.Please, please don't let anyone else fall victim like I have! The repercussions of my account being put in overdraft because of them has been far greater to me than just an "inconvenience". This is a very bad company and a scam.Desired Settlement: I would like to be refunded the $83.96 they charged without authorization plus any overdraft fees incurred as a result of this charge and any checks that bounced, etc,. because of the overdraft they caused in my account.I would also like to be taken off their mailing list, and have my credit/debit card information erased from their files.

Review: I emailed this company on December 7, 2012 to cancel delivery of their product and they charged my credit card on December 30, 2012 for $19.95 and shipped additional products.Desired Settlement: I want a refund of the $19.95 and I want them to stop charging my credit card and cancel my account.

Response:

Customer was refunded $19.95 on January 8th, 2013. While we've processed this refund on our end, it may take from between 5 to 10 business days for the amount to be reflected in the customer's bank records. The customer's account has been cancelled so there will no further charges or shipments of any product to this customer. We've sent an RMA email with return instructions today so that the customer can return the unwanted items in good faith as we've already refunded in full matching the desired settlement.

Review: Bought an E-cigarette price was 5.95 because I had purchased another item. After I cancelled my order for more E-cigs, I was sent an e-mail that said E-cigs were sending my order out. I called and was told to send the order back when it came in the mail and the E-cigarette that I had already payed for. Also was told I would be charged full price for the E-cigarette. Then I was charged 49.99 and 99.99 dollars to my credit card.Desired Settlement: I would like these charges taken off my credit card. I have no problem sender the new package back but I already payed the 5.95 for the first one and they want it back and charged me again for it 49.99.

Customer[redacted] placed an order for the starter kit trial offer on April 13th, 2013, was charged only $5.95 and sent an order confirmation email which included the following passage: "If you made a trial starter kit purchase, you have been enrolled in our refill membership program. If you cancel your membership before the end of the 15-day trial period, you will be charged for the starter kit's full value." Within the 15 day trial period we've got record of a call from S.B. who requested the trial be extended, and it was twice, from April 26th to May 15th. On May 15th, S.B. was charged $99.99 and sent 2 boxes of refill cartridges. The only two charges we have on file are for $5.95 (transaction ID 1860104398) and $99.99 (transaction ID 1886227806) and on May 15th, after another call from S.B., a RMA email was sent with return instructions and the only refund to date was processed, for $49.99 (transaction ID 1887301384) Once we've received the 2 boxes of refill cartridges back in good condition another refund of $50 will automatically be processed back to S.B. The account is closed/ inactive so there will be no further shipments of product or charges going forward unless directly otherwise by S.B. The terms and conditions of the offer are posted on the website: "If I enroll in the refill Membership program I am agreeing to be charged $99.99 in 15 days for the kit I received plus a 10-cartridge refill pack, and 79.99 +S&H each 30 days thereafter for a new 10-cartridge refill pack. My credit card will be billed and my shipment will be sent automatically at those times. Refill shipments will continue until I call to cancel my Membership at ###-###-####, open 24 hours a day, 7 days a week. All returns must be within 30 days of original purchase. Shipping and handling charges are non-refundable." in good faith we'll waive the 30 day return window- S.B. may return the product for an additional $50 refund at S.B.'s convenience.
