[redacted] I am [redacted] and am responsible for addressing Revdex.com complaints Unfortunately, because of management changes in our Maryland Branch, I did not get the complaint until today, when you sent your final notice So, I'm sending you [redacted] If you have any questions, please reach contact me at the number below.Sincerely, Curt C***LeafGuard of Maryland, Inc(the “Company”) apologizes for any potential confusion that it might have caused regarding this matter Unfortunately, due to recent turnover in the management positions in the Company, there has been some communications issues We are addressing those communication issues.As to potential confusion, we believe that the Customer is confused regarding what warranty she received When the Customer purchased her [redacted] in 2014, she received a limited “no clog” warranty Specifically, the warranty guarantees that water will remain “free flowing” throughout the [redacted] gutter system If water does not, LeafGuard will come out and clean out any clogs the LeafGuard gutter system at no cost to the customer However, the contractual warranty does not state, “Service – if at any time you think the system is not operating efficiently, call us and we will inspect and adjust the system as necessary at no charge to you! Feel free to contact us at anytime, we are standing by to be of service!” Because there was no applicable warranty, we quoted the Customer a price to address the issue that was associated with the house versus the installation of the gutter system.The Company does many things for customer service, even when it does not have a legal obligation to do so This is the situation that we have in this matter Even though there was no warranty that covered these issues that the Customer was experiencing, the Company has performed the work at no charge to the Customer We believe that the matter is now fully resolved So, we are closing this matter.-- [redacted] Curtis PC

Good morning, LeafGuard of Maryland, Inc(“LeafGuard”) respectfully disagrees with the Customer's assessment that the LeafGuard gutter system “does not perform as advertised.” The Customer HS generally complaining the LeafGuard gutter system is not working because he has icing/icicles, which he did not have prior to the purchase of the LeafGuard gutter SystemLeafGuard disagrees with the Customer's premise that the LeafGuard gutter system, or any gutter system, is going to completely prevent icing/iciclesThe contract, which the Customer had sufficient opportunity to review before signing, clearly addresses the icing/icicle issue and their relation or lack thereof t() the gutter systemThe LeafGuard gutter has not failed its intended purpose of effectively removing the water from the roof of the home, yet allowing the gutter to remain free flowingFor the reasons below, LeafGuard respectfully declines the Customer's request for a full refund and to reinstall his old gutters.LeafGuard informs its customers of the issue of ice dams/icicles both orally and in writing prior to a customer purchasing a LeafGuard gutter systemOur sales presentation contains slides addressing the issueOur standard sales presentation was given to this CustomerAlso, the contract clearly addresses the issueIt states as follows:“LeafGuard does not prevent buildup of ice, icicles, or other Acts of God, including water from backing in under shingles causing water damage to soffits, exteriors, and other areas of your buildingThose conditions can only be prevented by the proper installation of an ice and water shield membrane under shingles extending to feet around the entire perimeter of the roofThis membrane protects the roof deck as well as portions of the fascia board to provide a watertight seal, LEAFGUARD WILL NOT ELMINATE OR HELP ELIMINATE ICE FORMATION OR ICICLES ON YOUR EAVESIce formation is mostly caused by factors not related to your gutter systemIn fact, you will probably see more ice (icicles) on the outside of the LeafGuard Gutter because conventional gutters tend to collect ice inside the trough whereas LeafGuard is shaped to discourage anything from entering the trough except liquid waterTHEREFORE, IT IS TO SEE ICICLES ON THE OUTSIDE OF THE LEAFGUARD GUTTER, THIS CONDITION CAN BE SEVERE IN SITUATIONS WHERE THERE IS EXCESSIVE HFAT LOSS FROM YOURROOFWe make no representation regarding the elimination or prevention of ice formation with the installation of LeafGuardUnlike other gutter systems, we are able, and do warrant that the LeafGuard will not come off or be pulled loose from the fascia board as a result of ice formation.”As they say, the contract speaks for itselfIt clearly states that the LeafGuard gutter system will NOT ELIMINATE or HELP ELIMINATE ICE FORMATION OR ICICLESAccordingly, LeafGuard fully informed the Customer about icing/icicles and how it is not responsible for their formation prior to the Customer signing the contract for the purchase of the LeafGuard gutter system.There is numerous authority explaining what causes ice dams/icing/icicles, and it does not have anything to do with a particular gutter system or the alleged quality of that gutter systemThe Minnesota Department of Commerce and the University of Minnesota have published papersindicating that the primary cause of ice dams begins within the house and with heat escaping the home causing the snow to melt, which ultimate re-freezes at the edge of the roof, causing the ice damsAs an example, LeafGuard refers your attention to videos that can be viewed on YouTube that also explains how ice dams are caused ( [redacted] )Additionally, due to severe winter weather the Washington, D.Carea has had, there have been an explosion of iciclesA local newscast has document this event ( [redacted] )This information is just the tip of the iceberg regarding the information available (e.gthe science behind) the cause of ice dams/iciclesThere are also plenty of newscasts over the past few years that have addressed the ice damsicicle issueAs you can see from the available authority, ice dam/icing/icicles can occur with our without gutters or any type of gutter system because it is not generally related to the gutter systemThe problem typically lies within the customer’s home—i.eheat escaping, in part, due to improper insulation and/or ventilation.LeafGuard disputes that it has not been responsive to the Customer’s concernsAs the Customer indicated in his Complaint, we advised him that his home’s loss of heat might be a factor causing the iciclesAs indicated in his Complaint, the Customer was not always happy with our response, that the most likely cause of his icing/icicle issue was heat loss of his home versus the gutter system.LeafGuard has consistently dealt appropriately with this Customer and all customers, prior to (i.eits advertisements) throughout the sales/installation processes and when post-installation issues ariseLeafGuard provides all its Customer with a lifetime no clog warranty, which is what we advertiseA no clog guarantee means that water will remain free flowing in the gutter systemIn this situation, LeafGuard has already lived up to this warranty, as the Customer indicated in his Complaint when he stated at we have already came out to clean his gutters.LeafGuard does many things for customer service, even when it does not have a legal obligation to do soHowever, there are times, like this one, were there is nothing we can do for this Customer at this time Obviously, LeafGuard wishes that all its customers are 100% satisfied, but sometimes that is impossibleWhatever the Customer motivations maybe, LeafGuard is not going to refund the Customer's money because there has been nothing provided by the Customer to show that the gutter system is not working as designed, e.gthat water remains free-flowing through the gutter system, Again, the Customer’s concern regarding the icing/icicles is most likely related to his home versus the gutter systemMost importantly, he was completely advised of the issue of icing/icicles before him signing the contract purchasing the gutter systemAccordingly, LeafGuard will have no choice but to consider this matter closed

I am rejecting this response because: LeafGuard is making a one-sided argument with regard only to the increased icicle buiexperienced with their product The customer's complaint is highlighted below:1) The LeafGuard gutter system does not collect water that is free falling off the roof into the gutter system during major rain storms Instead, the water will flow off of the roof, over the gutters and into the yard / bushes / driveway The effects are like waterfalls at all major areas in the front and rear of the house;2) The icicles are much more pronounced after the LeafGuard system was installed The icicles are much more prevalent, larger and thicker icicles, and pose a safety hazard to the customer's family and pet;3) Finally, the fascia boards now show externally jagged edges and cosmetically look horrible since the installation of the LeafGuard gutters The pitch used pulls the gutters away from what was once a very neat and well dressed fascia and gutter system We have had the gutters fill with debris from trees the first year that they were installed.The problem that we have with LeafGuard and its customer service is that they tend to push everything back to the customer For example, they made a major argument to repeat that the contract identifies that icicles can be formed, but they don't consider that it may truly be possible that their product is indeed causing a bigger problem with the icicles that what was experienced prior to the new gutter system They just made a claim that the excessive icicles are caused by a large heat loss from the roof area, but didn't send anyone to measure the heat exchange to either support or discard their claim As for the water fall effects, the same argument is true Isn't it possible that the pitch of my roof and the roof layout may cause greater speeds of water flow rates off the roof, which may not allow the water to properly and efficiently collect into the gutter system? It may, or may not be the case My point is that nobody from LeafGuard will even help and determine if a problem does exist and requires further attention to determine a remedy, or not If the product doesn't do what they advertise and claim, then they should honor my request for a refund, if they're unable to rectify the problems at hand.The only reason we are having this dispute, is because LeafGuard is unwilling to look into these accusation seriously and make a conscious effort to help the customer as best they can We had a lot of confidence in their product when we decided to purchase their product, however, after the product was installed, our opinion was drastically changed This is not a cheap investmentWe demand satisfaction!Any positive dialogue and useful assistance would be greatly appreciated.Regards
