I have enclosed a copy of the contract between ERConcrete and Sewer, Pictures of driveway, sidewalk and steps,and also a copy of text messages between ** *** and myself.I have enclosed a copy of texted messages as you will readI been waiting for him to do a core sample for over a monthIhighlighted those textsAlso, on April 3rd he told me ***don’t want to do anything about itIn Mr***’s letter to you hedenied that comment.Also, I feel $8,is accurate since all concrete listed inthat price is defective.My apron of my driveway was done by a different concretecompany and poured around the same time and isn‘t defective inanywayWhich takes the blunt of de-icing materials applied oncity streets by the city.Thank You,*** ***

This letter is in response to the complaint brought to you by Mr*** *** My company, E.RConcrete & Sewer, Inc., did enter into a contract in 05/with work being performed in 07/with the ***s for repairs at their property at *** Rd in Mentor, Ohio, which
include the concrete in dispute I have seen the minimal areas of spalling in the driveway at the *** residence and I strongly disagree with Mr***’s statement that there are “big pits all over the driveway” And I also strongly disagree with Mr***’s statement that I told Mr***, “the concrete I poured was defective and *** *** won’t replace it” Also, the total cost in question of $8,included a set of steps at $1,and walkway at $1,which brings the driveway cost to $5,190.00.Although it is unfortunate that it seems spalling has occurred in minimal areas of the driveway, the ***’s were aware that this was a possibility as evident in their contract with my company which clearly states that we cannot provide a guarantee against flaking, spalling or cracking of any concrete work due to weather conditions and de-icing materials used on roads.See below:NOTICE: Due to weather conditions and de-icing materials used on roads, E.RConcrete & Sewer does not provide a guarantee against flaking, spalling, or cracking of concrete work E.RConcrete & Sewer does provide a year guarantee on basement waterproofing only on the condition that all basement walls are waterproofed This contract contains the entire agreement between the parties.A concrete sales repfrom *** *** and myself agreed to meet with the structural engineer at the residence that Mrs*** told me she had look at her driveway but that never happened, instead I received the notice from you I am very willing to meet with their structural engineer to go over the work performed by my company My company has completed work on hundreds of driveways, walkways, patios, concrete steps, etcin the last years and I have had issues on two of them, the *** residence being one I stand by my work and am always willing to take responsibility for repairs needed that are a direct result of fault on our behalf I do not believe that the issue the ***s are having is a result of poor workmanship on the part of my company And for this reason I do not agree with the desired settlement of paying for replacing the concrete or refunding the money paid to me by the ***s for the completed job at their residence Again, I am very willing to meet with the ***’s structural engineer and a concrete repfrom *** *** to look at the driveway and I am requesting that *** *** perform a core sample of the concrete driveway It is not and has never been my desire to have an unsatisfied customer My company performs a professional, well maintained, thorough and courteous job at every site and I stand by our work.Respectfully,** ***/E.RConcrete, Inc

This is in response to the additional letter sent by Mr*** *** Again I strongly disagree with the assumption that my company is responsible for the $8,to replace the concrete in question.Again I am waiting for *** concrete to do a core sample and to meet with the structural engineer Mr*** states he had look at the concrete Unfortunately I cannot dictate when a rep from *** will do the core sample, that is at their scheduling discretion Again I feel you can see from Mr***’s record of our text messages that I did not state “the concrete I poured was defective and *** Concrete won’t replace it”, as Mr*** stated in his first correspondence Again I await the results from the core sample and I will pursue that with *** Concrete and I would like a document from the ***’s structural engineer with his profession opinion along with his professional credentials as a structural engineer in concrete.Again, my contract clearly states I cannot provide a guarantee against flaking, spalling, or cracking of concrete work due to weather conditions and de-icing materials used I understand that Mr*** feels his apron takes the brunt of the de-icing materials but cars are driven on roads that use the materials and then parked on the concrete driveway where it falls from the vehicles and collects on the concrete This is the reason I cannot provide the guarantee as stated in the contract.Again do not feel that the resulting minor spalling that is present on the concrete at the ***’s residence in Mentor, Ohio is a direct result of the workmanship performed by my company I feel that if the ***’s were in any way unsatisfied with the quality of the finished product they would not have paid me in full at the time of completion of the project Respectfully,** ***/E.RConcrete, Inc.Additional comments from company:This is in addition to my response sent earlier today Also in my contract with the ***'s it clearly states that due to weather conditions we cannot provide a guarantee against the spalling, flaking and cracking of concrete Weather conditions are a major factor in spalling and as is documented the 2014-winter for Northeast Ohio was very bad I cannot control the weather just as much as I cannot control what de-icing materials came in contact with the concrete at the ***'s residence Thank you
