I have reviewed the response made by the business in reference to complaint ID ***I want to note there are discrepancies in the response of *** ***I did not move in at the end of September; I signed the Rental Lease and moved in on September 2, I was given a copy of the lease on September 5th, because a manager was not present on September 2nd to sign their part of the leaseIt was said I was told repeatedly there is an Online PortalThis is not trueI first heard of the Online Portal on September 20, via e-mail from one of the managersShe sent me the link to register and once I logged in, to place a work orderShe told me she already placed the work order when I spoke to her on the phoneThe online portal work orders says 24-hours to respond to requestWhen I called and then placed a work order on September 20th, it took days to repair the clogged sinkI called Friday, September 22nd to check if I someone was coming or already repaired the sink, knowing the apartment office is closed on the weekendsI was told it would be fixed first thing on MondayWhen I got home from work, on the 5th day without a kitchen sink, it still was not working and I had to call the office again to ask when it was going to get fixedIt's true, I have not been happy since I moved in, because I thought I was going to have a functional apartmentI moved into an apartment with the refrigerator not working and I had to do without the holiday weekendI also moved finding out the bathtub does not drain well, and within several minutes, the bathtub is full of waterI had to have this looked at three times and it's still not resolvedI will say the last time I requested a work order for a poor draining bathtub, it was responded within the hoursThe bathtub drains a little better, but within several minutes still fills about half the bathtub now. I do like the space and location of the apartmentI did not want a luxury apartment, why I chose this apartment buildingI know it's old and it does not have updates, but I did not care about all of thatI wanted an apartment I can function in, meaning a working kitchen sink and a proper draining bathtubI am asking when I have placed a work order for it not to exceed more than hours, so I do not have to call frequently to see when it is going to get done; if it is going to take more than hours, for management to communicate that with meI would very much appreciate for a bathtub to work properly, or at least close to being well functioningI would like management to put themselves in my shoes and think how frustrating it is when something is not working and have to wait for more than days to get it fixedWhen everything is works and functions well, management will not hear from me.

I am in receipt of the above referenced complaint and this will serve as our official response. Ms. [redacted] claim that there was a water leak from her window during a rainstorm is correct. However, that is about the only correct statement in her complaint. Ms. [redacted] called during...

the rainstorm and was advised that unfortunately there was absolutely nothing that could be done to stop the leak on her 10th floor window during the storm and that maintenance would be coming the next day to look at the nature of the problem. Ms. [redacted] was ask to please place some towels on the floor to control the water from making further damage. When maintenance arrived, it was concluded that the repair was outside of our in house staff capabilities and that an outside contractor was going to be required to repair the outside wall of the 10th floor. Ms. [redacted] was not satisfied with our maintenance staffs answer and proceeded to contacted the building manager demanding an offset on her rent. Ms. [redacted] was advised that per the terms of her lease there would be no offset or deduction of her rent and that she should contact her rental insurance provider to seek compensation for any damages or inconvenences suffered as a result of the rain storm.  All tenants on move in into our buildings are advised and are required to signed a notice advising them that the building is not responsible for any damage caused by leaks, floods, fire, burglary etc. in their apartment and that they should purchase renters insurance. Clearly Ms. [redacted] did not heed our advice and is now without insurance and is simply seeking compensation from us for something she knew well in advance would not be covered. Lastly, Ms. [redacted] was advised that in the event she was not happy with our remediation efforts, ie bring in an outside contractor to repair the building facade, we would be more than happy to release her from her lease since the last thing we want in our building is an unhappy tenant. I hope this satisfies your concerns and you can close out the file without further action.Should you have any questions or require any additional information, please let me know.Cordially,[redacted]

All of the "background noise" Ms. [redacted] is making is irrelevant to the fact that she entered into a contractual agreement and we expect her to honor said obligation. Ms. [redacted] was given an option to be released from her lease in exchange for an early termination fee, which she refused to pay. With regards to the key fob, again more "background noise" in an attempt to distract from the fact that she entered into a contractual obligation. The key fob is working and has been working for quite some time.We will not let Ms. [redacted] out of her lease unless she pays the early termination fee.Cordially,Eran E[redacted]

Review: My boyfriend and I have been renting from E Square Capital since July 27, 2014. Since this date we have encountered nothing but problems from this poor excuse of a management company. We had a list of things to be fixed prior to moving into the apartment, that upon our move in date were not completed. The property manager, [redacted] then put in writing that these repairs would be fixed in a timely manner. The biggest issue we have had is a leak in our bathroom ceiling which resulted in a hole in our ceiling. Upon moving in there was a tiny hole above the shower head that they simply patched. As time passed it was evident that the patch was not the correct solution and watermarks began to appear on our ceiling. It seemed as though we were calling or in the office every week about this issue to no avail. Finally one night a large hole developed and a sizeable leak was streaming down. After calling tthe emergency maintenance line 20+ times with no answer, a maintenance worker named [redacted] finally arrived and told me that there was nothing he could do until it dried. I told him I was concerned about our ceiling collapsing in and he merely shrugged me off. In the subsequent days another repair man came and removed the damaged ceiling drywall and put in a new piece. The workers said they would come back to sand and paint the drywall which never happened. Since then there have been a few wet spots here and there which when we informed the property manager, had never been followed up on. This past Sunday we noticed that a section of the new drywall was coming detached from the existing drywall, and a few hours later upon coming into the bathroom pieces were hanging from theceiling and water was dripping down. After going to the property manager TWICE, she sent [redacted] over who said yet again that there was not a problem with the plumbing and that it is the woman upstairs walking around that is causing the problem. This would be enough to drive a person crazy, but yet these are not our only issues with this management company. Last week there was streaks of blood on the walls of our hallway which we informed management 3 times until it was finally cleaned days later. We have also had problems with the lock to our apartment, the locked door to the building not properly closing to a supposedly secure building, as well as a broken glass pane to the outside door that was neglected for months until a resident finally put up a piece of plywood to keep the entry way not as frigid.Desired Settlement: All I am seeking is for a proper repair and maintenance to our apartment as well as the overall property. If they would fix it properly in the first place I would not have to call them weekly about a new issue that arises. My boyfriend and I work opposite schedules and thus often times I am left to deal with these issues myself and the majority of the time my complaints to E Square Capital fall on deaf ears. If we were not locked into a lease for 8 more months and planning to buy a house this summer, I would take this company to small claims court because these living conditions are deplorable and the only reason we are staying is because we have to.

In regards to the complaint we received from [redacted] we are giving her the option to vacate her apartment with proper notice and will waive any early termination fee's that we normally require. We understand her frustrations, and do not like when our tenants are unhappy so we figured it would be the best solution-to let her and [redacted] find a home where they would be more happy. As a small company-we have a huge work load and prioritize work orders to the best of our ability. We also do our best to do the repairs, however their ceiling problems are a result from the neighboring tenant-in which we are trying to control. The issue is not a plumbing issue what so ever. Though they may have stayed on top of their requests, and came to us more than once regarding their issues-we have never made them wait an excessive amount of time for repairs. Some of the issues they wrote in their complaint-were brought up to maintenance instead of management so when it didn't get done, they took it into their own hands. We reimbursed them with the cost, and showed sympathy and appreciation in their efforts. As for blood in the common areas, we did send the cleaning personnel the same day it was brought to our attention. The next day-I saw [redacted] and was told some of it was missed. I then personally cleaned it up myself. As a leasing agent-this wasn't my duty. However, I care a great deal about my tenants and do whatever is in my power to please them and help share the workload with my coworkers. Again, we are not forcing anyone to stay in their apartment if they find it "deplorable." That is not how we run our company. Review: While there was a major leak on a rainy day, I was told by management of this company that there's was nothing she can do. It was pouring rain outside and rain poured into my apartment above windows in both my bedroom and living room for nearly a day. Maintenance was sent to look at this issue a day later, but admitted that they can try to patch up the area but most likely won't be able to fix the problem. Now I'm afraid that if it rains again my furniture will be ruined. I made management aware and rather than addressing the issue she complained about other things and refused to accommodate me. She instead suggested I find some place else to live.Desired Settlement: Because management refused to send anyone to fixed this issue, I was forced to repeatedly clean up water. I simply asked for a deduction on the rent and management refused to work anything out but instead suggested I move out.
