Initial Business Response / [redacted] (1000, 8, 2015/09/10) */ The original proposal was that the concrete walkway would start at the front of the house and continues on to the side and to the patio where the Jacuzzi endsThe concrete material was estimated to be yards The next day, [redacted] requested to cancel the concrete walkway at the front of the house and to use stepping-stones insteadI complied with the request [redacted] then requested to have the same done on the other side of the house where the Jacuzzi ends as well as add a sidewalk to where the garage endsI complied with this request A few days later, my workers and I prepared the ground grading and the framing for the concrete (see attached pictures)The sidewalk measures approximately feet wide During the framing, [redacted] addressed she wanted the walkway to be smaller than inches and the planter to curve at inches out from the wall of the houseI advised her that it wouldn't suit the rest of the concrete and if the walkway were smaller than inches it would crack over time due to the lawn mower being driven on the walkway; ***, her husband, agreed with meI took his agreement as approval of my planMy workers and I then proceeded to frame the walkway (see attached picture #1) I mentioned to [redacted] that the concrete truck would arrive on Tuesday, June 9, at 6am and my workers and I would arrive at 5:30amI asked him to make sure their cars are moved to the street to make room for the concrete truckWhen we arrived, none of the cars were moved That same morning, I knocked on their door and ***'s brother answeredI asked him to move the cars before the concrete truck arrivedFor no apparent reason, he answered, "We will" in a hostile manner and walked away while expressing derogatory remarks such as, "Fing bunch of Mexicans." Taken aback, I replied by saying, "There is no need for that." Mr [redacted] 's response is unacceptable for the following reasonsFirst of all, he used this as a forum to personally attack me, my husband, and my brotherAnd while I will not address his ludicrous and accusations about my husband, I want it to be known that my brother is developmentally delayed and has never used a curse word in his entire life, nor did he make a rude racial slurI was upstairs when Mr [redacted] came to the door and wanted my brother to move the vehicles out of the drivewayMy brother told him very politely that my husband would move the vehicles as soon as he got back from taking the dogs for a walkMr [redacted] was insistent but my brother does not know how to drive, and just repeated the same statement each timeSecondly, the fact remains that: A) We paid Mr [redacted] for work to be done and the work was not done B) The plants I paid for are not the plants that he put in C) He used dirty (smells like urine) mulch instead of the "good planting soil" that I paid for D) The sprinkler system that he installed is inferior and incorrectly installed (It was buried only a few inches - not the regulation 12"-18"; he put too many heads per line; the lines were too far apart; he used Home Depot parts rather than "commercial grade" PVC and heads; he did not install an anti-syphon valve; and he did not install a regulator for the drip system) and therefore the entire irrigation system had to be replaced E) He changed the design of my cement walkway without my consent(I was very specific that it was to be arched and even went over the drawings with himHe made it straight, I corrected it and told him againHe made it straight AGAIN, and I corrected it and told him againI did not know that he had changed it YET AGAIN until I saw the cement being poured! F) The soil and sod that I paid for was never delivered/installed, and he has not reimbursed me G) When I initially wrote this complaint, the check that Mr [redacted] had given to the cement company for their work had bounced and the cement company was coming after ME for payment! But since then, Mr [redacted] finally did pay the cement company what he owed themI just don't understand how someone who owns a business could operate this way H) He lied about being licensed - his license is EXPIRED! When we were getting ready to hire Mr [redacted] I asked him, "You're licensed, right?" to which he replied, "Of course - I am a professional and have been in business for over years." And since there is a license number prominently displayed on the building, I took his word for it and did not check I) We paid Mr [redacted] for everything that was done and some things that were pending (such as the soil and sod)The only thing I did not pay him for was the labor to install the sod because it had not been done yetYet, he is claiming that we owe him money! J) And if all this were not enough, now Mr [redacted] has filed for a restraining order against my husband! I have now hired a LICENSED AND BONDED landscaping company to tear out and replace the messirrigation system installed by [redacted] So, regardless of Mr [redacted] 's personal attack on me, my husband, and my disabled brother; and despite the fact that he FINALLY, after two months, paid his debt to the cement company; and despite the pictures pictures that he submitted as "proof" - Mr [redacted] did not do what he was paid to do, he changed things without our consent, he tried to over-charge and over-tax us, and he fraudulently presented himself as a licensed lanscaping contractor

The original proposal was that the concrete walkway would start at the front of the house and continues on to the side and to the patio where the Jacuzzi ends. The concrete material was estimated to be 10 yards.
The next day, [redacted] requested...

to cancel the concrete walkway at the front of the house and to use stepping-stones instead. I complied with the request. [redacted] then requested to have the same done on the other side of the house where the Jacuzzi ends as well as add a sidewalk to where the garage ends. I complied with this request.
A few days later, my workers and I prepared the ground grading and the framing for the concrete (see attached pictures). The sidewalk measures approximately 3 feet wide.
During the framing, [redacted] addressed she wanted the walkway to be smaller than 18 inches and the planter to curve at 24 inches out from the wall of the house. I advised her that it wouldn't suit the rest of the concrete and if the walkway were smaller than 18 inches it would crack over time due to the lawn mower being driven on the walkway; [redacted], her husband, agreed with me. I took his agreement as approval of my plan. My workers and I then proceeded to frame the walkway (see attached picture #1).
I mentioned to [redacted] that the concrete truck would arrive on Tuesday, June 9, 2015 at 6am and my workers and I would arrive at 5:30am. I asked him to make sure their cars are moved to the street to make room for the concrete truck. When we arrived, none of the cars were moved.

For no apparent reason, he answered, "We will" in a hostile manner and walked away while expressing derogatory remarks such as, "Fing bunch of Mexicans." Taken aback, I replied by saying, "There is no need for that." Suddenly, [redacted] came outside and started yelling at me. She went to the side of the house and pointed to the walkway. I explained to her that [redacted] had agreed on the framing. She still requested to have a smaller walkway even though I reminded her that a smaller walkway would easily damage. Persistent with her request, I complied and assured her it would take approximately 10 minutes to fix. Before proceeding, I explained to her that I needed her to sign a Changed Order Form, a document that relieves me from being responsible for any future damages due to the changes she requested. [redacted] said, "Never mind, it is too late. They are here. F" and walked away.
