The seller is keeping my $500 in earnest money claiming I did not abide by the contract.
I entered into a contract to buy a home at 2563 Chatham Way Palm Bay, Fl. It had a 45 day period to complete the purchase. The deadline was April 15th. I was working with a lender who kept delaying processing my loan to the point where I asked the seller for and extension. They agreed in writing with no changes to extend it until April 29th. On April 22nd I was informed by the lender that they were not going to process my loan. They claimed the Virus caused the banks to start not lending under $100,000 and for Manufactured Homes.On April 23rd, I signed a cancellation agreement with the seller. This was signed before the extension date of April 29th. Based on the facts, the seller should not be able to keep my earnest money.
Refund Based on the fact that we had a signed agreement for the extension with no changes,the seller should not be able to keep my earnest money.
