Hi ***It was a pleasure speaking with you today I have attached the event information and email correspondence with Ms [redacted] On 5/14/Eagal Lakes Resort held a public event “Lil MudRunner Kid’s & Family Mud Run” benefitting UCP of San Joaquin CO.This event was our 5th annual runOn the morning of May 14, Ms [redacted] and her family registered on site day of for the eventThis incident stands out because when she arrived at the registration table she was under the impression that day of registration was no chargeShe was there with friends and her familyShe was clearly unhappy about the day of registration pricing and was very vocal about it to the girls at the registration desk My manager, ***, was at the registration and overheard the conversation which was clearly becoming more frustrating for Ms [redacted] [redacted] asked if there was a problem and if she could help her Ms [redacted] said the price advertised on [redacted] was only $per person and it had a $off [redacted] tried to explain to her that the price was never $nor had there ever been a promo with a $off, however, the early bird pricing in January was at $and the pricing went up in increments as time came closer to the event with day of registration being $ [redacted] tried to explain to her but she cut her off and handed over her credit card and said “fine just charge it” The girls at the registration desk swiped her card for all participants that registered Ms [redacted] signed for the purchase and was asked if she would like a receipt and she said “NO” All participants were given a race shirt & race number to participate in the run.On June 2, I received an email from Ms [redacted] that she was disputing the credit card charges and that she had paid $cash for only participants I later received correspondence from her bank disputing the charges I sent them the same information enclosed above inclusive of the swiped, signed credit card receipt.She again emailed me in July threatening me with Revdex.com, small claims court, etc She stated that she had paid with $bills only of them had run and that we had “frauded” her by charging her $after she had already paid.In my own in house investigation, both my staff who were present at registration concurred that Ms [redacted] was clearly upset, had never paid cash and gave her credit card for paymentPlease let me know if I can be of any further assistance to you.Regards, [redacted] ***

This incident stands out because when she arrived at the registration table she was under the impression that day of registration was no charge. She was there with friends and her family. She was clearly unhappy about the day of registration pricing and was very vocal about it to the girls at the registration desk.  My manager, [redacted],  was at the registration and overheard the conversation which was clearly becoming more frustrating for Ms. [redacted].  [redacted] asked if there was a problem and if she could help her.  Ms [redacted] said the price advertised on ** was only $23 per person and it had a $10 off.  [redacted] tried to explain to her that the price was never $23 nor had there ever been a promo with a $10 off,  however, the early bird pricing in January was at $25 and the pricing went up in increments as time came closer to the event with day of registration being $40. [redacted] tried to explain to her but she cut her off and handed over her credit card and said “fine just charge it”.  The girls at the registration desk swiped her card for all 5 participants that registered.  Ms. [redacted] signed for the purchase and was asked if she would like a receipt and she said “NO”.  All 5 participants were given a race shirt & race number to participate in the run.On June 2, 2017 I received an email from Ms. [redacted] that she was disputing the credit card charges and that she had paid $80 cash for only 2 participants.  I later received correspondence from her bank disputing the charges.  I sent them the same information enclosed above inclusive of the swiped, signed credit card receipt.She again emailed me in July threatening me with Revdex.com, small claims court, etc.  She stated that she had paid with 2 $50 bills only 2 of them had run and that we had “frauded” her by charging her $200 after she had already paid.In my own in house investigation, both my staff who were present at registration concurred that Ms. [redacted] was clearly upset, had never paid cash and gave her credit card for payment. Please let me know if I can be of any further assistance to you.Regards,[redacted]

I am rejecting this response because:These people clearly have a case of mistaken identity. NEVER was there a scene. Although we did question about the pricing discrepancy, there was never a scene. The truth of the matter was when my kids saw the hamster balls they were way more interested in those then running. We have tried to reach out to these people to get it resolved and they fail to respond to any attempt of contact. On Saturday we met with an attorney. We brought with us pictures of our Clean (not muddy) kids standing next to us moms covered in mud. We also showed them a video that was taken on my friends go pro which shows us crossing the finish line with our families waiting. We are prepared to take this to court if need be. Although, I do not see why it would ever need to get to that point. The fact is this has become an our word against theirs. However, we are the ones with the burden of proof as we have pictures and video as well as witnesses to prove our case. We have asked repeatedly for them to show us proof and they have ignored all of our attempts. They cannot support their claim other than to show a receipt which no one is disputing the actual receipt. We know you ran our card, that's what we are fighting. Them providing a receipt does not deem authority to them or proof that we all ran. AND, I NEVER thought the even was free. Which tells me even more that they have our family confused with another because I specifically showed them the pricing which shows the $10 off which I have also attached to this rebuttal.
