Complaint: [redacted] I am rejecting this response because:We never gave our? approval of all the attempted? repairsThere were some that were successfully repaired, but MOST of the repairs that were attempted were never fully resolved, and we complained about them immediatelyThe squeaks and pops remain to this day, and the fact remains that even those that were "repaired" have returned, and most of those are worse than? before the attempted repairI have multiple emails, text messages, and formal warranty requests during the warranty period for the same problems stating? that these issues? were never successfully repairedWe have < [redacted] >never asked for a repair? outside of the warranty period.? In fact, we have been complaining from day? one about these same problems with no resolutionBoth my parents, nearly all of my friends, and my wife and I have all built new homes, and I do understand that there may be some issues given the number of factors involvedHowever, the problems in our home far exceed those I have experienced in my entire lifeNone of the 20+ new homes that I have been in have the floor noise that our home has, and these problems have existed since day oneThe definition of warranty is "a written guarantee, issued to the purchaser of an article by its manufacturer, < [redacted] >promising to repair or replace it if necessary within a specified period of time." Nothing should permit a business to give it their best attempt and then stop trying to remedy the problem just because they spent a lot of time and money attempting to fix the problemI expect the repairs to be < [redacted] >successfully? completed, and not just attempted, per the Eaglewood's written warranty Sincerely, [redacted]

Eaglewood Homes repaired all floor squeaks that were present at the end of the warranty periodAs I mentioned in the email, we committed to resolve the issue and we followed through with that commitment by making the necessary repairsAfter our last visit with [redacted] , neither our employees or [redacted] could locate any floor squeaksEaglewood Homes cannot guarantee complete silence of joints in the future as wood flexes and is affected by changes in humidity and temperature

We apologize for the issues you have experienced and are always more than willing to meet with you to resolve issuesI believe Taylor, our regional manager, was in the process of trying to schedule a time to meet at your house when this complaint was submittedSometimes there are small details
that are overlooked on a new home, but that's one of the reasons we provide a great warranty program and walk-throughsI know you have now met with Taylor and he is in the process of getting those items fixed, but please contact either him or I if you need any further assistance

***,As you mentioned, we have been to your home multiple times during your warranty, and even after your warranty period to address issues you had with the construction of your home Many of these issues were addressed at our expense even though they were not covered or severe enough to
warrant repair as sated in the warranty manual We feel that overall, we have met and exceeded our commitment to customer service.Please understand that the nature of a wood framed home does not and cannot allow for complete silence of joints Many parts of the construction are required to move to accommodate contraction and expansion of building materials In addition, so many factors beyond our control affect the materials used to build your home including weather, time of year, humidity, lumber yard conditions, etcDespite these uncertainties we made several trips to your home to address these floor squeaks in an effort to be faithful to our ethos of superior warranty and customer service.On our last visit with the framer, we repaired every floor squeak we could hear and had you walk around the house to locate any that remained When we couldn’t identify any more, you gave us your approval Please understand that we are very thorough with our customers to make sure they are satisfied, but we feel we have met every reasonable expectation with regards to repairing the floor squeaks in your home We deeply regret that you are not 100% satisfied with your home, but hope you recognize the extensive effort we put into ensuring your satisfaction.Thanks,Abram N***President

The particular part of the warranty is contained in section 16.3, which is on page 15 of the EaglewoodWarranty-OddPages.pdf file. We have been complaining about this particular problem since before the house was even finished and before we closed. We have continued to complain and seek resolution throughout the entire warranty period. The framing company that came out to repair the problem never adequately fixed it, and never addressed every part of the problem. Abram is lying when he says that we approved all the repairs. The only part of the repairs that we approved were those made in the stairwell. The remainder of the house still has problems and we never approved of those attempted repairs. What is the next step?
