Dear Revdex.com:Ms***'s complaint was sent to me for resolution as her purchase was handled by my department Ms [redacted] visited Earnhardt Avondale Hyundai on 1/14/ When Sales did the credit check, they referred her to my department due to the information on her credit report My Manager, Kyland R***, submitted the application to the lenders who would consider a loan with her profile Two lenders, Prestige and A-L Financial, showed the status as "decision pending", which usually indicates that the loan fits their parameters Ms [redacted] had a $13,paid loan on her Experian report and he felt the loan would be approved based on itUnfortunately, the paid loan did not offset the other derogatory credit and we were unable to obtain financing for her On 1/16/17, we contacted Ms [redacted] to advise her of the situation In the next week, she presented three possible co-buyers but they did not meet the lender’s requirements.After receiving this complaint I contacted Ms***I reviewed the file notes and agreed that the miscommunication was the result of her receiving calls from the salesman, our Loan Manager and MrR***I explained that it is not in our interest to have her take a vehicle, only to request she return it two days later I apologized for the frustration and disappointment she felt and I made arrangements to have the car towed from her home to save her a trip to our dealership I met with MrR [redacted] and we reviewed her complaint and comments so he would handle a situation like hers differently in the future.I thank you for sending the complaint as it allowed me the opportunity to explain why the decision was made to give her the keys and to apologize to her for the outcomeKindly contact me if you have any questions or require additional information.Respectfully yours:Colleen M***, Special Finance Director, Earnhardt Auto Centers [redacted]

Ms. [redacted] 's complaint is interesting in that she does not deny she owes the additional $755.46 on the loan secured by the 2006 Audi she traded. She simply asserts that she should not have to fully pay the debt she incurred for the 2006 Audi because there was an... error in the payoff number used in her connection with her November purchase. Underlying Ms. [redacted] 's position is the notion that her debt became Earnhardt's debt because of the error in the payoff amount. Ms. [redacted] 's position is legally and logically incorrect. To Whom It May Concern:The above-referenced complaint was forwarded to me for response as *** *** auto purchase was handled by my Department The matter was resolved on February 9,2015.We received an applicati on from *** *** on January 21, She was interested in
purchasing a *** *** and requested that we obtain an approval for her, which we d id, through *** *** *** She purchased a *** *** *** *** *** from Earnhardt Avondale Hyundai [EAH] on January 24, When we contacted the lender the following day to update the approval, the payment was capped at $due to her credit and income; the payment on the Explorer was $per month We attempted to get her loan approved at another lender but due to the age of the vehicle, we were not successful *** *** was contacted and given the option to keep the *** by adding a co-buyer or putting additional cash down, to switch vehicles, or to return the Explorer and unwind the contract She chose to switch vehicles and took delivery of a new Hyundai Elantra from EAH on January , Over the course of the next week, we contacted her daily to obtain the documents required by the Lender to fund the contract, including proof of income and insurance and the remainder of her $down paymentThe final stipulation was received on February 10, and the contract was sent to the Lender the following day.When the Lender contacted *** *** *** to verify her job, they confirmed that her employment had terminated on February 6, Our Funding Specialist, *** ***, reached her on February and asked for her new employment infonnation *** *** said she was still employed at *** but on weeks' vacation *** stated that *** *** check stub showed no accrued vacation and asked how she had earnedweek's earned vacation on a month job At this point, *** *** stated that she was returning the car*** *** demanded that a check for the down payment be ready when the vehicle was returned and she was informed verbally and by email that the down payment would be returned with proof that the check(s) had cleared the account and upon inspectionof the vehicle to ascertain that it was not damaged She came into the dealership on February at 8:20pm, after our business office was closed, and retuned the Elantra and took possession of her trade-in She was informed to bring in the extra key and proof that the down payment cleared her account; the copy she provided by email was notlegible.A check for $was issued the following morning, which represented her cash down payment, and *** *** was again advised that the additional down payment would be refunded with proof that the funds had cleared At 3:15pm on February 19, 2015, the check writer, *** *** ***, came into the dealership and we did a conference call with *** *** *** to confirm that the total of $had cleared his account; we issued a check for the remaining down payment payable to him and *** *** at that time.In summary, *** *** loan was approved but the financing did not go through due to her loss of employment Her down payment was reimbursed as soon as were able to ascertain that the funds cleared her account, less than hours after she returned the Elantra I kindly request that you find in our favor in this matter and close this complaint.Please contact me if your require our notes and documentation pertaining to this case or if I any be of further service in any way.*** *** *** *** *** *** *** ***

I have seen the responseI still do believe they should have done something to try to get me approvedAll I received was an oh well it's our mistakeWe still need to pick up the vehicle but you have a great daySo where does that leave me now.I returned my rental due to me having a vehicle now I am at square with no type of transportation

Dear Revdex.com: I spoke to Ms*** who stated in her rebuttal that "we should have done something to get her approved" and that is her position todayWe tried, but the lenders are unwilling to approve a loan for her because of the multiple bankruptcies (4) and auto repossessions (3) on her credit report. The purchase agreement she signed states that it is her responsibility to provide financing and any attempt by the dealer is done as an accommodation to the purchaser. In the last few months, she applied for financing with other auto dealers and was turned away. Ours is the only dealership who tried to assist her Ms*** has been renting a car for 60-days and stated that she will have to do this again. For the days she drove our car, she did not have to pay for a rental and since she did not have insurance, we advanced $so she could pay for a policy. This saved her over $500. We did everything in our power to assist her in purchasing the car but the decline of the loan was based solely on her credit historyI respectfully request that you close this complaint, but please contact me if you require additional information. The Service Director at Earnhardt Avondale Hyundai, Inc. reviewed Ms. [redacted] concern.  The engine issues Ms. [redacted] is experiencing are the result of sludge build-up in the engine.  They are not  warrantable as a result of the failure to maintain the vehicle. ...

The statement in Ms. [redacted] concern that [redacted] added 5 quarts of oil to the vehicle reveals the lack of maintenance.  Five quarts is the total amount the engine holds.  Typical oil consumption is 1 quart per 1000 miles.  The dealership requested that Ms. [redacted] return after 1000 miles.  She did not return until she had driven another 2000 miles, but the oil was down 3 quarts after that mileage.  There is evidence the oil consumption issue is caused by the lack of maintenance.  The dealership has requested maintenance receipts from Ms. [redacted], which she has failed to provide.  The dealership regrets any confusion in the communications between the service advisor and Ms. [redacted].  That confusion, however, does not change the fact that the current problems with Ms. [redacted] engine are caused by sludge built up from lack of maintenance.  [redacted]General Counsel

significant  inequity in her trade vehicle, and the limitations on down payment, caused that result to be beyond the dealership's reach.   More than one finance manager attempted to obtain the financing Ms. [redacted] sought.  The second manager did not see the note about limiting the number of banks to which Ms. [redacted] credit was submitted.  The dealership apologizes for that error and will write the credit bureaus and request removal of all of the Earnhardt [redacted] inquiries.   Earnhardt [redacted] is not in a position to respond to any aspect of Ms. [redacted] concern involving [redacted].  [redacted]General Counsel

Be careful buying a used car from here because they don't do all the inspections of the engine in the car and when you go back after owning the car a month and there's issues they say oh well that's not our responsibility we don't go over everything before we sell them. We now have to pay money to have our car to get an alignment and fuel system done. We at first were happy with them getting us a car then these little things started happening to the car
