As the owner of a small landscape design company, I was hired by the complaintant as a favor to my niece who was his hair stylest, to do landscaping since I do not normally work in this area.
Once hired, I did everything I promised to...

do within my power, plus a whole lot more. In the process of the job I was hired for, the complaintant had major plumbing problems, causing them to have to tear up a large portion of the front yard. We not only worked around this situation we also had to grade and clean up what the plumber had left that was not in my bid nor did I charge them.
The complaintant turned very rude to me when three shrubs did not come in as large as they had hoped. I re orderd these plants twice and each time they were the same size as that's all that was available in the Midwest at that time. This is when the complaintant, who is an attorney began to tough guy me. I have letters, emails and text messages to back this up.
When the job was completed, professionally and properly the copmplaintant refused to pay his bill in full due to the fact that I could not finish his sod due to the plumbing problem. I removed the cost of the sod we could not lay, 50.00, as we got 95% of it down. This is when the complaintant told me he was going to hold 200.00 not 50.00 from his final payment to insure my return in 2014, making his bill still with an outstanding balance for completed work from October of 2013 of 200.00.
I also spent 48.00 of my own money to try to disguise the pile of clay and dirt left by the plumber for Halloween with no Thank you only a rude remark of how excessive that was to spend, and I wasn't even charging them for it and they were aware of that fact!
As for the 3 plants that they are speaking of, due to the winter of 2013, I have not been able to obtain any larger shrubs then last year and was still trying to accomplish this when the complaintent started to threaten me. There was a major loss at ALL growers in the Midwest this winter due to the sub zero temperatures and we are all trying to obtain these plants elsewhere. I told the complaintant this spring I would be out within 10 days to see his home, we then have had snow, rain and cold for three months and as he is so far from my area, it was not possible for me to make it in ten days, that's when the threat came without a chance to explain.
I have been in this business for 25 years and on my own for 10, and have NEVER worked with such an unreasonable and mean spirited family, and for this reason I told them to keep the 200.00 I was never paid and hire someone else.AS for me not honoring my warranty, it is good until Nov. of 2014 so I had not blown that off as it is still within the warranty time period. We did loose a lot of plant material in zone 5 this winter due to the extreme cold in our planting zone and as my warranty states I DO NOT cover plants lost due to Mother Nature. I don't think I could do anything to make this client Happy at this point and would rather not have any contact with him as he is a very mean and scary man. I will be happy to allow him to keep his 200.00 from the unpaid invoice from November of 2013 to keep myself or my crew from having to deal with this family again. Again as I stated I have email and text messages to back up how hard I tried and how unreasonable my client was. I would also be happy to supply you with ALL of my past clients names and phone numbers so you may see yourself just how hard I stand behind my work and my work ethics, this is just a client that happens to feel that because of his occupation he can scare and intimidate a woman running a small business. I cant even take this personally as I'm sure I am not the first business that this client has reported or shorted monies from in the past.
