We employed Earthworks to extend and asphalt our drive The work was not done on time and when we complained about this the owner of the company threatened to sue us The work was of a very poor quality Earthworks did not respond to our concerns now six months after the earthworks were last on site we are forced to have the entire job redone We have left telephone messages and sent emails and have received no response

Customer satisfaction is very important to me In this extreme case I do not believe I am in the wrongThings with Angie did not go as planned I doubt you have any photos of these issues (the ruined grass, a receipt of payment to the contractor)? if so I would like to see them I did break the plastic trim around the the patio door while I was leveling the top step(see photo) I hired and paid a contractor to come to Angie’s house and fix the door His price was $plus I would have to order the door I ordered the door costing $(If Angie paid him I do not know) This contractor told Angie he could replace the small crack in the door trim for $She insisted on a new door stating the a repaired door would not be identical to the original There would have been NO COSMETIC OR FUNCTIONAL DIFFERENCE if the door was simply repaired The contractor began work on Angles house While working her boyfriend verbally and physically threatened the contractor He refused to return to the house claiming the worksite was unsafe The contract Angie and I signed does state that the second half of payment would be received after the work is completed In a txt message she refused to pay me the second half even if the work was done This is a clear violation of the contract I would expect to be paid when everything was completeI have installed 85% of the project and I have only received money for the material Angie claims I killed grass I do not believe her yard to have been damaged The machine we used puts down lbs of pressure per square inch of space There where no ruts or dead grass when I left the job site Angie claims I have not finished the steps You can see a photo of the steps below Angie increased the size of the steps twice, doubling the amount of block and labor required(for which I have received nothing) She also stated “She did not like” the granite cap placed on the tops of the steps only after I had ordered this product two times and she had seen what the product looks like These solid granite squares are the most expensive option for the tops of the steps Angie claims I want more money I do not want more money I will not continue to work on her project knowing she has no intention of paying me in the end We do have a signed contract with a completion date Unfortunately, her stating she will not pay me is a clear violation of the contract and no-one deserves to work for free

I am rejecting this response because: I have an invoice from the contractor and pictures of the ruined grass, along with pictures of the steps being installed incorrectly which was determined by another landscaping company that has been around for over yearsThe grass that was ruined was from him cutting the granite pieces in the grass when there was plenty of space to do that either in the ft easement behind my house that did not have grass or right next to the patio in the dirtOr, he could have put down a board to cut onI have attached the invoice for the door, installing the door, and the invoice from the other landscaping company that said it all needs to be redoneI will get the pictures of the grass loaded to my computer and get those sent as well. The contractor that was supposed to fix the door told me he was charging $He never told me that he would replace it for $He told me that it could not be fixed, that the whole door had to be replacedMy mother was there at the time he said that, so I do have a witnessThe contractor texted me on July 4th concerned about the storm that was coming through because he had already removed the siding from my house and it was laying on the groundI texted him back and said the siding was fineHe still came over to my houseI had other people there that day and we were all sitting outsideMy boyfriend asked him why he didn't accept his help the Friday before to get the door installedThe contractor said, "It doesn't matter." My boyfriend said, "It does matter." This was repeated twice and the second time my boyfriend said, "It does matter," he did raise his voiceIt was not threatening or physically abusiveThe contractor was not anwering his questionThen the contractor walked away and said "I will drop off the door tomorrow." My boyfriend did not verbally or physically threaten the contractor whatsoever! I have witnesses that will attest to thatAll we wanted to know was why he wasn't showing up to install the new door when he said he was going to and why he didn't take the free help when it was offeredThe contractor never did drop off the door the next dayThat is when I was fed up and told Jake I wanted the door and to be done with all of thisI ended up having to pay for the door myselfWe also had to rip out the steps because they were not done properly, nor were they built with blocks that were appropriate for stepsThis is per two separate companies that I talked to that have excellent reputations in FargoWhat I want is my money back for the poor job that was done and for the cost of replacing the doorI am not in violation of the contract because he says it will be completed to 100% customer satisfactionI am not satisfied with the job at allIf the job was done to my 100% satisfaction, I would have paid for the entire thingWhat I told him was:You quoted $for prepping around the house which was not done and we ended up doing that ourselvesI still owed $So my calculations are as follows:$2197-650-(door)-(installing door) = -$353 There were also extra pavers that are included in the $total that I do not know the price ofI told him prior to sending this calculations that if he left the door and the pavers, we would call it good because at this point, he owes me moneyHe did not like that response and told me I still owed him moneyI was willing to settle for that when I did not know that I needed to redo the stepsI am not willing to settle for that any longerI want my $back plus the $I had to spend on replacing the door
