On February 9, 2015, I entered into an agreement with Ms. [redacted] and received a check for $12,000.00. This money was to be used for rental equipment, concrete for footer, a foundation for a 2 story garage, and to obtain permits which took 8 trips to the Hendricks's County Government Building &...

2 trips to Chicago Title. In Ms. [redacted]'s letter, she states that there was not a permit, however, permits were obtained, and are available upon request. Ms. [redacted] was unable to take the time off work to obtain the permits herself, and agreed to pay for the time it would take me to do it for her. In regards to the garage, I called for a line locate on 2/9/2015 to operator S. [redacted] at the Markrite Line Locating Company after meeting with Ms. [redacted] and receiving the check for $12,000.00. This line locate information also went out to One Call Response and Marathon Pipe Line LLC. After 48 hours, you can dig. Markrite & Marathon confirmed no lines in the dig area. Work was then placed on hold for 3 weeks due to the weather and the ground being frozen. On 3/11/2015, the sub-contractor, Earth Creations, digging the foundation, hit the 1" gas service line. I was called by the Earth Creations and informed of the gas line event. When I arrived on the property, the fencing contractor & Vectron Gas Representative told me that the homeowner had been told to get out of the house and had not yet left. At this time I went to the door and told the ex-brother-in-law & homeowner's sister that they were in danger and needed to leave immediately. They said to give them 5 minutes and I told them they needed to leave now, at which they put on jackets and left the house. The Vectron Gas Company then sent me a picture of markings of yellow paint taken prior to digging, but they had come off due to snow and rain. They sent me a bill for $800.00 and I paid it. Digging for the garage footer and foundation ceased after this event.Prior to the cancelation of the garage & before the gas line issue, it was decided that the garage had to go back 8 feet more from the original building location in order to make it 24" x 32" (this was a change to the original contract). With this adjustment, a walnut tree was in the way that would have to be taken down. This would be an additional $1800.00. Ms. [redacted] then hurt her back and wanted to put the garage on hold in order to proceed to adding on a master bedroom & bathroom at the screen porch area of this home because she had been staying at her home in the [redacted] of Danville and wanted to move into this Brownsburg home & sell the [redacted] home. This is where 3 more trips to the Hendricks's County Government Building were needed to obtain additional permits and information. At this point in the project, it was discovered that with the addition of a 3rd bedroom, she would need a bigger septic system or tie into the city sewer. I had given Ms. [redacted] paper work from the Hendricks's County Planning Department with the names of engineers and contractors that would be required for this project. Upon learning of this information, she said she needed to sell her [redacted] home in order to do the renovations to the Brownsburg home.In regards to yard damage, we had agreed to wait until the ground thawed out to bring in fill dirt to level the ground, fill the trench for the garage footers, & fill the ruts from the equipment used to fix the gas line. However, when I had someone to go out to fill the garage footer trench it had already been done.In regards to the fence, Reed Construction was sub-contracted to install the fence. The fence did contain her & her ex-brother-in-laws 3 dogs that were on the property dogs. Ms. [redacted] informed me she had 2 other small lap dogs (that I haven't seen) that were able to get under the fence in several areas. We installed field rock in those areas. Her ex-brother-in-law informed me that the field rack worked for containing the small lap dogs.Reed Construction was also sub-contracted to demo the second floor bathroom. They took the extra fence material back to Menard's and exchanged it for cement board for the bathroom floor. [redacted] Construction did the remodeling of this bathroom. Ms. [redacted] states in her complaint that "the same gentleman's (who did the fence, Reed Construction) was fired. This is untrue. Mr. Reed had a big project he wanted to do, and had only been hired for the demo. Ms. [redacted]'s complaint also states they were without a bathroom for 4 weeks, however, they did have a full bath and a half bath down stairs. The upstairs bathroom remodel took 2 weeks. At the time, Ms. [redacted] was living in her [redacted] home. Ms. [redacted] states how poorly the tile was installed. I had asked Ms. [redacted] on 3 different occasions how the bathroom looked, 1) how did the floor look, to which she stated "I am very happy with the floor, it looks very nice and straight", 2) when the cabinet, sink, & toilet were installed, she said that made her very happy, and 3) when we installed the tub, tile, & border, she had asked if we were going to put one more tile above the border, and I told her we were going to go 6 inches above the (tile) border. That's when the ex-brother in law had told us to use a full tile per Kathy's request. She had noticed a few of the tile spacers had fallen out and the tile had slipped. She informed me of this and the tile was straightened before being grouted. The tile in the corners had to be cut at an anglebecause the house is old and the walls aren't square. The caulk used was a tub & tile silicone caulk, not a painter's caulk. Ms. [redacted]'s ex-brother-in-law told me he was a Master Painter, and was painting the inside of the house. I do not know if he painted the bathroom after we completed it and maybe used a painter's caulk, but we did use a tub & tile silicone caulk. We did chip the bath tub & tried to repair it. I had forgot to mention this while we discussed Ms. [redacted]'s finances and that she would be having her ex-brother in law finish the bathroom. The tub is metal and the chip is about the size of 14 a penny. I can and will repair this at my expense, which is about a $50.00 to repair.In closing, Ms. [redacted] had told me she could not afford 2 house payments, paying the ex-brother in law to paint, 2 utility bills, and keep going the way she was, needing a 3rd back surgery, that she couldn't afford her family using her, etc. She stated she was afraid of going bankrupt and that this project was costing her more than she thought. I was never told I was fired. I told her I understood that things can happen and that I would put numbers together to come up with a refund for her, and that I would need a couple weeks. She had said okay.I did receive a phone call last Thursday from her ex-brother-in-law wanting to know if I had come up with a number yet, and final itemized bill. I told him I was close to finishing it and would type it up. I told him if I did not have it by last Friday, I would have it Monday (today). I did call her today, 4/27/2015, around 10 a.m. to tell her I could talk to her around noon. The Revdex.com email complaint came at 11:38 a.m. I did not receive a return call from her.I returned her Whirl Pool tub and they credited her Menard's card. I did review the charges with Menard's upon learning of the discrepancy she is reporting, and she is to have a meeting with the store manager, David, for her answers. We did not find $4000.00 in charges that are unaccounted for.As of 5/1/2015, Ms. [redacted] and I have had a couple missed calls to each other. Her ex-brother in-law calls me, however my contract is with Ms. [redacted]. I have a refund check for her in the amount of $5252.00. Monies from Ms. [redacted] include $12,000.00 for garage, $1200.00 for fence installation, and a $32.37 rebate from fencing material which amount to $13,232.37.Monies paid out include:$1430.00 for fence installation.$1450.00 for portion of garage foundation dig out by Earth Creation.$1250.00 for equipment rental.$350.00 for gravel.$1400.00 for upstairs bathroom labor.$200.00 for removal of debris from back porch.$1400.00 for 8 trips to Hendricks's County Government Building & 2 trips to Chicago Title(time & fuel).$500.00 for drawings of 2-story garage, master bedroom & bath, and measuring out of eachroom for water department related to septic issue on number of bedrooms.I do still have her key, I had forgotten it was on my key ring. I am not sure which key it is as I take care of several locations, but with permission, will go to the house to determine which key is hers and return it.Sincerely, Tim [redacted]

To Whom This Concerns, Upon being invited to (see email attachment),then arriving at the [redacted] location on March 2,2016,at approximately 4:55 pm,we went into the church and were met by [redacted]. He informed us the meeting would be in an out building next door to...

the church.We went to this building. [redacted] didn't come to the building at this [redacted]e. His wife,[redacted],was In the building eating a mealso we waited and had some small talk during this [redacted]e.   [redacted] joined us about 10 minutes later. He paced the room a bit,then [redacted] left,then [redacted] (Ibelieve to use the bathroom in the room). Then a man arrived,Idon't recall his name,but after more small talk,Iasked what he did. He said he was a science teacher for the 7ttt grade. Ithought about this for a few minutes and turned to [redacted] & [redacted] (my husband) and said "Ididn't know we were going to have people here,we could have brought [redacted] (our attorney,although Idid not say"attorney" aloud)." [redacted] stated,while leaning over the table "It'll be fine". Istarted to feeluncomfortable at this point,but we had met with the [redacted]s another [redacted]e, with another couple as their witness,which went fine,so Ididn't want to worry needlessly. Before the meeting actually started,[redacted] said a prayer,with the finalwords being the meeting would be "honest and truthful." He asked us if we wanted to go first,Isaid No,you go ahead",to which my husband,[redacted] started talking,if Iremember correctly,saying why he was asking for a reduced amount,as stated in an e-mail. Ire-clarified the reason for the meeting being about payment and if they were going to pay him, and at this point [redacted] stated "No" and their reasoning consisting of the contract not being fulfilled,and sticking to the "original" contract. After more talk amongst us which is hard to recall word for word,I stated to [redacted] a couple [redacted]es" This has been deceitful,we sent you an email and you said the meeting was to finalize payment, and,You have been deceitfuland wasted out [redacted]e,knowing you weren't going to pay you could have told us by email. Ialso mentioned the meeting months prior at their home in which they had a couple be their witness that went well. Then,3 people entered the building, 2 women and a man ([redacted] told me after the meeting that one of the two women was [redacted] & [redacted]'s daughter,a minor).The man,probably about 250 pounds sat to my left. My husband was on my right. Iasked what was going on and [redacted] replied Oh,we're going to have witnesses". While Iagain stated we had been deceived,the man sitting next to me said "that will be enough of that kind of talk". Istated to [redacted] and [redacted] "we're done,we're leaving" while during the same [redacted]e,[redacted] stated to the man {Iwas between them) "who are you to talk to my wife like that". The man stated either" sit down or settle down" to my husband. Iheard mv husband say "Iam sitting down, who are you to tell me what to do, but Ican stand up" (or something along the line). As [redacted] stood up,the chair kept him wedged place and he pushed it back to·stand up ([redacted] has accused him of throwing the chair). Ikept telling my husband to leave. Both [redacted] and the man were both up and about a foot apart from each other having a kind of stand-off. ll<ept Pttlling & pushing [redacted] to leave. The science teacher came over and stated "in the name of Jesus Icommand this/you to stop". I said "this isn't Jesus who did this,it was your pastor" but kept my attention focused on getting [redacted] out of there so there would be no further incidence. [redacted] did yell things to [redacted],including curses,while Iwas focused on getting him to leave,stating "it wasn't worth it,If he hit somebody he would go to jail and that is what they ([redacted]) wanted,(based on how the [redacted]s set up this meeting. Iphysically pushed & pulled [redacted] out of the building. [redacted] called the police,Irealized this when Iturned around from getting [redacted] In the truck and [redacted] was walking along side our truck and looking at it, then reading the license plate over the phone. We stayed at the scene as to not be accused of fleeing or further wrong doing. I have enclosed a picture of this, which also shows the man who sat next to me,not next to [redacted] or [redacted]. The police arrived and spoke to us separately. We were told it was a civil matter and needed to take care of it as such. we then returned home. The morning after this meeting,we received an email from the Revdex.com, regarding [redacted], requesting termination of the contracting and wishing to warn people of [redacted]'s temper (see attachment). Then on Saturday,March 5, we received a letter from his attorney (attached),then again on Sunday morning during church service to confirm we had received the email on Friday. He also called our church pastor twice. Once he left a message. When it was realized why he was calling,our pastor said he wasn't getting involved because it wasn't a church issue,but then informed us that [redacted] called again & did listen to him,and inform him he hadn't seen the behavior described by [redacted].  We don't understand the need he feels to continue to pursue [redacted]. Being untruthfuland deceptive are very unchristian like,especially for a pastor. While we don't disagree with anyone contacting the Revdex.com,not telling the whole truth is an issue. This meeting was set up on church grounds. We could have been advised of their intent to have 4 other people show up to the meeting, to which we would have opted resolution in a peaceful,legal manner with a legalmediator,not involving other church members in a non-church based situation as [redacted] did. If [redacted] had felt it would be necessary to have 4 other people at the meeting because he thought there could be a problem he would need witnesses for,then the meeting should not have happened at all. Had he been honest in his intention of the meeting, we would not have even come. He manipulated the situation and was deceptive in his intent. This is certainly un- Christian like behavior,especially coming from a pastor. It is also concerning that he would bring members of his congregation Into such a situation. We are Christians, and were seeking what we believed to a fair settlement. In regards to the letter from [redacted]'s attorney, we feel you should know that we have no intention of approaching anyone from the [redacted], and would not even had been there had [redacted] not invited us (or them). Upon receiving notice from the [redacted]'s attorney, we have our attorney on the matter now and will proceed legally. Thank You [redacted] & [redacted] Eason P.S. While trying to keep the personal vs. church aspect of this situation In perspective,here is a short background of some factors that happened prior to this meeting. We had met with the [redacted]s on an occasion prior to the holidays when problems became apparent with their home floor,that weren't evident at [redacted]e of completion. At this meeting at their home,I went with [redacted], as his witness to take notes,and they had informed us another couple would be there. This couple was very helpful, information,and fair. They even provided information pertaining to the problems with Pergo floor. [redacted] was willing to take $4000.00 out of his retirement to rectify the problem. When we saw issues with bowing in the dining room floor, and cabinets coming away from the wall, and boards separating that weren't there when the floor was installed,we suggested a structuralengineer to look at the home structure. Upon our follow up,It was revealed the [redacted]s had gotten information regarding the deterioration of their home's band board & other underlying structures rotting and having been sprayed with insulation,which were missed by the home inspector,and at this point we do not know the full details,but the [redacted]s have es[redacted]ates ranging from $3000 ([redacted]) to $20,000 to fix their home. When we realized this was a factor in fixing his flooring, we sent a letter requesting payment for work completed,as the faulty flooring wasn't [redacted]'s fault.
