Good day, I am writing in response to a Second Notice that we received regarding a complaint filed by [redacted] about our service Firstly, please note that we did not receive the initial notice regarding this complaintThis is the first opportunity that we have had to respond to this Response :- When we received [redacted] boat in Newfoundland, it was secured on his own boat trailer and was covered with a fitted tonneau cover, typical of most boatsOur driver did a visual inspection of the exterior to ensure that there was no existing damage to the hullWe did not have access to the interior, nor any part of the boat that was concealed by this fitted cover, therefore we did not inspect this area, nor have any knowledge of the condition of the contentsIf this alleged damage was caused by the flapping of this cover, then this is not a result of our neglectThis cover is prone to flapping at kms per hour regardless of how it was positioned on the trailerWe have no control over that While we do not have a picture of the boat while it was travelling on our trailer, we can identify the position on our trailer by referring to the photo attachedThe boat was transported on the lower deck of our trailer, in the same position as you see the front end loader in this sample photoThe distance between the trucks exhaust and the boat makes it impossible to be affected by any heat from the exhaustFurther, as general knowledge, there is no possible way for any truck exhaust to damage any freight being transported, otherwise all freight being transported like this would be burntThis is a ludicrous notion, and one that is unheard of within our industry Attached you will also find a copy of the Bill of Lading ( BOL) for the transportation of this boatThis will confirm that we delivered the boat on July 12, without any recorded damage or concernsThe first contact from [redacted] wasdays lateron July 22ndby way of an e-mail to our Dispatcher, [redacted] (see beginning of e-mail trail below) The carriers liability ends on the day and moment of deliveryAnything could have happened to this boat within the days between our delivery and the initial contact from [redacted] on the 22nd I can see in the “ Additional Comments from Customer” within your document that [redacted] states that he did not hear from our companyAgain, referring to the email trail below, you will find several emails beginning on July 26ththrough to August 1stwhen we advised [redacted] of our position regarding this claim This is the first complaint that we have received from Revdex.com regarding our service in years of business, so I am not familiar with the protocol from this pointGiven the facts provided and the position that we have taken regarding our liability, I am asking that Revdex.com support our position and have this complaint be stricken from our file Please acknowledge receipt of this response for our files Best regards, [redacted] President, East Can Transport Services Ltd Phone: [redacted] Fax: [redacted] Email: [redacted]

I am rejecting this response becauseThe businesses assertion that they did not have access to view the cover or around the back edge where the damage was cause is not correctThe cover was fixed by snaps and bungee attachments to the boat and was easily viewableIt is designed to be towed with the bow facing into the wind allowing the wind to move around the boat as it is towedIn this case the boat was loaded backwards onto the trailer and this allowed the wind to catch the cover causing the damageThe pictures before Eastcan transported the boat clearly shows no damage in this areaMy assertion is Eastcan was negligent in loading the vessel onto the trailer by putting it on back ward, negligent in not putting additional covers over the vessel to ensure no damage during transport thus responsible to pay for the damagesI did not arrive in Ottawa until 19th July and did not inspect the boat till July at which time I notified the companyDuring this time the boat was not moved from the spot where Eastcan delivered the boat thus no damage of this nature could occurI assert that East can is responsible for damage caused when transporting the boat [redacted]

This cover is prone to flapping at 100 kms per hour regardless of how it was positioned on the trailer. We have no control over that.

Given the facts provided and the position that we have taken regarding our liability, I am asking that Revdex.com support our position and have this complaint be stricken from our file.
