This complaint is largely repeatative of the first complaint received. The move-out inspection was not scheduled by the resident and was performed in their absence. A copy of the inspection, the final statement of account and a payment plan option was sent to the forwarding address provided upon move-out. Additionally, the same correspondence was copied and given to the former resident in person on 12/29/14. Again, as the community incurred expenses well beyond wear and tear and such expenses are well documented, the damage deposit was applied to said damage and no refund is due. Charges beyond the damage deposit are owed as previously explained to FCO Collection Agency

If they did the move -out inspection on 12/1/14 as they claim, why did they not inform me?  Also, as a matter of fact, there was no damage to the carpet at the time I vacated and that is why they do not have any proof of it. 
Therefore I still stand by my original complaint.

Mr. [redacted] gave formal, written notice to vacate his apartment home at East Chase Apartments on 8/29/14.  When asked why he was vacating, he stated he needed a larger home.  We did not offer an inter-complex transfer, as he resided in the largest home on the property.  An...

acknowledgement of the notice was sent immediately with instructions for vacating, estimated move-out charges and how to schedule the move-out inspection.  Upon receiving this correspondence, Mr. [redacted] and his wife returned to the office requesting that they be let out of their lease early which we had to deny to be uniform in our practices and to comply with Fair Housing laws. 
The couple reported a mold-like substance in the home later in the day on 8/29/14 and again on 9/17/14.  Our maintenance supervisor was dispatched immediately and found small amounts of mildew in the home due to extremely humid conditions.  The areas were cleaned with bleach, primer and touch-up painting.  The residents were instructed that using HVAC system is necessary to circulate the air and remove humidity.  The temperature inside the home on both visits was over 90 degrees and the walls were literally sweating from humidity.  Mr. [redacted] was advised that they were causing this situation at that we were fearful the conditions could escalate.  A copy of the mold addendum in their lease and our company's tip sheet for preventing mold and mildew was delivered to the home as a reminder for compliance.
Mr. [redacted] vacate the home as scheduled on 11/30/14 and turned in his keys to the office.  No move-out inspection was scheduled, so the inspection was performed without his prescence on 12/1/14.  The home was found in good shape with the exception of one stove drip pan and the carpet.  It appeared that a bleach substance was used as a spot cleaner on the carpet.  There were numerous bleach spots in carpet throughout the entire home.  The carpet of the home was new when the resident took occupancy on 11/2/13 and the carpet could not be saved.  Notations were made on the move-out inspection along with a bill for the carpet, less the homes damage deposit which was applied.   All was mailed to the forwarding address provided on 12/1/14.  Our replacement cost was $1083.10 on 12/9/14 - we charged Mr. [redacted] $737.76 for the carpet, $13 for the drip pan and applied the $400 deposit leaving a balance due East Chase of $350.76.  East Chase will not waive these charges.
Mr. [redacted] came to the apartment office at closing time on 12/29/14, first asking for his deposit and second asking to see the damaged carpet.  As this was a month after vacating, the carpet was already replaced and the home occupied by another resident, making it impossible to perform a second move-out inspection.  Mr. [redacted] stated that he would not be paying the balance due and demanded his deposit in person on 12/29/14 and again in writing on 1/5/15.  As this is an uncollectable debt for East Chase, this account was sold to FCO Collections, which can be reached at ###-###-####.  East Chase can no longer accept payments on the account.

As the property manager mentioned, there was mold in the apartment and that was the reason I had to vacate the apartment. Naturally, the landlord will try to put the blame on the tenant, but it is very unrealistic that someone would run the thermostat at 90 degrees Fahrenheit during summer. The apartment has improper venting and circulation because the cool air circulation was not uniform throughout. One of the bedrooms cooled very quickly while the others remained relatively hot during summers. Also, there was some mold like stains at some places on the ceilings even before I moved in and I mentioned the same on my move- in condition form which was signed by both the parties. I believe the apartment was already mold infected and it was a recurring problem.  I brought this to the attention of the maintenance crew and told them that the improper venting and circulation could be triggering the mold again. They tried to put the blame on me and gave me some recommendations which I was already following. I already lived in the same community for two years in a single bedroom apartment and am very well aware of their mold policy. There was no problem whatsoever in the one bed apartment and the problems surfaced when I moved in to this two bedroom apartment only because it was already infected by mold.
I was afraid the mold might cause any problems to my new- born baby.  I had no choice, but to move my family to different community. I still kept the possession of this apartment for the remaining two months of the lease just not to break the lease. I am telling this because I have already endured a lot of inconvenience and financial loss without a fault of mine.
While vacating the apartment I followed all the due procedures. After my notice to vacate, East Chase sent me a letter with move- out information and stating that they will schedule a move- out inspection. However, they never ever scheduled a move -out inspection. I duly vacated the apartment on 11/30 as per my initial notice and personally handed over the possession of the apartment to East Chase staff. I also informed the lady about the missing drip pan on the kitchen stove and she told me that I can either replace it myself or let them do it against my security deposit. I chose to let them do it. 
I have not heard from East Chase after I vacated.  Couple of weeks after my vacating I went to their office twice within a span of one week  to demand my security deposit, but they were closed before their published timings on both the occasions.  On 12/29/14, I was able to meet their staff and fortunately the property manager as well. That is when she brought up the carpet damage charges. I lived in that apartment for just over an year and there could be nothing more than normal wear and tear. I was very confident and strongly requested her to show me the damage. She denied it outright and threatened to send the charges to collections which she eventually did. 
As claimed by the property manager in her response to my complaint to Revdex.com, we never used any bleach substance as a spot cleaner on the carpet. Also, in her response she said a move-out inspection was done on 12/1/14 in my absence. Had they informed me I would have been present.
I once again request to waive off the charges and refund my security deposit. I agree to pay $ 13 for the kitchen stove drip pan out of my security deposit, though the landlord is not entitled to hold any portion of my security deposit because of the violation of Kentucky Law KRS 383.580, which states that the landlord should inform the tenant of all the details of the account where the security deposits are deposited.
