Initial Business Response /* (1000, 5, 2017/09/28) */
In response to *** description, Upon completion of the driveway done by East Coast in there were no initial issues and the invoice was paid in fullAfter sometime the *** had some concerns with pebbling asphalt in areas which
the foreman at the time mentioned if they were having issues that he would come in the spring to do a repairIn addition we have made additional trips to the home to try to resolve any issues that may have come up as well as doing the annual sealing maintenance free of charge twice and plan on fully satisfying the two year repair warrantyIf there are any further repairs needed to be done to the driveway prior to the warranty's expiration we will be happy to make a return trip to repair and at no time mentioned we would not do anything furtherWe hope to be a help moving forward
Thank You
Management
Initial Consumer Rebuttal /* (3000, 7, 2017/10/02) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We do not accept this response of East Coast PavingThe job was seemingly complete and the ash fault was still wet when the foreman insisted on his paymentPayment was madeAs the ash fault cured the issues become very apparentThe entire center of the driveway was not curingThe pebbles were loose and there was nothing holding that area of the driveway togetherWe immediately tried to contact the company but our phone calls were ignored until later that winterThey came and assessedThey stated they can not seal the driveway until spring but assured us that sealing would fix all the issuesThis was not the caseAll winter the pebbles wore away leaving a dusty uneven surfaceAfter sealing the pebbles continued the flake away from this dusty area and many weeds began growing through another area of the driveway revealing more issuesAgain the company was contacted and they suggested a solution of heating the area and tampering itThey did not do thisThey simply sealed the driveway yet again and where the weeds were growing through they dug out the cracks and covered the area with a tub of tarAfter further complaints the company told us they will do nothing further as under the law they are not required to do anythingWe were told we can have it recapped at a cost of many of thousands of dollars to usIt was clearly stated they would do nothing further for usThis company openly admitted to having issues with their ash fault supplier "Ocean" whom were trying a new environmentally friendly formulaAs well as admitting they fired the foreman of this jobClearly this ash fault was faulty and they made promises to make things right with their customersWe have a very expensive deteriorated driveway with unsightly weedsI feel they are stretching this out to get past the year warranty which is fast approaching
Final Business Response /* (4000, 9, 2017/10/10) */
We tell all of our customers that if they are happy its payment upon completion, which the driveway looked fine, asphalt is not wet like concrete there is no water in asphalt, it oxidizes over time but all asphalt doesWe are under new ownership and because of that changed our staff and no one was firedWe decided to honor the previous owners year repair warranty which we have continually fulfilled on this propertyI would like to quote two individual parts of our repair warranty#" Any cracks larger than 1/8-inch wide will be filled with crack fillerTire scuff marks/pebbling will be heated and re-tampedThese repairs can be visibleThis Unconditional Warranty does not include damage caused by gas or oil spills, puddles on a surface with less than percent grade and wear and tear." #Acts of nature that can cause damage to your pavement are as follows and these will not be covered under this warranty: ground movement, drought or compaction of the earth's soils, root systems of surrounding landscapes, (this includes all vegetation) oxidation through ultraviolet rays, and ground water under pavement causing undue moisture of pavement base. Not only have we honored the above but have went above and beyond covering acts of nature with vegetation repair at no additional cost We East Coast Paving will continue to fulfill if requested our repair warranty up to its maturity date
Final Consumer Response /* (4200, 11, 2017/10/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
And from your website I quote
Frequently asked questions QI have vegetation growing up and through my drivewaywhy? Answer:
Unlike many of our competitors, we study and identify barriers at the baseOur mission is to put in a driveway that will last years
QThe edges of my driveway are starting to crumble, why is this happening?
Answer:
Unlike most of our competitors, we think in terms of decadesOur installations include a degree angle trimmed and a "tamped edge"
QWater is pooling in my drivewaywhy is this?
Answer: Unlike many of our competitors, we take painful precautions to implement a degree grade on the top dressingThis prevents pooling and allows for proper drainage
Bottom line is your company admittedly used a bad batch of "environmentally friendly" experimental ash fault provided to you by "***"Why are you not replacing this faulty driveway

My offer to the homeowner was that I would come back and fix the driveway and they agreed to itI am still willing to do thatAs far as an apology, I feel they owe me one tooWe both acted irrationally

Revdex.com:
I have reviewed the response made by the business in reference to
complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
On Friday July 10th I received a message from the
secretary asking that we get back to herMy wife and I were on vacation and cell
service was not working very well but we were able to send text messagesWe
sent the secretary a text message on Saturday July 11th at 9:
letter her know we were on vacation and asking what the message was pertaining to
The secretary wrote back that it was in regards to fixing our drivewayI let
her know that we would call her as soon as we were home
On Monday July 13th I received a message from the Revdex.com
in regards to the owners response to our claimThe response that I got back is as follows "My
offer to the homeowner was that I would come back and fix the driveway
and they agreed to itI am still willing to do thatAs far as an
apology, I feel they owe me one tooWe both acted irrationally"This very brief response reiterated what I
had shared in my original claim that the owner stated he would fix the driveway, but we were never contacted as to what this fix would beThis was stated to us over three weeks ago and no one from the company contacted us until this latest call. Due to us speaking
with other paving companies, we are aware that the only fix for the problem
created by East Coast Paving is to rip out the poorly create new section to our
driveway and then put a new sturdy base in and then repave this sectionIn regards to the statement about my wife and I as customers
owing him an apologyI was not aware that a customer merely questioning a business’s
work after a defect has been detected constitutes as irrationalA business
owner coming over unannounced and yelling at customers telling them they are
liars is what I believe to be irrational behavior
I contacted the secretary on Monday July 13th at 12:
in regards to her message about fixing our drivewayThere was no answer so I
left a message letting her know that she can contact me at any point as we are
home from vacationThere was no word from her on MondayI called again on
Tuesday July 14th at 12:and I left another message to have her
get back to me about fixing the driveway
At 1:pm on Tuesday July 14th, the secretary
returned my phone callShe let me know that the owner is in the hospital after
having surgery and has called off his crew until at least the start of
AugustShe said the fix would have to occur after this pointI inquired as to
exactly what this fix would entailShe was not sure of this information and
she said she would have to get back to me regarding this information
The
only way to fix the driveway according to two other companies is to remove the
damaged section and replace the base and repave itWe then have to seal the
driveway to ensure no cracks or other damage due to weather/erosion occursDue
to our climate, this installation needs to occur soonas the temperatures needs
to stay stable in order for the pavement to be laid downAs a customer it is worrisome to not have an answer as to how the company is going to fix the defect and now we will have to wait until the beginning of August at the earliest to have the problem rectifiedThis is of course if the crew is back working again by the start of August which is a very big maybe
Due to thisour original resolution is still what my wife and I are
seekingThis resolution is that we are asking that East Coat Paving refund at
least half of what we spent on the job they completed that has been deemed
defective by other paving companies and people I have contacted at the Department of Transportation. In
addition, the owner of the company owes myself and my wife an apology for the
way in which he spoke to us on Thursday June 25, as it should be the customer should be put first and not be put down for questioning a businesses work or final product. Attached are some pictures of the defective area in questionThey were taking four weeks after the job was completed and as recently as days short of weeks this Thursday July 16. As the Pictures show indentations and sinking are still occurring
Regards,
*** ***

The owner of the company had bypass surgery. He was in icu for a wk. He's is still heavily medicated. This surgery was totally unexpected. At this point we cant get them the answers they want. We don't no what paving companies they spoke to but as long as the weather holds up we work up to and through October. There is plenty of time to fix the driveway. We understand their urgency and wanting this resolved quickly. The secretary told [redacted] that as soon as she can speak to Tom she will get an answer for him as to how Toms going to do to fix the driveway. We are just asking that they be a little patient. It will get done. Addressing the way Tom spoke to the homeowners. What happened was the secretary had just hung up with the home owner minutes before Tom arrived to their home. The secretary told them that Tom had felt that they parked the RV or some heavy truck on the new addition and he had told laurels father(he was there the day the work was done)not to park on the addition for a month. The homeowners got upset with that answer. Tom showed up moments later to their house and the homeowners came flying out of the house angry. Tom reacted to them and got defensive. He regrets that and he feels they both acted irrationally.
