Initial Business Response / [redacted] (1000, 8, 2016/12/22) */ We are providing here a response to [redacted] ***'s complaint In order to fully respond to Mr [redacted] and his allegations, it is necessary to first provide some foundation regarding Live Out Loud programsLive Out Loud has been in existence since 2002, and has provided education and services for tens of thousands of peopleLive Out Loud provides educational programs to assist individuals to build and grow businesses and wealth through both active and passive endeavorsLive Out Loud has created over these many years, a robust series of proprietary educational programs that teach principles to create and grow sound businesses, and accelerate financial growthLive Out Loud provides supplementary coaching, seminars, and workshops to assist clients in implementing the education Live Out Loud has worked directly with the Nevada Attorney General's Office to confirm that the proprietary educational content mentioned above constitutes "Delivery of Program." This content is delivered to the client upon enrollment in the program so that they can immediately begin studying the principles and steps to successWhile we strongly recommend that each client utilize all of the other services included with the education, it is the responsibility of the client to take action in studying, attending events, scheduling and attending coaching sessions with Live Out Loud coaches, etcSince Live Out Loud cannot guarantee that the client will take action, we also cannot guarantee resultsAll we can do is to provide the educational content, and make available the seminars, coaching, workshops, and any other components included with the client's programThe client must be open to receive information, and take action on coaching recommendations, training from seminars, concepts from the educational content, etc Clients enroll in Live Out Loud programs via signed agreements where the deliverables to be provided by Live Out Loud are clearly outlined, and where the client agrees to receive those deliverables, and to take action to implement the principles, steps, and strategies includedMr [redacted] signed agreements at two different junctures, for his first enrollment, and about one month later when he upgraded to a more comprehensive program, as will be described below Mr [redacted] has made some unsubstantiated allegations, and statements he has made are slanted to support Mr***'s point of viewIn this response, we will include substantiated and documented information 1) Mr [redacted] attended an event in mid-September of 2015, and our documentation shows that an order from Mr [redacted] to participate in the Live Out Loud $100k Challenge program was processed on 9/15/2015, along with an order to participate in the Live Out Loud Days to Cash educational program and seminar 2) Access was provided to the educational content associated with these two programs on 9/15/2015, completing, as noted above, the requirements established by the Nevada State Attorney General's Office for Delivery of program 3) Included with the notifications emailed to Mr [redacted] that provided these connections to products was an email that explained getting started with the program, and requested that Mr [redacted] work with us to schedule a time to meet to discuss getting started with his programQuoting from that email: "Complete the Welcome/Orientation Call.Let's work together to schedule this call as soon as possiblePlease provide me with suggestions for when is the best time to reach you." Included was additional information as to why this call is important, and my direct email to reach out and communicate with meIt should be noted that the subject line for this email stated: "Welcome to ***'s $100k Challenge Program." Subsequent attempts were made to get a response and schedule a meeting with Mr***, and Mr [redacted] indicates that he was receiving emails from us--but chose to delete them? Again, we do not have control over the actions of the client 4) Also included in this email was instruction on filling out and submitting a Client profile to be used in the assignment of a one on one coach to begin the coaching process, along with the direct link to connect to this profile form, and informing Mr [redacted] that he must complete this form in order for us to assign a coach to start the coaching processAll of this was sent on 9/15/Mr [redacted] alleges that a coach was not assigned immediately--here is the statement in the email explaining the process: "One of the first things we ask you to do in the program is to fill out your Client Profile, which is used to assign your one on one coach." 5) Mr [redacted] was given access to multiple weekly live group coaching sessions, in which he could have immediate direct contact with coaches to evaluate their assistanceMr [redacted] alleges that Live Out Loud coaches are not qualified to provide business coachingLive Out Loud has strict requirements for coaches, that require them to have substantial business and coaching experience, plus actively operating a businessAll of our coaches meet and exceed these requirementsSpeaking only for myself as a member of the coaching staff, I have over years entrepreneurial experience, and years coaching experience on real estate and entrepreneurial subjectsI have been an international keynote speaker on real estate and natural health topics, have published two books, formulated nutritional supplements and created a network marketing company for distribution, served as the CEO for this company, plus constructed, owned and operated a manufacturing facility, founded and co-hosted a syndicated radio program, operated a successful real estate investing company, am a partner in a publishing and coaching company, have edited books for television show hosts, and have created content and curriculum for over different educational leaders and gurusAnd honestly, some of our coaches have even greater success records, so Mr***'s conclusion that the coaches are unqualified is grossly inaccurate 6) Mr [redacted] claims that it was "nearly impossible" to make contact with Live Out Loud, and yet states that he received many different emailsAll of these emails include contact information for response, which makes it impossible to believe that Mr [redacted] did not have contact informationI can personally attest that, in spite of emails to him with my contact information included, I did not receive anything from Mr [redacted] until he started asking for a refund 7) Mr [redacted] upgraded his program to The Big Table in October of 2015, and participated in Orientation Calls on October 13, and on October 22, During these calls it was verified that he had received the program accesses described above, and knew and understood how to use themOur records show that a Client Profile was finally received from Mr [redacted] on 12/29/2015, which is a pre-requisite to assignment of a one on one coachSo Mr [redacted] understood the process and verified that on the phone, took a very long time to submit the Client profile, and then did not choose to properly engage in his program by following up to schedule the proper coaching appointmentsLive Out Loud granted Mr [redacted] the ability to start his coaching even though Mr***'s account shows that he is only partially paid on his programAnd Live Out Loud has offered Mr [redacted] the opportunity of shifting his program to a lower priced program where he would be paid in full and eligible to receive all of the services in that program 8) Finally, Mr [redacted] indicates that he received a $3k refund from Live Out LoudThis was in regard to services from an affiliated 3rd party vendor, where funds were collected but the services from this other vendor were not providedLive Out Loud only retains funds when a services agreement has been properly executed, as described in the information aboveSo Mr [redacted] bringing up that point is kind of an apples and oranges situation To summarize this response: 1) Mr [redacted] joined Live Out Loud programs TWICE by signed agreement; 2) Live Out Loud has delivered the proprietary education content and has made available ALL of the services included in the agreement; 3) Mr***'s refund request was reviewed by Live Out Loud and a decision was made that a refund would not be offered based on the signed agreementMr [redacted] then initiated a chargeback with his credit card companyLive Out Loud submitted a response to the credit card company who then reversed the chargeback, indicating they felt that Mr***'s chargeback action was without merit 4) Live Out Loud remains constant in its willingness to deliver serviceMr [redacted] has been offered the opportunity to transfer enrollment into a different program if desiredLive Out Loud's background demonstrates an ability to assist clients in busines growth, we would be happy to assist Mr [redacted] as we have assisted many th Initial Consumer Rebuttal / [redacted] (3000, 10, 2017/01/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) I have not slanted any of my opinions to support my point of viewI have stated and continue to state facts about how this company works My responses to Live Out Loud's responses are below 1) I was attending a seminar in mid-September hosted by Global Publishing, not a Live Out Loud event [redacted] was there and spoke, very convincingly and powerfullyThrough Global Publishing, prior to this seminar, I had already paid to attend a days to cash eventDuring [redacted] 's presentation, she was upselling a program of hers called the 100k challengeShe stated those in attendance could pay half down ($3,000) and then the balance when we went "live." She even wrote that herself on my invoiceThe only thing I signed that day was my credit card slipI was told I would be contacted by a person on her staff to begin the process 2) I did not receive access to this educational content that Live Out Loud is referring toI had to call several times and left messages with no return phone callsFinally, I received a call back and we started the discussion of what I needed to do to get started in the programI hadn't paid in full at that time so according to that person, I was not going to be able to really begin until I paid in full 3) I did receive emails from Live Out LoudThe ones I chose to delete were marketing emails that were trying to upsell me something elseMost emails from Live Out Loud at that point were marketing emailsSee number two above for details on them being in contact with meThey did not until I finally made enough phone calls to them for the Big Table 4) I did not receive an orientation email for the Big Table from them until I finally called and gotten a call backThat was after the days to cash seminar, after I had signed up for the Big TableA few days after I returned home from the days to cash seminar, I received a call from a woman from Live Out Loud that was trying to get me to spend another $10,000! After I said no many times, she became belligerent and insulting to meI finally hung up on her 5) I talked with two coaches (or what I thought were coaches potentially?) and neither one of them had business experience but were just spewing generic informationI already had a business established and they were trying to "go by the script" and tell me how to start my businessThey did not listen or try to coach me and start coaching me at the point I was at in my business 6) I made several attempts to contact Live Out Loud and left several messagesI finally contacted the sales agent that I signed up with and then I received a call backI also asked her if she could stop the annoying and harassing sales calls from Live Out Loud trying to get me to invest in special one of a kind programs and investments from Ms [redacted] And if you do a simple search of reviews online, you can see that many people have difficulty reaching a live person at Live Out Loud 7) I did participate in callsI don't recall being verified for anything and I would seriously doubt they have proof that they did verify anythingI spoke to one person who called himself a coach or at least made it sound like a coaching callHe was advising me how to set up my businessI explained to him that I had a real estate coach and didn't need or want coaching in that fieldBut the whole conversation kept going back to that"Partially paid" on my program they say? I don't have any idea what they are talking about because my credit card accounts can prove that they were all paidIt would be against all that Ms [redacted] stands for and preaches to render services before money is collectedAt no time was I offered the ability to downgrade my programThis was paid in full (balance of $920) within a week after the majority of it was paidEven at her days to cash events, her puppets teach people how to ask for money and get it, even if they do not even have a product or service to sell yet 8) Services were never renderedThat is why, when Global Publishing contacted Live Out Loud to request a refund, it was grantedMy thought on this is so that both companies can continue to have a working agreement because they both make money with each otherThat $3,was taken off the $25,price tag of the big table costAs far as apples and oranges, that shows that it was indeed used for the same program 9) When you purchase something and find out after the unreasonably impossible day exploration period that it is not something that you want, a refund should be allowedI didn't go on for months using their services 10) I signed only one agreementThe other was a credit card receipt for my charge that Global Publishing made 11) The credit card company denied my first chargeback attempt because I did not understand that I could make a responseI now know and am in process of opening another dispute 12) Live out loud may be willing to continue to deliver service and I do acknowledge they have contacted me about thatAfter talking with at least two coaches, listening in on a couple of group calls, and started reviewing some of the "proprietary information" I am not satisfied with the program and that is when I asked for a refundI have coaches in real estate that I have invested a lot of money in and have gone through their programs successfullyThese coaches knew what they were doing and their programs have helped me find success in real estate where my business continues to growThis demonstrates that going through a program and following the outline and rules is not difficult for me to doLive out loud was not able to provide this kind of coaching or program to help another business of mine flourishTheir program is very generic and not focused on any kind of business

1) Live Out Loud (LOL) is a provider of education, training, and coaching programs to assist
people to create and develop businesses, assets and investmentsLive Out Loud has provided these services for thousands of people for their financial success since
2) The programs in which *** enrolled are educational programs with supporting coaching services to assist with implementation of the educationThe proprietary educational content is supplied immediately so that the client can begin utilizing this training and educationLive Out Loud has also worked with the Nevada Attorney General's office to confirm that providing this educational content access constitutes "Delivery of Program." So the educational content is placed in the hand of the client up front, and then the coaching is provided as they begin to implement their program
3) Because clients wish to move at their own individual speed, LOL provides clients with a welcome/orientation email and a welcome/orientation callIn both media, we provide instructions on how to begin utilizing their program, and make certain that they have access to all the educational content, know how and where to fill out the client profile that will assign their one on one coach, and provide them with specific assignments for to engagement steps to utilize their program, and impress on them that it is their responsibility to take these actions
*** enrolled in a bundled package of components that includes the $100k Challenge program, a very directed program for increasing revenue through a personally owned business, including step by step tasks for successfully increasing revenue by $100k within one year, and backed by a performance guarantee; she also enrolled in the Days to Cash workshop, an on site seminar that teaches business skills and sales; also a Make New Money online program for business skills development; also the Millionaire Maker Academy, an independent study to guide a person in building wealth development skills; plus Fast Cash Coaching, that provides live group coaching sessions every week, including holidays; and the Millionaire Maker Success Kit, a collection of independent study programs on business development, debt management, mindset, sales, asset management, etc
*** enrolled in this composite program on 11/07/2015, that was end of day on SaturdayOn Monday morning she was connected to all the the educational content for her program--i.e., the program was delivered per the Nevada A.G.'s office specificationsShe received the welcome/orientation email on MondayAn appointment was scheduled and conducted with *** on Tuesday, and it was confirmed that she had received the content, access and welcome email on MondayShe was continuing to ask for information and content regarding her program on Friday 11/13/2015, through a voice messageAnd an additional call took place that week for additional clarification on the program
*** claims that she made multiple contacts with our officeShe was contacted by our funding team that provides arrangements for business lines of credit to grow your business--one of the most valuable assets in business growth is leverage, as any successful business will attestThis seems to have angered ***, although the offer is optional and actually requires a person to qualify to participateIt appears that this precipitated a request for a refund, the request was made outside the rescission period for signed contracts, and *** rescission rights had been included and clarified with the signing of her agreement
Due to the fact that *** program had been delivered and she was outside her rescission period, it was explained to *** that a refund could not be offered, but that her program remains in full effect, and LOL remains committed to the continued delivery of services associated with her programAnd as we had indicated, we would need a client profile from her to match her with a specific one on one coach*** has not submitted this profileLive Out Loud considered the matter of a refund closed at that point
Several months later, *** contacted Live Out Loud again, even though we had previously informed her that a refund would not be providedThis time her story was completely differentInstead of saying that she wanted to cancel because she did not like the fact that we had offered her business funding, she began claiming that her request was for personal financial reasons, regarding family status, an illness, etc
It was indicated to *** that if she has additional information, we could forward that information to the Live Out Loud Resolutions Committee, as a request for an exception to company policyThe information was reviewed, the decision not to provide a refund was reaffirmed, and *** was notified, at which time it was also indicated that LOL still remains committed to assisting her through the provision of our education, coaching, and training servicesThe old saying about teaching a man to fish instead of providing him a fish applies here, Live Out Loud is committed to assisting people with life-long changes through learning new skills, developing business, and learning how to properly invest and acquire assets
It should be noted that after this second review, *** notified Live Out Loud that she would be embarking on a campaign to damage Live Out Loud for failing to provide her with what she has asked forThe methods that she mentioned as her steps are in direct violation to the methods of resolution that are outlined in her signed agreementLive Out Loud would much prefer to work with *** to assist her with business growth than to have to take action against a kind of "vendetta" type campaign that *** has initiated
We recognize that people experience difficulties in their lives, but future growth and success are dependent upon learning new ways to operate our lives, not from backing away from a program that can assist with thatWhen a person enrolls in a LOL program, we explain to them that they have chosen a great path, but that the path will involve effort on their part, and that seeking guidance from those with more experience in business growth is the clearest path to making changes--and that we hold people accountable to their own decisions to make changes, even when sometimes they want to backpedal on those decisions and signed agreementsThat is the nature of coaching, whether it is for an athlete, or for a business leader or entrepreneurQuitting is not a path to success
Live Out Loud is happy to work with *** with respect to her program and its various components, and would also be open to reexamine her enrollment to see if there would be other program components that would be more amenable to her

Let me begin by indicating that we are very sorry to hear about health challenges in *** familyWe have found over the years that such challenges create financial needs, and that usually these needs are ongoing needsLive Out Loud
is a unique company that truly assists people to learn "how to fish, rather than providing a fish." In this way they are able to resolve financial challenges permanently rather than temporarily
*** enrolled in a Live Out Loud education, training, coaching, and seminar program called Loral's Big Table on 3/23, She made a deposit toward this program of $1000, and received the educational access to multi media programs that deliver the proprietary information of the program on 3/25/Per the Nevada Attorney General's office, this constitutes delivery of the programThe additional services were placed on hold pending the completion of her payment on the programShe has had access to this educational content throughout the program, and was welcomed into the program by phone call on 3/25, From that date until the present, *** has had access to all of this education and our live group coaching calls held multiple times per weekAll of these provide proprietary content and procedures that are exclusive to Live Out LoudAnd education is not something you can simply send back like a dress that doesn't fit--once you learn something, you cannot unlearn it
Several attempts have been made by our office to reach *** through the intervening years, and to offer her access to other Live Out Loud programs that could be completed with the deposit that she has made, and would require no additional payment from ***
In *** file, I see phone attempts were made on the following dates regarding her program, and also to invite an opportunity, if needed, to shift to a different program that we could provide additional services without further payment from herThe dates that I see listed for phone call attempts are 6/14/13, 10/10/13, 8/7/14, 8/8/14, 11/26/14, 4/28/15, and 5/4/That does not include other dates when emails were sentThere are reports of leaving messages on several of those datesIn other words, Live Out Loud has been conscientious in maintaining contact over more than three years of time
*** reports having made a request for a refund in May Since requests of this nature are directed through me to the Live Out Loud Resolutions Committee, I have checked to see if there were any forwarded emails or other requests recorded in her account file, and cannot see any indications of requests being madeHad I been made aware, it would have reinvigorated the conversation of how Live Out Loud could finish the provision of services to ***Even though it is now years and months after her enrollment, Live Out Loud remains perfectly open to provide assistance to ***, although her contract for services expired months after her enrollment
To summarize, Live Out Loud has provided, and continues to provide service on *** original agreement, as we have done for almost 1/years, and would be happy to assist *** through our programs to be able to better provide for her family financially through developing ways to produce more revenueUtilizing Live Out Loud services is the best way to develop long term financial stability through development of a business or assetsThat seems like a very positive and forward thinking resolution

[redacted] (Client) initially joined $100k coaching program, and was to be working with her daughter on that program. Then she joined the Real Estate As Leverage program Modules 1 and 2. Here's a summary of my communications and experience...

from things that she has mentioned either in emails or in conversations.
1) I did onboarding with [redacted], she expressed from the beginning some financial problems. I provided her with a couple of additional sessions, at least 45 minutes or longer each to discuss her direction. She was struggling with what her cash machine would be, and also wanted me to talk with her daughter [redacted]. I tried through [redacted] and also attempted to schedule time with [redacted] directly, that never ended up happening.
2) [redacted] then joiined the Real Estate program, Modules 1 and 2. In welcoming her, she was disappointed that the program was not starting immediately. I later found out that she spent money without conferring with her husband and expected to do a deal quickly enough to replace it. [redacted] was the first person to join the program for this time period, but I had explained that we would not start until we had a few enrollments. I sent [redacted] some emails with some instructions on getting started and had two one on one sessions with her to help her get started before the group sessions began.
3) She claims that she was told things in the sales process that are not included in the agreement form. I have explained to her that we cannot give claims as to how soon or how much money you will make, and that this is a long-term strategy for success, not a quick cash process, and that she would need to work with her $100k coach on her existing business, which I think is hypnosis, for a more quick cash approach.
4) [redacted] was very inconsistent in attending live sessions, I think she may have attended 2 out of 6 of the REAL sessions in Module 1. Of course, we make all of the information available via recordings, powerpoints, document and script files that she could reference. We began sessions right after the holidays, at the beginning of January, and added an additional recording each week. She had immediate access to all information as it was created through a dropbox folder.
5) When we started Module 2 of REAL, [redacted] complained that she was told that the entire program was about Wholesaling. I had informed her in Welcome session that we would be covering a variety of strategies, beginning with Wholesaling in Module 1, then Rehabbing and Sandwich Lease Option/Seller Finance in Module 2. I explained that this would include two strategies that require very little money and no credit in order to be able to complete successful transactions.
6) [redacted] informed me in one private call that she was going to be working with a remote market, then it appears that she shifted to her small market in southwestern [redacted], and was having difficulty finding properties and buyers. She also complained that she heard from someone that wholesaling doesn't work--I asked if the person had done any successful deals. She said no. I informed her that I had worked with thousands of people over the years, and that the active ones had all put deals together, including during current market conditions, and encouraged her to broaden her methods of finding both properties and cash buyers.
In summary, regardless of the program, whether $100k or the Real Estate program, [redacted] has had more to say in complaint about what she was told, or what she felt doesn't work, or the amount of help she received from us, or our response time, etc., than any positives. I have personally spent more time with [redacted] privately coaching her than with 98% of the rest of the people who join the program. We have people using the same instructions as were given to [redacted] and putting deals together in various locations around the country, so it cannot be the information, we're teaching the same things we have taught to thousands of successful investors over 18 years of investing and coaching. [redacted] chooses to focus on what isn't working for her rather than finding a solution, and we have certainly tried to help her past that.
We remain willing and ready to continue the program [redacted] purchased as stated in the signed agreement. The program, like any other educational endeavor, relies on the student's participation and application of the material taught to produce desired results. The fact that we are in our 15th year of coaching, mentoring and providing educational platforms, attests to our commitment to our clients success in this industry.

I do not agree with Live out Louds resolution.
Again, I reiterate, I thought I was sold just one 100K Challenge program, which consisted of consulting to get my hypnotherapy business off the ground. I only found out later that I had actually purchased two programs. When I called for a refund on the second, I was told that the second was for my husband, and they would not refund the money. Trying to act in good faith and salvage the money, I spoke to Valerie. I asked if the program could help my daughter in publishing her book. She had already self-published it, but I thought it might be a shot. Valerie told me they could.
Then my daughter was forgotten, until I asked again, which I have copies of those emails. I have kept copies of all correspondence I have had with Live out Loud. My husband still receives the emails regarding the 100k Challenge, my daughter has only received emails from [redacted] It was painfully obvious to me, once beginning the program that the program was not going to help my daughter even remotely. It was not structured for finding a publisher.
The following is my address to each point made by Live out Loud in numerical order:
1) I did not express financial problems. There was never a question as to my cash machine, since I had already began putting together a business plan for a Hypnotherapy Clinic before I ever spoke to Live out Loud. [redacted] did speak to [redacted]once, and he tried to steer her in the direction of selling t-shirt and key-chains, instead of working to getting her book published.
2) I did not, nor would I ever, spend money without conferring with my husband. We wouldn't have been married for 22 years if I had. I was disappointed. It became painfully obvious that the real estate program was just a class and not a mentorship as had been sold to me. They can try and send me any additional information they want, the bottom line is that the program is NOT how the salesmen had sold it. It is not what I had consented to pay for.
3) I am not, nor was I ever, asking for a guarantee of making money. My complaint is that I am not getting what I paid for, consulting and mentoring.
4) I did attend the classes, and when there was a scheduling conflict, I listened to the recording. Not that it matters, I had paid for a mentor, not classes.
5) My complaint was that I was still waiting for the course to cover remote wholesaling, which it did not. I was surprised that the class was moving forward before the information I needed was even addressed.
6) I never even considered doing wholesaling in [redacted]. Matter of fact, had the salesman been honest with what their Real Estate Program was, I wouldn't have signed. He never came right out and said what it was, he acted like it was some big secret. He said that I didn't need any sales experience to make it work. Had I known it was preying on those that were going through difficult times, I would have never agreed. It is heart wrenching, and disgusting.
[redacted]is right, I have complained a lot. Which I hate to do, but I am not getting the information nor the support that I paid for. I have a right to complain, and to be angry. And [redacted]should know. I think he is the only one that works there that is not on a sales team. He helps with the 100k challenge, he does the real estate program, cash machine seminars, big table seminars, and apparently complaints too. Maybe some of the problem lies with staffing, there is not enough people there to actually mentor or consult with.

In responding to [redacted] most recent response, I would like to first address the fact that [redacted] is alleging things in which she is using some very potent terminology. Fraud and misrepresentation are things that a person cannot just "toss out there"--these are things that actually need to be proved in court. That requires evidence. In order to set the record straight, I'm going to attach the list of deliverables associated with [redacted] multiple program components. Live Out Loud provided [redacted] with a clear, comprehensive, and complete list of deliverables in the agreement forms that she signed in enrolling in her programs, and the agreement forms also indicate that this is the ONLY list of products and services included with her program. And then, I'd challenge [redacted] to make any claims about her program and what was promised to her, compared against the actual program declarations.
I've reviewed the original order, in which [redacted] claims that she is entitled to a refund because of being double charged. The order actually shows that [redacted] purchased a partner version of a program that is bundled. This is like buying a [redacted], or getting a bundle on your telephone, internet, and cable TV services, where you receive a reduced price buy purchasing things together. Based on our published prices at the time that [redacted] purchased, she enrolled in 4 different programs, the $100k Challenge program, the Internet Marketing 101 program, the 3 Days to Cash program, and the Millionaire Maker Academy program, and she was given the partnership version of the program at a price that was less than what we would have charged for the individual programs if the program had been purchased separately. The bundle not only saved her money on all the components, but it saved her over $9200 vs. the partner version of these components if purchased separately.
I will also be attaching the deliverables for the Real Estate program. And once again, [redacted] received about $2k discount in bundling the two modules of the program together. But more importantly, the attachment documents will indicate what was promised, and the basis upon which program delivery is to be evaluated.
A big point in [redacted]'s argument is that she says that she did not receive "consulting or mentoring." Live Out Loud programs have been defined as education and coaching. The term mentoring is sometimes used due to its close association with coaching, but we never use the term "consulting" in association with Live Out Loud programs. For the record, the Merriam Webster definition of mentoring is: "someone who teaches or gives help and advice to a less experienced and often younger person." The service that we have provided to [redacted] fits perfectly with that definition--and we have provided education and coaching as well.
I have another question that I think helps to crystallize the situation. If [redacted]'s experience with Live Out Loud services was so unproductive, why did she utilize so much of my time in coaching, training, and mentoring her? She has "consumed" much of her program in coaching and training sessions and personally scheduled time, and also requested a refund. Unfortunately, that is much like ordering a meal, consuming all but a few bites, and then attempting to return it and say you did not like it. I've spent time talking with [redacted] and her daughter as a part of her $100k Challenge, she has also used several of the coaching sessions that came with that program. I have spent time analyzing property deals with [redacted] on several occasions, plus discussing ways to find properties, evaluate properties, work with real estate professionals, build money relationships, etc. This time spent with her is in addition to a robust series of training sessions that are recorded, and which [redacted] has admitted also in her communication here to having consumed, some live, and some by reviewing recordings that we have made available on demand. [redacted] still has access to thousands of dollars worth of proprietary information that has been used successfully by other people to make millions of dollars.
I do want to say this--we set a precedent of openness at the beginning of the relationship where [redacted] could contact us at any time for assistance, or to schedule appointments to talk about her program. If there have been any missed emails or requests along the way, it is not because we are unwilling to assist, but in our programs we deal with a lot of other people as well. We expect that our clients will make more than one attempt to reach us if they have a need, as we may be assisting other people.
We are still very willing to provide service to [redacted], the same service that has been effective for thousands of people we have worked with in Live Out Loud. [redacted] is a very intelligent person, the steps to success are straightforward, and simply require repetition in order to produce positive results. Live Out Loud cannot provide a refund on a program where a person has consumed a great deal of the program, but we would undoubtedly be able to arrange for additional coaching for her at no additional cost--we remain committed to [redacted] and her family's success.

We are providing here a response to [redacted]'s complaint.
In order to fully respond to Mr. [redacted] and his allegations, it is necessary to first provide some foundation regarding Live Out Loud programs. Live Out Loud has been in existence...

since 2002, and has provided education and services for tens of thousands of people. Live Out Loud provides educational programs to assist individuals to build and grow businesses and wealth through both active and passive endeavors. Live Out Loud has created over these many years, a robust series of proprietary educational programs that teach principles to create and grow sound businesses, and accelerate financial growth. Live Out Loud provides supplementary coaching, seminars, and workshops to assist clients in implementing the education.
Live Out Loud has worked directly with the Nevada Attorney General's Office to confirm that the proprietary educational content mentioned above constitutes "Delivery of Program." This content is delivered to the client upon enrollment in the program so that they can immediately begin studying the principles and steps to success. While we strongly recommend that each client utilize all of the other services included with the education, it is the responsibility of the client to take action in studying, attending events, scheduling and attending coaching sessions with Live Out Loud coaches, etc. Since Live Out Loud cannot guarantee that the client will take action, we also cannot guarantee results. All we can do is to provide the educational content, and make available the seminars, coaching, workshops, and any other components included with the client's program. The client must be open to receive information, and take action on coaching recommendations, training from seminars, concepts from the educational content, etc.
Clients enroll in Live Out Loud programs via signed agreements where the deliverables to be provided by Live Out Loud are clearly outlined, and where the client agrees to receive those deliverables, and to take action to implement the principles, steps, and strategies included. Mr. [redacted] signed agreements at two different junctures, for his first enrollment, and about one month later when he upgraded to a more comprehensive program, as will be described below.
Mr. [redacted] has made some unsubstantiated allegations, and statements he has made are slanted to support Mr. [redacted]'s point of view. In this response, we will include substantiated and documented information.
1) Mr. [redacted] attended an event in mid-September of 2015, and our documentation shows that an order from Mr. [redacted] to participate in the Live Out Loud $100k Challenge program was processed on 9/15/2015, along with an order to participate in the Live Out Loud 3 Days to Cash educational program and seminar.
2) Access was provided to the educational content associated with these two programs on 9/15/2015, completing, as noted above, the requirements established by the Nevada State Attorney General's Office for Delivery of program.
3) Included with the notifications emailed to Mr. [redacted] that provided these connections to products was an email that explained getting started with the program, and requested that Mr. [redacted] work with us to schedule a time to meet to discuss getting started with his program. Quoting from that email: "Complete the Welcome/Orientation Call. . .Let's work together to schedule this call as soon as possible. Please provide me with suggestions for when is the best time to reach you." Included was additional information as to why this call is important, and my direct email to reach out and communicate with me. It should be noted that the subject line for this email stated: "Welcome to [redacted]'s $100k Challenge Program." Subsequent attempts were made to get a response and schedule a meeting with Mr. [redacted], and Mr. [redacted] indicates that he was receiving emails from us--but chose to delete them? Again, we do not have control over the actions of the client.
4) Also included in this email was instruction on filling out and submitting a Client profile to be used in the assignment of a one on one coach to begin the coaching process, along with the direct link to connect to this profile form, and informing Mr. [redacted] that he must complete this form in order for us to assign a coach to start the coaching process. All of this was sent on 9/15/2015. Mr. [redacted] alleges that a coach was not assigned immediately--here is the statement in the email explaining the process: "One of the first things we ask you to do in the program is to fill out your Client Profile, which is used to assign your one on one coach."
5) Mr. [redacted] was given access to multiple weekly live group coaching sessions, in which he could have immediate direct contact with coaches to evaluate their assistance. Mr. [redacted] alleges that Live Out Loud coaches are not qualified to provide business coaching. Live Out Loud has strict requirements for coaches, that require them to have substantial business and coaching experience, plus actively operating a business. All of our coaches meet and exceed these requirements. Speaking only for myself as a member of the coaching staff, I have over 30 years entrepreneurial experience, and 20 years coaching experience on real estate and entrepreneurial subjects. I have been an international keynote speaker on real estate and natural health topics, have published two books, formulated nutritional supplements and created a network marketing company for distribution, served as the CEO for this company, plus constructed, owned and operated a manufacturing facility, founded and co-hosted a syndicated radio program, operated a successful real estate investing company, am a partner in a publishing and coaching company, have edited books for television show hosts, and have created content and curriculum for over 25 different educational leaders and gurus. And honestly, some of our coaches have even greater success records, so Mr. [redacted]'s conclusion that the coaches are unqualified is grossly inaccurate.
6) Mr. [redacted] claims that it was "nearly impossible" to make contact with Live Out Loud, and yet states that he received many different emails. All of these emails include contact information for response, which makes it impossible to believe that Mr. [redacted] did not have contact information. I can personally attest that, in spite of emails to him with my contact information included, I did not receive anything from Mr. [redacted] until he started asking for a refund.
7) Mr. [redacted] upgraded his program to The Big Table in October of 2015, and participated in Orientation Calls on October 13, and on October 22, 2015. During these calls it was verified that he had received the program accesses described above, and knew and understood how to use them. Our records show that a Client Profile was finally received from Mr. [redacted] on 12/29/2015, which is a pre-requisite to assignment of a one on one coach. So Mr. [redacted] understood the process and verified that on the phone, took a very long time to submit the Client profile, and then did not choose to properly engage in his program by following up to schedule the proper coaching appointments. Live Out Loud granted Mr. [redacted] the ability to start his coaching even though Mr. [redacted]'s account shows that he is only partially paid on his program. And Live Out Loud has offered Mr. [redacted] the opportunity of shifting his program to a lower priced program where he would be paid in full and eligible to receive all of the services in that program.
8) Finally, Mr. [redacted] indicates that he received a $3k refund from Live Out Loud. This was in regard to services from an affiliated 3rd party vendor, where funds were collected but the services from this other vendor were not provided. Live Out Loud only retains funds when a services agreement has been properly executed, as described in the information above. So Mr. [redacted] bringing up that point is kind of an apples and oranges situation.
To summarize this response:
1) Mr. [redacted] joined Live Out Loud programs TWICE by signed agreement;
2) Live Out Loud has delivered the proprietary education content and has made available ALL of the services included in the agreement;
3) Mr. [redacted]'s refund request was reviewed by Live Out Loud and a decision was made that a refund would not be offered based on the signed agreement. Mr. [redacted] then initiated a chargeback with his credit card company. Live Out Loud submitted a response to the credit card company who then reversed the chargeback, indicating they felt that Mr. [redacted]'s chargeback action was without merit.
4) Live Out Loud remains constant in its willingness to deliver service. Mr. [redacted] has been offered the opportunity to transfer enrollment into a different program if desired. Live Out Loud's background demonstrates an ability to assist clients in busines growth, we would be happy to assist Mr. [redacted] as we have assisted many th

I have not slanted any of my opinions to support my point of view. I have stated and continue to state facts about how this company works.
My responses to Live Out Loud's responses are below.
1) I was attending a seminar in mid-September 2015 hosted by Global Publishing, not a Live Out Loud event. [redacted] was there and spoke, very convincingly and powerfully. Through Global Publishing, prior to this seminar, I had already paid to attend a 3 days to cash event. During [redacted]'s presentation, she was upselling a program of hers called the 100k challenge. She stated those in attendance could pay half down ($3,000) and then the balance when we went "live." She even wrote that herself on my invoice. The only thing I signed that day was my credit card slip. I was told I would be contacted by a person on her staff to begin the process.
2) I did not receive access to this educational content that Live Out Loud is referring to. I had to call several times and left messages with no return phone calls. Finally, I received a call back and we started the discussion of what I needed to do to get started in the program. I hadn't paid in full at that time so according to that person, I was not going to be able to really begin until I paid in full.
3) I did receive emails from Live Out Loud. The ones I chose to delete were marketing emails that were trying to upsell me something else. Most emails from Live Out Loud at that point were marketing emails. See number two above for details on them being in contact with me. They did not until I finally made enough phone calls to them for the Big Table.
4) I did not receive an orientation email for the Big Table from them until I finally called and gotten a call back. That was after the 3 days to cash seminar, after I had signed up for the Big Table. A few days after I returned home from the 3 days to cash seminar, I received a call from a woman from Live Out Loud that was trying to get me to spend another $10,000! After I said no many times, she became belligerent and insulting to me. I finally hung up on her.
5) I talked with two coaches (or what I thought were coaches potentially?) and neither one of them had business experience but were just spewing generic information. I already had a business established and they were trying to "go by the script" and tell me how to start my business. They did not listen or try to coach me and start coaching me at the point I was at in my business.
6) I made several attempts to contact Live Out Loud and left several messages. I finally contacted the sales agent that I signed up with and then I received a call back. I also asked her if she could stop the annoying and harassing sales calls from Live Out Loud trying to get me to invest in special one of a kind programs and investments from Ms. [redacted]. And if you do a simple search of reviews online, you can see that many people have difficulty reaching a live person at Live Out Loud.
7) I did participate in calls. I don't recall being verified for anything and I would seriously doubt they have proof that they did verify anything. I spoke to one person who called himself a coach or at least made it sound like a coaching call. He was advising me how to set up my business. I explained to him that I had a real estate coach and didn't need or want coaching in that field. But the whole conversation kept going back to that. "Partially paid" on my program they say? I don't have any idea what they are talking about because my credit card accounts can prove that they were all paid. It would be against all that Ms. [redacted] stands for and preaches to render services before money is collected. At no time was I offered the ability to downgrade my program. This was paid in full (balance of $920) within a week after the majority of it was paid. Even at her 3 days to cash events, her puppets teach people how to ask for money and get it, even if they do not even have a product or service to sell yet.
8) Services were never rendered. That is why, when Global Publishing contacted Live Out Loud to request a refund, it was granted. My thought on this is so that both companies can continue to have a working agreement because they both make money with each other. That $3,000 was taken off the $25,000 price tag of the big table cost. As far as apples and oranges, that shows that it was indeed used for the same program.
9) When you purchase something and find out after the unreasonably impossible 3 day exploration period that it is not something that you want, a refund should be allowed. I didn't go on for months using their services.
10) I signed only one agreement. The other was a credit card receipt for my charge that Global Publishing made.
11) The credit card company denied my first chargeback attempt because I did not understand that I could make a response. I now know and am in process of opening another dispute.
12) Live out loud may be willing to continue to deliver service and I do acknowledge they have contacted me about that. After talking with at least two coaches, listening in on a couple of group calls, and started reviewing some of the "proprietary information" I am not satisfied with the program and that is when I asked for a refund. I have coaches in real estate that I have invested a lot of money in and have gone through their programs successfully. These coaches knew what they were doing and their programs have helped me find success in real estate where my business continues to grow. This demonstrates that going through a program and following the outline and rules is not difficult for me to do. Live out loud was not able to provide this kind of coaching or program to help another business of mine flourish. Their program is very generic and not focused on any kind of business.

We at Live Out Loud wish to express our sincere apologies for the experience and frustration that [redacted] had regarding the start she had with the 100K Program and Entity Services purchased on May 22, 2017. After reviewing the timeline of events documented in the client's letter, and all parties included, we agree that there were some unique circumstances that affected the timeline of some of the deliverables of her program. However, there is a significant portion of education and proprietary content that were delivered in a timely fashion (via private members area of www.liveoutloud.com) and which the client has had access to without interruption since May 30, 2017. As Live Out Loud is first and foremost an education company empowering its clients to become more informed and confident in their financial activity, we place enormous importance on our clients engaging in the education so they understand the reasons and options they have when in contact with the financial services providers. To the point regarding delays, there were several factors that were unforeseen as well as understandable in our opinion, due to the Memorial Day holiday on May 30th, 2017. As with any major holiday during the year, it can and does affect businesses in a variety of ways. In our experience, holidays are used as milestones and deadlines to accomplish tasks and goals. In this scenario, we do see spikes in business volume and customer service requests both leading up to and after the actual holiday. We do acknowledge that [redacted] experienced a longer than normal time frame for getting connected to her coach and to the entity provider, however only by a couple days, not an expanse of time that would necessitate cancellation and refund. Regarding the Entity provider, he was actually on a week-long vacation with his family starting on Memorial Day, but his office was in contact with the client the following week to set up an appointment (June 7).
Regarding coaching, the process of choosing a coach based on information provided by the client, notifying client and coach, and allowing for communication to be exchanged, we feel the timeline was not unreasonable. A coaching assignment was emailed to client and coach on Thursday, May 31, 2017. Communication was had between client and coach that same day via email which resulted in a follow up "welcome email" from the coach and notification that she

typically coached on Tuesdays & Wednesdays and would send a schedule of open coaching
dates as soon as possible. After Memorial Day, and only 3 business days, the schedule was sent to client (on June 5th), with request to choose from the available dates, one of which was the very next day on June 6th. To be clear, the client had many other available dates to choose from as well. Regarding being restricted to 9-5 and 30 minute coaching calls, coach Janet is not inflexible and would (and does) make exceptions for clients whenever necessary for earlier or later start times and 30 minutes in our experience (18 years) is very much sufficient for a focused coaching call.
Regarding the first actual coaching call, below are coach Janet's notes from the call with [redacted]:
"From my call notes, we had a good call, I reviewed the power-point slides for the first call which is standard procedure for all 100K Challenge first calls. Her homework was to create a written down marketing plan and I guided her through the process to do so and provided a template as well. She expressed on the call and on her coaching agenda form that her most pressing issues were pricing, finding a web developer, and deciding on a CRM. I gave her ideas on how to determine pricing, a reference for finding a developer on [redacted]and some things to consider when choosing a CRM.
On June 8th, [redacted] sent me an email thanking me for the recommendation for a contact on [redacted] At that time, she indicated no dissatisfaction with the program, the coaching, her coach (me), or Live Out Loud."- Coach Janet Fish

The timeline of some of the interaction between the Entity provider and [redacted]'s coach was certainly affected (delayed) by the Memorial holiday, but we feel with respect to actual business days to process and connect with said people, this was not unreasonable.
Live Out Loud is fully ready, willing, and happy to provide all services comprised in the purchase by [redacted] and we are willing to go over and above typical fulfillment to ensure successful and satisfactory delivery of the package purchased by her. We sincerely care about each and every client and fully intend to assist this client to her We are sorry we have not met her expectations to this point but feel that considering the timeline around Memorial Day holiday fulfillment has been reasonable. We look forward to an opportunity to assist [redacted] getting re-engaged and moving forward toward her goals with our programs that have been successfully in existence for more than 18 years.

The program is a time-sensitive program (1 year). Yet, they are making excuses for their untimeliness. I purchased the service on May 18, not May 22 as they state. Lack of integrity. I have the credit card statement and document to prove it. In addition, since I have not used most of the services or received the entity formation, there is nothing stopping them from returning my funds. I still want a full refund for services not rendered and time wasted. As I told Deanna and as they can check from my login I have not accessed their services since June 7 when I made my complaint. What is their reason for not returning my money? Did I attend all coaching sessions, receive the entity and ask for a refund? No. They have not given me a reason why they are not returning my money. I'm not happy with their services and they are trying to force me to work with them again instead parting ways. Total scam. Total lack of integrity. Lack of professionalism.
