gave a deposit for a car that was on [redacted],car sold to some one else for more and the deposit was kept.our conversation started on [redacted] for a purchase of a [redacted] rxX XXXX vin number [redacted]XXXXXXX ,on [redacted] deposit was made for $1000.00 once the deposit was sent the buyer said they would remove the car from [redacted]. The seller sold the car to someone else and then kept the deposit,HE SAID "held the car for you on my word. you never paid the balance so I am keeping the deposit"the balance was to be paid once the seller removed the item from [redacted]. Further there is suspected fraud on the sellers part as they item sold for above the Buy it now price that was $12500 (sold for XXXXX) and above what the two parties had agreed to pay. IC3.gov doc has already been filed and will be sent by the buyer.Desired Settlementi just want my $1000.00 deposit back that's allBusiness Response [redacted]I am responding to the case mentioned above. Mr [redacted] put a $1000.00 deposit on a vehicle that I had for sale on [redacted] The deposit was to secure the purchase of the vehicle. Mr. [redacted] either was unable to come up with the funds to purchase the vehicle or changed his mind regarding the purchase and did not fulfill his end of the contract, thus forfeited his deposit. He was given a deadline to pay for the vehicle, then I extended it in order to help him fulfill his obligation. He chose not to complete the purchase or was unable to do so. At this point he forfeited his deposit. The purpose of the deposit was to hold the vehicle until paid for. I held the vehicle for as long as I said I would and fulfilled my end of the contract. Whether I sold the vehicle afterwards or not has nothing to do with the fact that Mr [redacted] did not fulfill his obligation. He has already lost a dispute with [redacted] If he chooses to litigate this matter, we welcome the challenge as we did nothing wrong. Thank you
