Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: [Your Answer Here] MESSAGE FROM BUSINESS: In response to [redacted] complaint: We met with [redacted] when she first brought her car for a CARCO inspection (photo inspection for insurance company); at that time we told her that we can service all auto body and auto repairs, except for state inspections for which Eastern Automotive is on the waitlist We never claim or advertise to be a NYS Inspection Station Rather, as an ancillary service or as courtesy and convenience to our customers who request it, we take in a vehicle, check it out and repair it, and then bring the vehicle to a licensed inspection facility If Eastern Automotive is not a registered inspection station in New York, then why I would bring my car to them for a vehicle inspection? This begs the question if you, (Eastern Automotive) do not have the equipment and proper licensing to legally perform inspections from the Department of Motor Vehicles in the State of New York you should not be taking in, through convoluted language, misleading impressions, or “Good Samaritan” roleplaying, any vehicles whatsoever in for “Inspections”, period The translation of your writings that you “Are Providing An Ancillary Service Or As A Courtesy and Convenience” to your customers walks upon a very frail line and wreaks of fraudulent practices It truly appears by your behavior and actions that you are conveniently confusing the best interests of your customers with those of none other than your own I do not appreciate being deceived [redacted] is misinformative in his statement that he dropped off his vehicle and asked me if I perform state inspections The word is misinformed and I am not I directly asked Ted the question of whether or not Eastern Automotive performed state inspectionsHe answered yes that he did Now that Eastern Automotive is being called to task and being held accountable, they have shifted their position and are now claiming that they in fact do not perform state inspectionsHow convenient is this as well as just being short of an amazing coincidence The reason why the vehicle was left with Eastern Automotive was so it could be inspectedAgain, I brought my vehicle in to Eastern Automotive be inspected because Ted said they performed state inspections I would have never left the vehicle with him if he did not offer a state inspection service Please give an explanation as to why this question should be categorized as “Misinformative” Rather, [redacted] called my shop prior to the vehicle coming in, informed my secretary that she had a car that was way past its inspection due date and that it had been sitting a long time as it had an inspection issue She told us that she thought it needed an Osensor and said she was dropping it off During that conversation she was again informed that we do not do state inspections but if she wanted we would check-out the car, do whatever it may need and then take it to an inspection facility to which she agreed I am really having a hard time convincing myself of what I just read as truthful so I am going to write it down to possibly help me better understand itHere goes: Firstly, my wife just agreed to let someone perform a state inspection on our vehicle who has just informed her that they do not perform state inspectionsDoes this makes sense? Secondly, she also just agreed that they can do whatever to remedy any problems that were found by means other than a valid New York State inspection test along with a pass/fail reportThis also makes sense? Thirdly, she then finally agreed to bring the vehicle to someone else to perform the actual inspection that should have been performed by, and was brought to Eastern Automotive, in the first placeShe also agreed to this? When asked if she remembers any of this she replied: “Why is he lying? Why would I bring the car in for an inspection to someone who just told me that they do not do state inspections? I would have just brought it to a registered inspection station and been done with it.” Eastern Automotive once again states that they “Do not do state inspections” yet continues to perform some sort of uniquely distorted version of a vehicle state inspectionWhy? Numerous requests to Eastern Automotive to explain their actions have gone unanswered The car was dropped off by them after hours on Sunday, 715, with a note attached stating that I should call them and that her husband Steve would tell me what it needs That note, signed by *** [redacted] , is uploaded here After we performed a diagnosis, I called *** [redacted] and informed him that the car had an engine and emissions code for an evaporator canister (not Osensor), and it also had antilock and transmission codes as wellI told him that the car needed an evaporator canister and after the evaporator canister is installed the car must be driven to set the monitors so it would pass inspection, as it will outright fail otherwise I have asked Eastern Automotive several times to provide me with the state inspection failure report that is generated when a vehicle fails inspectionThey could not provide or produce it Also requested was a computer printout of the association between the vehicle unable to pass inspection and the evaporative canister and why it needed to be replacedEastern Automotive once again could not provide this information He gave his permission to perform this work, which I did I offered him the old part – as it is shop policy with every part replacement - back he refused it, that it was ok Permission was given to perform the work based on the fact that he (Ted) clearly stated when asked that the inspection failure report indicated that this was the only problem that was preventing the vehicle from passing inspection What he failed to mention that no report was really ever generated, (and as I learned later on) and no report would ever be made available because the vehicle was never connected or linked to an NYS DMV inspection computer for proper analysis As far as the part, the question was not if he had replaced the part, but rather why he replaced the part which in turn led to the request for the failure report from Eastern AutomotiveThe part was left with him so he could put it back in the vehicle which he refused to do In order to set the monitors, he gave me permission to drive the car to set those monitorsAfter driving the car for approximately miles (at no additional charge!) the emission codes were fixed and there was only this monitor left to set Setting this monitor could entail one mile or fifty miles of driving to reset What I was actually told by Ted of Eastern Automotive was that I needed to drive the vehicle a minimum of miles non-stop and not to under any circumstances shut the vehicle off for the entire mile journey This is when I began to question (Ted) Eastern Automotive and asked for validation on why this is necessaryAt this point Ted nervously looked away, dismissed my requests to see his state inspection equipment/credentials and said to just do exactly as I was told or else the vehicle would never pass inspection I too now became nervous I released the car to him on Friday, 7/***15, stating that I really could not take any more time to drive his car (for which he did not want to be charged any additional labor) and he should drive it over the weekend and simply bring it back to me and I would computer scan it to see if the remaining monitor set The only driving the vehicle needed was that of driving to a station that is properly equipped to inspect vehicles in New York State I did not at all tell [redacted] that a [redacted] was the only facility with the proper equipment; rather, I advised him, that there are occasions when vehicles, despite test driving, take some time with adjustments to set monitors Eastern Automotive admitted that they could not get the vehicle to pass inspection and indeed did say that it needed to go to a [redacted] to clear the transmission codes that he said were now preventing the vehicle from passing inspection Ted at no time suggested that I bring the vehicle to someone, unlike him, who actually possess a registered NYS DMV computer to properly link, test, and inspect the vehicle It was only when I began to disregard his bizarre czar-like orders of driving the vehicle hundreds of miles non-stop to clear the codes and brought it elsewhere that the vehicle passed inspection *** [redacted] came into my shop on Monday screaming that he took the car to another facility where it passed inspectionI replied that I was thrilled that we (my work) set the monitors and it passed, but he proceeded to scream at me that I should never have worked on his car if I did not have theproper equipment (which is nonsense and untrue) I have given ample opportunities to Eastern Automotive to fix the vehicle so it could pass inspectionThey could not How could Eastern Automotive ever get the vehicle to pass inspection if they could never link the vehicle to the DMW inspection computer? If this is indeed nonsense and untrue, then why does Eastern Automotive continue to refuse to show me their inspection equipment, registration certificate and the failed inspection report for the vehicle? I tried to tell him that I indeed have the proper equipment and computers to diagnose the vehicle but he would not stop yelling long enough to either hear what I was saying or figure out his misunderstanding or assumptions When asked several times to see Eastern Automotive’s state inspection equipment, they responded with a curt, “No” The bottom line is this: the car needed an evap canister; if I had not replaced it the car would have never passed any state inspection at any inspection station; How can Eastern Automotive conclude that the Evaporative Canister needed to be replaced to pass inspection when they never ran a legitimate inspection to begin with? Again, Eastern Automotive, please provide the failed inspection report to validate your claims I had *** [redacted] see the old evap canister, offered him the old part, which he had refused to take it Again, as far as the Evaporative Canister part, the question was not if he had replaced the part, but rather why he replaced the part in the first place This in turn led to the request for the inspection failure report which Eastern Automotive either would not or could not ever produce I went above and beyond what any shop owner would have done for its customer, driving the car for many hours, without additional charge, monitoring and adjusting the codes to get all the monitors to set, which proved successfulThere is no way that car would have ever passed state inspection without the evap canister being replaced and without me driving the car to adjust the monitors and successfully reset the codes, as I did with all the codes Again, how can Eastern Automotive conclude that the Evaporative Canister needed to be replaced to pass inspection when they never ran a legitimate state inspection test to begin with? Again, Eastern Automotive, please provide the failed inspection report from NYS DMV to validate your claims And we did not charge him for diagnosing, test driving, and resetting the codes (for which we expended a good amount of time)! Eastern Automotive did not charge for “Performed Services” because even they realized they could never really validate the charges I have been a mechanic for over years with credentials and certifications (NYS and NYC Certifications; NYS Certified DMV Inspector and Appraiser; NYC Certifications of Fitness, Training Emissions Performance (STEP); Engine Electronics Training; Computerized Performance Systems; Fuel Injection Systems; NYS DMV Automotive Excellence Program SAEP Technician; Manager Software for Auto Repair, etc.), and I take pride in my work and business Unfortunately, years of service has left Ted of Eastern Automotive with nothing more than a very selective memory What has been conveniently left out from Ted of Eastern Automotive conga line of personal accolades, achievements, and awards is a current registration as a NYS DMV Inspection Station Remember Ted, this is why the vehicle was brought to you in the first place, to be inspected Ted never disclosed he was on the DMV “Waitlist”Never Ted never disclosed he was not a registered inspection stationNever Ted never disclosed that the vehicle would have to be ultimately inspected by “Others”Never I understand [redacted] [redacted] layman’s frustration but he is making statements and claims that are disingenuous, without context or nexus, technically and actually incorrect and simply offending Yes or no Eastern Automotive, are you NYS DMV registered inspection station? Yes or no Eastern Automotive, can you substantiate the work you performed with a valid report? Yes or no Eastern Automotive, have you contacted and made the NYS DMV aware that you are performing “Inspections” on vehicles while you remain on their “Waitlist”? Yes or no Eastern Automotive, was the vehicle ever linked to an official NYS DMV inspection computer by you for proper analysis? Yes or no Eastern Automotive, are these questions “disingenuous, without context or nexus, technically and actually incorrect and simply offending” or rather are they simply questions Eastern Automotive rather not answer? If I am guilty and suffer from “Layman’s Frustration” as claimed by Ted, I will assume the role of judge and jury and then find Ted guilty of Professional Deception We are entitled to every penny we charged and got paid for the work (labor and parts) that that we provided to MrWiencek per his approval, which by the way got his car (which was uninspected for a long time) to pass inspection I want a full refund of $by Eastern AutomotiveThey provided an unsubstantiated, needless services and were never able to get the vehicle to pass inspection Any approved charges that were agreed to were because Ted said they were necessary for the vehicle to pass inspection which, in the end, were nothing more than baseless stabs at parts changing and proved false Ultimately, once the vehicle was taken away from Eastern Automotive and brought to a registered NYS DMV inspection station with people possessing the proper technical training and equipment, the vehicle passed inspection in minutes In conclusion, Eastern Automotive’s self-flattery and claiming responsibility for the vehicle passing inspection is, and remains, laughable on all accounts In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]
