This is in response to complaint [redacted], filed by [redacted]: As Ms. [redacted] stated, we were contracted to build an inground swimming pool at her residence. In her complaint, she raises several issues as to installation questions and...

responsibilities.  First and foremost, seems to be a misunderstanding regarding what ‘rough grading’ involves. In general, we will use our excavator while on site to perform a rough grade that brings dirt to approximately the bottom of the concrete level in areas that are accessible with our Bobcat excavator. I believe that Ms. [redacted] expected the level to be to the top of the concrete, but if we had done that, topsoil brought in and spread by the landscaper would have then been too high and dirt/mud would ultimately have washed into the pool. Also, due to the yard’s layout, much of it was inaccessible to the Bobcat once concrete was poured. Per our contract, we would have spread up to ten yards of customer-provided topsoil in Bobcat accessible areas if it had been there at the time of construction, but as it was not, we could not do so. As a landscaper was coming in following the completion of our work, it only seems natural that they would be doing this as part of the yard’s finish work. Also, in a couple of areas where there are drainage issues causing pooling water, this is because drainage pipe needs installed by the landscaper. Even had we had been able to grade these areas by hand, these areas would have washed out if drainage work had not been performed by a qualified landscaper first. As we are not landscapers, this type of work falls outside our area of expertise and that is why we specifically exclude it in our contract. Ms. [redacted] also discusses us digging up a downspout line. We did indeed hit an underground drainage line but rerouted it and reconnected it to open space for proper drainage. Again, this is something excluded in our contract but we did attempt to accommodate her to the best of our abilities. Again, any additional drainage issue need to be addressed by a quality landscaper and performed by them as part of their service. The remaining drain line mentioned could not have been relocated without significant additional cost and labor and is outside the scope of our project, specifically because of the existing ‘T’ where this pipe connected to another. We do greatly appreciate Ms. [redacted]’s business and visited her at her home on Friday October 13th to address the issues she has. I hope that our answers and explanations were satisfactory to clear up any misunderstandings she might have had regarding our responsibilities during the construction process and if she still has questions, we would ask that she call and discuss them further.
